Article1ThepresentRegulationisformulatedinaccordancewiththeLawofthePeople'

sRepublicofChinaonRoadTrafficSafety（hereinafterreferredtoastheLRTS）.

Article2Allvehicledrivers,pedestrians,passengers,roadtrafficactivity-relatedentitiesandindividualswithintheterritoryofthePeople'

sRepublicofChinashallabidebythepresentLaw.

Article3Thelocalpeople'

sgovernmentsatthecountylevel 

or 

aboveshallestablishandperfecttheroadsafetycoordinationmechanism,organizetherelevantdepartmentstoevaluatetheimpactofurbanconstructionprojectsonthetraffic,formulateanadministrativeplanningonroadtrafficsafety,determineanadministrativetargetandmakeanimplementationplan.

ChapterIIVehiclesandDrivers

Section1MotorVehicles

Article4Theregistrationsofmotorvehiclesshallbeclassifiedintoinitialregistration,modificationregistration,transferregistration,mortgageregistrationandcancellationregistration.

Article5Whenapplyingfortheinitialmotorvehicleplate 

drivingpermit,anapplicantshallfileanapplicationtothetrafficadministrativedepartmentofthepublicsecurityorganwherethedomicileoftheownerofthemotorvehicleislocated.Whenapplyingfortheinitialmotorvehicleregistration,anapplicantshallhavethemotorvehiclecheckedandshallsubmitthefollowingcertificatesandvouchers:

（1）Theidentificationproofoftheownerofthemotorvehicle;

（2）Thepurchaseinvoiceandotherproofsoftheprovenanceofthemotorvehicle;

（3）Theconformitycertificateissuedwhenthewholemotorvehicleleavesthefactory 

theimportdocumentationoftheimportedmotorvehicle;

（4）Theproofofpaymentofvehiclepurchasetax 

tax-exemptiondocumentation;

（5）Theproofofmandatorymotorvehiclethirdpartyliabilityinsurance;

（6）Otherproofsandcertificatesprescribedbyanylaw 

administrativeregulationtobesubmittedfortheregistrationofthemotorvehicle.

Ifthetypeofthemotorvehicleisn'

tonethatisexemptedfromsafetytechnicalinspectionaccordingtotheprovisionsoftheadministrativedepartmentformotorvehicleproductsoftheStateCouncil,theapplicantshallprovideaqualitycertificateofsafetytechnicalinspectionapartfromtheabove-mentionedcertificationandproofs.

Article6Wherearegisteredmotorvehicleisunderanyofthefollowingcircumstances,theownerofthemotorvehicleshallfileanapplicationtothetrafficadministrativedepartmentofthepublicsecurityorgan,inwhichthismotorvehiclehasbeenregistered,formodifyingtheregistration:

（1）Thecolorofitsbodyischanged;

（2）Itsengineischanged;

（3）Itsbody 

frameischanged;

（4）Thewholemotorvehicleischangedbythemanufacturerduetoanyqualityproblem;

（5）Thecommercialoperatingmotorvehicleischangedtonon-commercialoperatingmotorvehicle 

viceversa;

（6）Theownerofthemotorvehiclehasmovedinto 

outofadomicilewithinthejurisdictionofthetrafficadministrativedepartmentofthepublicsecurityorgan.

Whenapplyingformodificationregistrationofamotorvehicle,theapplicantshallsubmitthefollowingcertificatesandproofs.IfthemotorvehicleisunderanyofthecircumstancesaslistedinItems

（1）through（5）oftheprecedingparagraph,theapplicantshallhavethemotorvehiclecheckedapartfromsubmittingthefollowingcertificatesandproofs;

ifthemotorvehicleisunderthecircumstanceaslistedinItem

（2） 

（3）oftheprecedingparagraph,theapplicantshallsimultaneouslysubmittheconformitycertificateuponsafetytechnicalinspectionaswell:

（2）Themotorvehicleregistrationcertificate;

and

（3）Themotorvehicledrivingpermit.

Wheretheownerofamotorvehiclechangeshisdomicilewithinthejurisdictionofthetrafficadministrativedepartmentofthepublicsecurityorgan,thenameoftheowner（entity） 

contactway,heshallreporttothetrafficadministrativedepartmentofthepublicsecurityorgan,inwhichthemotorvehiclehasbeenregistered,forarchivalpurposes.

Article7Wheretheownershipofaregisteredmotorvehicleischanged,thepartiesconcernedshalldulygothroughthetransferregistrationformalities.

Whenapplyingfortransferregistration,thepartiesconcernedshallhavethemotorvehicleinspectedbythetrafficadministrativedepartmentofpublicsecurityorganwherethemotorvehicleisregistered,andshallsubmitthefollowingcertificatesandproofs:

（1）Theidentificationproofsofthepartiesconcerned;

（2）Thecertificate 

proofofthetransferoftheownershipofthemotorvehicle;

（3）Themotorvehicleregistrationcertificate;

（4）Themotorvehicledrivingpermit.

Article8Wheretheownerofamotorvehiclemortgagesthemotorvehicle,he（she）shallfileanapplicationformortgageregistrationtothetrafficadministrativedepartmentofthepublicsecurityorganwherethemotorvehiclehasbeenregistered.

Article9Wherearegisteredmotorvehiclemeetsthemandatorydiscardstandardsofthestate,thetrafficadministrativedepartmentofthepublicsecurityorganshallinformtheownerofthemotorvehiclethatheshallgothroughtheformalitiesforcancellationregistrationtwomonthsbeforethediscardperiodexpires.Theownerofthemotorvehicleshallsellthemotorvehiclethecorrespondingrecyclingenterprise,whichshallsubmitthediscardedmotorvehicleregistrationcertificate,plate,drivingpermittothetrafficadministrativedepartmentofthepublicsecurityorganforcancellation.Iftheownerofthemotorvehiclefailstogothroughtheformalitiesforcancellationregistrationwithinthetimelimit,thetrafficadministrativedepartmentofthepublicsecurityorganshallannouncethattheregistrationcertificate,plateanddrivinglicenseofthismotorvehiclearenullandvoid.

Whereanapplicationforcancellationregistrationduetoloss 

damagetothemotorvehicle,theownerofthemotorvehicleshallsubmithis（her,its）ownidentificationprooftothetrafficadministrativedepartmentofthepublicsecurityorganaswellasthemotorvehicleregistrationcertificate.

Article10Wheretheproofsandcertificatessubmittedbyanapplicantformotorvehicleregistrationarecompleteandvalid,theformalitiesforregistrationshallbecompletedbythetrafficadministrativedepartmentofthepublicsecurityorganonthespot.

Withregardtoamotorvehicleseized 

detainedbythepeople'

scourt,people'

sprocuratorate 

administrativelawenforcementdepartment,thetrafficadministrativedepartmentofthepublicsecurityorganshallrefusetoregisterthemotorvehicle.

Article11Wheretheownerofmotorvehicleappliesforanewregistrationcertificate,plate 

drivingpermitbecausetheformeroneislost 

destroyed,heshallsubmithisidentificationproofandapplicationmaterialstothetrafficadministrativedepartmentofthepublicsecurityorgan.Uponverifyingagainsttheregisteredfilesofthismotorvehicle,thetrafficadministrativedepartmentofthepublicsecurityorganshallissueanewregistrationcertificate,plate,drivingpermittotheapplicantwithin15daysfromthedaywhentheapplicationisreceived.

Article12Thetaxdepartment 

insuranceinstitutionmay,inacentralizedway,handlethemotor-vehicle-relatedtaxpayments 

conclusionofinsurancecontractsattheofficeofthetrafficadministrativedepartmentofpublicsecurityorgan.

Article13Theplateofamotorvehicleshallbefixedatthespecifiedplacesofthefrontandbackofthemotorvehicle,andshallbekeptclearandcomplete.Anenlargedplatenumbershallbepaintedatthebackofthebody 

containerofaheavylorry,medium-typetruck 

tractoranditstrailer,thelettersshallbestandardandclear.

Themotorvehicleconformityinspectionmarkandtheinsurancesignshallbestuckontheuppercorneroftherightofthefrontwindowofthemotorvehicle.

Anymark,sign, 

advertisementpaintedonthebodyofamotorvehicleshallnotaffectthesafetyofdriving.

Article14Aroadpassengerautomobile,heavylorry 

semi-trailertractorshallbeequippedwith 

useadrivingrecordinstrumentthatmeetsthestandardsofthestate.Thetrafficpolicemayexaminethedrivingspeed,consecutivedrivingtimeandotherdrivinginformationofmotorvehicles.Theinstallationofdrivingrecordinstrumentsmaybecarriedoutinseveralsteps,whichshallbespecifiedbytheadministrativedepartmentformotorvehicleproductoftheStateCounciljointlywithotherrelevantdepartments.

Article15Themotorvehiclesafetytechnicalinspectionshallbeconductedbythemotorvehiclesafetytechnicalinspectioninstitutionsaccordingtothestandardsofthestateonmotorvehiclesafetytechnicalinspection.Themotorvehiclesafetytechnicalinspectioninstitutionsshallbearthelegalliabilitiesfortheinspectionconclusions.

Thequality&

technicalsupervisorydepartmentshallberesponsibleforthequalificationmanagementandmeasureauthenticationmanagementrelatedtothemotorvehiclesafetytechnicalinspectioninstitutions,shallcheckandtestthemotorvehiclesafetytechnicalinspectionequipment,andshallsupervisetheimplementationof
