Article1Inordertoregulatetheestablishmentandimplementationofadministrativelicenses,toprotectthelegitimaterightsandinterestsofcitizens,legalpersonsandotherorganizations,tosafeguardpublicinterestsandsocialorder,toensureandsupervisetheeffectiveimplementationofadministrativemanagement,theLawisformulatedinaccordancewiththeConstitution.

Article2Theterm"

administrativelicenses"

asmentionedintheLawreferstotheactsthattheadministrativeorganspermit,uponexaminationaccordingtolaw,thecitizens,legalpersonsorotherorganizationtoengageinspecialactivitiesaccordingtotheirapplications.

Article3TheLawshallbeapplicabletotheestablishmentandimplementationofadministrativelicenses.

TheLawshallnotbeapplicabletotheexaminationandapprovalofsuchmattersaspersonnel,financeandforeignaffairsofrelevantadministrativeorganstootherorgansorpublicinstitutionsdirectlyundertheiradministration.

Article4Theestablishmentandimplementationofanadministrativelicenseshalltallywithlegalauthority,scope,conditionsandprocedures.

Article5Theprincipleofpublicity,fairnessandimpartialityshallbeabidedbyintheestablishmentandimplementationofanadministrativelicense.

Therelevantregulationsonanadministrativelicenseshallbeannouncedtothepublic;

thoseundisclosedshallnotbethebasisfortheimplementationoftheadministrativelicense.Theimplementationoftheadministrativelicenseandtheresultsthereof,exceptforthosethatconcernthestatesecrets,commercialsecretsorindividualprivacy,shallbedisclosed.

Theapplicantswhomeetthelegalconditionsandstandardsareentitledtoobtaintheequalrightunderanadministrativelicense,theadministrativeorgansshallnotdiscriminateagainstanyofthem.

Article6Intheimplementationofadministrativelicense,theprincipleoffacilitatingpeopleshallbeabidedbysoastoenhancetheefficiencyandtorenderqualityservices.

Article7Withregardtoanadministrativeorgan'

simplementationofanadministrativelicense,thecitizens,legalpersonorotherinstitutionsshallbeentitledtomakestatements,todefendthemselves,toapplyforadministrativereconsiderationortofileanadministrativelawsuitinaccordancewiththelaw.Whereanyoftheirlegalrightsandinterestsisimpairedbecauseoftheadministrativeorgans'

unlawfulimplementationoftheadministrativelicense,itshallbeentitledtodemandcompensationinaccordancewiththelaw.

Article8Theadministrativelicenseobtainedbyacitizen,alegalpersonoranyofotherorganizationsinaccordancewiththelawshallbeprotectedbylaw.Theadministrativeorgansshallnotchangeaneffectiveadministrativelicensewithoutpermission.

Whereanyofthelaws,regulationsandrulesthattheadministrativelicenseisbasedonisamendedorabolished,ortheobjectivecircumstancesthattheadministrativelicenserestsonchangegreatly,inordertomeetthedemandofpublicinterests,theadministrativeorganmaymodifyorwithdrawtheeffectiveadministrativelicense.Thedamagescausedtothepropertiesofcitizens,legalpersonorotherinstitutionsaccordinglyshallbecompensatedforbytheadministrativeorganinaccordancewiththelaw.

Article9Anadministrativelicenseobtainedinaccordancewiththelawshallnotbetransferredexceptforthosethatmaybetransferredinlightofthelegalconditionsandproceduresofthelawsandregulations.

Article10Thepeople'

sgovernmentsabovethecountylevelshallestablishandperfectthesupervisorysystemfortheadministrativelicensesimplementedbyadministrativeorgans,shallstrengthenthesupervisionandexaminationovertheadministrativelicensesimplementedbyadministrativeorgans.

Theadministrativeorgansshalleffectivelysupervisetheactivitiesofthecitizens,legalpersonsorotherinstitutionsconcerningthemattersunderadministrativelicense.

ChapterIITheEstablishmentofanAdministrativeLicense

Article11Theestablishmentofanadministrativelicenseshallbeinlinewiththeruleofeconomicandsocialdevelopment,shallbepropitioustothefullplayoftheenthusiasmandinitiativeofthecitizens,legalpersonsorotherinstitutions,safeguardthepublicinterestsandsocialorder,promotetheharmoniousdevelopmentoftheeconomy,societyandecologicalenvironment.

Article12Anadministrativelicensemaybeestablishedforanyofthefollowingmatters:

（1）Thespecialactivitiesthatdirectlybearonthestatesecurity,publicsecurity,macro-economiccontrol,ecologicalenvironmentprotection,andthosedirectlyrelatetothehumanhealth,safetyoflifeandproperty,whichshallbeapprovedaccordingtothelegalrequirements;

（2）Thedevelopmentandutilizationofthelimitednaturalresources,allocationofpublicresourcesandthemarketentryofthespecialtradesthatdirectlyconcernpublicinterests,whichshallbeentitledwithspecialrights;

（3）Thevocationsandtradesthatprovidepublicservicesanddirectlyrelatetothepublicinterests,whichneedqualificationofspecialcredit,conditionsorskills;

（4）Theimportantequipment,facilities,products,articlesthatdirectlyconcernpublicsecurity,humanhealth,thesafetyoflifeandproperty,whichshallbeexaminedandapprovedbymeansofinspection,testing,andquarantineaccordingtothetechnicalstandardsorcriterions;

（5）Theestablishmentoftheenterprisesorotherinstitutions,whichneedtodeterminethesubjectqualification;

（6）Othermatters,forwhichadministrativelicensesmaybeestablishedinaccordancewiththelawsandregulations.

Article13ForthematterslistedinArticle12oftheLaw,whichmayberegulatedthroughthefollowingmethods,theadministrativelicensesaren'

trequiredtobeestablished:

（1）Thosecanbedecidedbythecitizens,legalpersonorotherinstitutionsthemselves;

（2）Thosecanbeeffectivelyregulatedbythemarketcompetitionmechanism;

（3）Thosemaybesubjecttotheself-disciplinemanagementofthetradeorganizationsorintermediaryinstitutions;

（4）Themattersthatcanbesolvedbytheadministrativeorgansbymeansofsupervisionafterwardsorthroughotheradministrativemethods.

Article14AstothematterslistedinArticle12oftheLaw,administrativelicensesmaybeestablishedbymeansoflaw.Wherethereisnogoverninglaw,administrativelicensesmaybeestablishedbymeansofadministrativeregulations.

Wherenecessary,theStateCouncilmayadopttheformofreleasingdecisionstoestablishadministrativelicenses.Afterimplementation,exceptforthemattersundertemporaryadministrativelicenses,theStateCouncilshalltimelyproposetotheNationalPeople'

sCongressanditsStandingCommitteetoformulatelaws,orformulateadministrativeregulationsbyitself.

Article15Ifthereisnogoverninglaworadministrativeregulationyet,anadministrativelicensemaybeestablishedbymeansoflocalregulationsforanyofthematterslistedinArticle12oftheLaw;

ifthereisnogoverninglaw,administrativeregulationandlocalregulationyet,butitisreallynecessarytoestablishanadministrativelicensetoconductadministrativemanagementimmediately,antemporaryadministrativelicensemaybeestablishedbymeansofaregulationofthepeople'

sgovernmentofaprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment.Ifitisnecessarytokeeponimplementingtheadministrativelicenseafterayear,thepeople'

scongressanditsstandingcommitteeofthesamelevelshallbeproposedtoformulatealocalregulation.

Nolocalregulationorgovernmentruleoftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentmayestablishanyadministrativelicenseforthequalificationsofthecitizens,legalpersonsorotherinstitutionsthatshallbedeterminedbythestate;

noadministrativelicenseandpre-administrativelicensemaybeestablishedfortheestablishmentandregistrationofenterprisesorotherinstitutions.Theadministrativelicensesestablishedtherebyshallnothindertheindividualsorenterprisesofotherregionsfromdealinginproductionandbusinessandprovidingservicesinoneregion,shallnotrestrictthecommoditiesofotherregionsfromenteringintothemarketofthelocalregion.

Article16Anadministrativeregulationmayhavespecificrequirementsfortheimplementationofanadministrativelicensewithinthescopeofthemattersprescribedbyastatutoryadministrativelicense.

Alocalregulationmay,withinthescopeofthemattersofadministrativelicenseestablishedbythelawsandadministrativeregulations,makespecificrequirementsfortheimplementationoftheadministrativelicense.

Theregulationmaymakespecificrequirementsfortheimplementationoftheadministrativelicensewithinthescopeofthemattersestablishedbytheupperlaw.

Theregulationsandrulesshallnotmakespecificrequirementsfortheimplementationoftheadministrativelicensesetdownbytheupperlaw,shallnotincreaseadministrativelicense;

forthespecific
