OILANDNATURALGAS
BYTHEGRACEOFGODALMIGHTY
THEPRESIDENTOFTHEREPUBLICOFINDONESIA
Considering:
a.whereasthenationaldevelopmentmustbeaimedtoachievewelfareforthepeoplebyreformingallaspectsofthenationalandstatelifeonthebasisofthestateideologyofPancasilaandthe1945Constitution;
b.whereasPetroleumandNaturalGasarenon-renewablestrategicnatural-resourcescontrolledbythestateandconstitutesavitalcommoditythatcontrolsthelifeofthepublicatlargeandplaysanimportantroleinthenationaleconomy,thustheExploitationofPetroleumandNaturalGasmustbeabletoprovidemaximumcontributiontothepeople'
sprosperityandwelfare;
c.whereasPetroleumandNaturalGasrelatedbusinessactivitiesplaysimportantroleinprovingrealaddedvalueforanimprovedandsustainablenationaleconomicgrowth;
d.whereasLawNumber44Prp.Of1960concerningPetroleumandNaturalGasMining,LawNumber15of1962concerningtheStipulationofaGovernmentRegulationToReplaceLawNumber2of1962concerningtheObligationofOilCompaniestoMeettheDomesticDemands,andLawNumber8of1971concerningState-OwnedOilandGasMiningCompaniesarenolongersuitabletomeetthedemandsofthePetroleumandNaturalGasminingbusinessdevelopments;
e.whereasbycontinuouslyobservingthenationalandinternationaldevelopments,itisdeemednecessarytoamendthelegislationonPetroleumandNaturalGasminingsoastheymaycreateanindependent,reliable,transparent,competitive,efficientandenvironmentalfriendlyPetroleumandNaturalGasbusinessactivities,aswellasencouragethegrowthofnationalpotentialandrole;
f.whereasbasedontheconsiderationsasreferredtointheabovepointsa,b,c,dandeaswellastoprovidelegalbasisfortherenewalandarrangementofthePetroleumandNaturalGasbusinessactivities,itisdeemednecessarytopromulgateaLawonPetroleumandNaturalGas;

(2)and(3)ofthe1945ConstitutionasalreadyamendedbytheSecondAmendmenttothe1945Constitution;
2.StipulationofthePeople'
sConsultativeAssemblyoftheRepublicofIndonesiaNumberXV/MPR/1998concerningtheImplementationofRegionalAutonomy;
Regulation,Distribution,andExploitationoftheNationalResourcesontheBasisofthePrincipleofJustice;
aswellasFinancialBalancebetweentheCentralGovernmentandtheRegionalGovernmentwithintheframeworkoftheUnitaryStateoftheRepublicofIndonesia.

CHAPTERI
GENERALPROVISION
Article1
ReferencetothefollowingunderthisLawshallmean:
1.Petroleumshallmeantheresultofthenaturalprocessintheformofhydrocarbonthatwilltaketheformofaliquidorsolidmaterialinapressurizedconditionandatanatmospheretemperature,includingasphalt,mineralcandleorozokeritandbitumenobtainedfromtheminingprocess,excludingcoalandsedimentsofotherhydrocarbonintheformofasolidmaterialprocuredduringnon-PetroleumandNaturalGasbusinessactivities.
2.NaturalGasshallmeantheproductsofanaturalprocessinformofhydrocarbonthatwilltaketheformofagasinapressurizedconditionandatanatmospheretemperature,whichisprocuredfromaPetroleumandNaturalGasminingprocess.
3.PetroleumandNaturalGasshallmeanpetroleumandnaturalGas.
4.OilFuelshallmeanthefuelderivedand/orprocessedfromPetroleum.
5.MiningConcessionshallmeantheauthoritydelegatedbytheStatetotheGovernmenttocarryoutExplorationandExploitationactivities.
6.GeneralSurveyshallmeanfieldactivitiescomprisingthecollection,analysisandpresentationofdatarelatingtogeologicalconditioninformationtopredictthelocationandpotentialofPetroleumandNaturalGasresourcesoutsidetheWorkingArea.
7.UpstreamBusinessActivitiesshallmeanthebusinessactivitiesfocusedorbasedonExplorationandExploitationbusinessactivities.
8.ExplorationshallmeantheactivitiesaimedatobtaininggeologicalconditioninformationtofindandestablishanestimateofPetroleumandNaturalGasreservesinthestipulatedWorkingArea.
9.ExploitationshallmeanaseriesofactivitiesaimedtoproducePetroleumandNaturalGasfromthestipulatedWorkingArea,consistingofdrillingandwellcompletionactivities,constructionofthetransport,storageandprocessingfacilitiestofilterandrefinethePetroleumandNaturalGasonthefieldaswellasothersupportingactivities.
10.DownstreamBusinessActivitiesshallmeanthebusinessactivitiesfocusedorbasedontheProcessing,Transport,Storageand/orTradingactivities.
11.Processingshallmeantherefinery,procurementofparts,qualityimprovementandimprovingtheaddedvalueofPetroleumand/orNaturalGas,excludingon-siteprocessing.
12.TransportshallmeantherepositionofPetroleum,NaturalGasand/ortheirprocessedproductsfromtheWorkingAreaorfromthestoragesiteandProcessingplant,includingthetransportofNaturalGasthroughthetransmissionanddistributionpipes.
13.Storageshallmeanthereceipt,collection,storageanddischargeofPetroleumand/orNaturalGas.
14.Tradingshallmeanthepurchase,sales,exportation,andimportationofPetroleum,NaturalGasand/ortheirprocessedproducts,includingtheTradingofNaturalGasthroughpipelines.
15.IndonesianMiningJurisdictionshallmeantheentireIndonesianmainland,watersandcontinentalshelfterritories.
16.WorkingAreashallmeanacertainregionwithintheIndonesianMiningJurisdictionwheretheExplorationandExploitationactivitiestakeplace.
17.BusinessEntityshallmeanacompanyintheformofalegalentitythatengagesinabusinessonapermanentandcontinuousbasis,andisestablishedinaccordancewiththeprevailinglegislationandisdomiciledintheterritoryoftheUnitaryStateoftheRepublicofIndonesia.
18.PermanentBusinessEntityshallmeanabusinessentityestablishedintheformofalegalentityoutsidetheterritoryoftheUnitaryStateoftheRepublicofIndonesiathatengagesinactivitieswithintheterritoryoftheUnitaryStateoftheRepublicofIndonesiaandisobligedtocomplywiththeprevailinglegislationoftheterritoryoftheUnitaryStateoftheRepublicofIndonesia.
19.CooperationContractshallmeantheProductionSharingContractorothermodelsofCooperationContracttoengageintheExplorationandExploitationactivities,fortheinterestoftheStateandtheresultsofwhichshallbeusedtothemaximumextenttoimprovethepeople'
swelfare.
20.BusinessLicenseshallmeanthelicensegrantedtoaBusinessEntitytoProcess,Transport,Storeand/orTradewiththeaimofgaininganadvantageand/orprofit.
21.CentralGovernmenthereinafterreferredtoastheGovernmentshallmeantheinstrumentoftheUnitaryStateoftheRepublicofIndonesiaconsistingofthePresidentandtheMinisters.
22.RegionalGovernmentshallmeantheHeadoftheRegionalongwithotherinstrumentsofanAutonomousRegionastheRegionalExecutiveBoard.
23.ImplementingAgencyshallmeantheagencyestablishedtocontroltheUpstreamBusinessActivitiesinthePetroleumandNaturalGassector.
24.RegulatoryBoardshallmeantheboardestablishedtoregulateandsupervisethesupplyanddistributionofOilFuelandNaturalGasintheDownstreamBusinessActivities.
25.MinistershallmeantheMinisterinchargeofPetroleumandNaturalGasbusinessactivities.
CHAPTERII
PRINCIPLEANDOBJECTIVE
Article2
TheimplementationofPetroleumandNaturalGasbusinessactivitiesstipulatedunderthisLawshallbebasedontheprinciplesofpeopleorientedeconomy,integration,benefit,justice,balance,equaldistribution,collectiveprosperityandpublicwelfare,security,safetyandlegalcertaintyprinciplesaswellasenvironmentallyfriendly.
Article3
TheimplementationofPetroleumandNaturalGasbusinessactivitiesshallbeaimedto:
a.guaranteetheeffectiveimplementationandcontrolovertheExplorationandExploitationbusinessactivitiesofthestate-ownedPetroleumandNaturalGasthatarestrategicandnonrenewablebynaturethroughanopenandtransparentmechanismsoasitwillbeeffective,efficient,highlycompetitiveandsustainable;
b.guaranteetheeffectiveimplementationandcontrolovertheProcessing,Transport,StorageandTradingbusinessesbasedontheprincipleofaccountabilityandcarriedoutthroughareasonable,fairandtransparentbusinesscompetitionmechanism;
c.guaranteetheefficientandeffectivesupplyofPetroleumandNaturalGas,bothasasourceofenergyandmaterialforthedomesticdemand;
d.supportandpromotethenational’scapacitytoincreaseitsabilitytocompetenationally,regionallyandinternationally;
e.increasethestate’sincometoprovideamaximumcontributiontothenationaleconomyandtodevelopaswellasstrengthenthepositionofindustryandtradeinIndonesian;
f.createjobopportunities,improvethepublicwelfareandprosperityinafairandequallydistributedmanner,whilecontinuouslymaintainingthepreservationoftheenvironment.
