Inthepursuitoftheprojectmanagementprofession,itisvitalthatPMImembersconducttheirworkinanethicalmannerinordertoearnandmaintaintheconfidenceofteammembers,colleagues,employees,employers,customers/clients,thepublic,andtheglobalcommunity.
MemberCodeofEthics:
Asaprofessionalinthefieldofprojectmanagement,PMImemberspledgetoupholdandabidebythefollowing:
•Iwillmaintainhighstandardsofintegrityandprofessionalconduct
•Iwillacceptresponsibilityformyactions
•Iwillcontinuallyseektoenhancemyprofessionalcapabilities
•Iwillpracticewithfairnessandhonesty
•Iwillencourageothersintheprofessiontoactinanethicalandprofessionalmanner.
MEMBERSTANDARDSOFCONDUCT
ThefollowingPMIMemberStandardsofConductdescribestheobligationsandexpectationsassociatedwithmembershipintheProjectManagementInstitute.AllPMIMembersmustconducttheiractivitiesconsistentwiththeMemberStandardsofConduct.
I.ProfessionalObligations.
A.ProfessionalBehavior.
1.PMIMemberswillfullyandaccuratelydiscloseanyprofessionalorbusiness-relatedconflictsorpotentialconflictsofinterestinatimelymanner.
2.PMIMemberswillrefrainfromofferingoracceptingpayments,orotherformsofcompensationortangiblebenefits,which:
(a)donotconformwithapplicablelaws;
and(b)mayprovideunfairadvantageforthemselves,theirbusinessorotherstheymayrepresent.
3.PMIMemberswhoconductresearchorsimilarprofessionalactivitieswilldosoinamannerthatisfair,honest,accurate,unbiased,andotherwiseappropriate,andwillmaintainappropriate,accurate,andcompleterecordswithrespecttosuchresearchandprofessionalactivities.
4.PMIMemberswillrespectandprotecttheintellectualpropertyrightsofothers,andwillproperlydiscloseandrecognizetheprofessional,intellectual,andresearchcontributionsofothers.
5.PMIMemberswillstrivetoenhancetheirprofessionalcapabilities,skillsandknowledge;
andwillaccuratelyandtruthfullyrepresentandadvertisetheirprofessionalservicesandqualifications.
B.RelationshipWithCustomers,Clients,andEmployers.
1.PMIMemberswillprovidecustomers,clients,andemployerswithfair,honest,completeandaccurateinformationconcerning:
(a)theirqualifications;
(b)theirprofessionalservices;
and(c)thepreparationofestimatesconcerningcosts,services,andexpectedresults.
2.PMIMemberswillhonorandmaintaintheconfidentialityandprivacyofcustomer,client,employer,andsimilarworkinformation,includingtheconfidentialityofcustomerorclientidentities,assignmentsundertaken,andotherinformationobtainedthroughoutthecourseofaprofessionalrelationship,unless:
(a)grantedpermissionbythecustomer,client,oremployer;
or(b)themaintenanceoftheconfidentialityisotherwiseunethicalorunlawful.
3.PMIMemberswillnottakepersonal,business,orfinancialadvantageofconfidentialorprivateinformationacquiredduringthecourseoftheirprofessionalrelationships,norwilltheyprovidesuchinformationtoothers.
C.RelationshipWiththePublicandtheGlobalCommunity.
1.PMIMemberswillhonorandmeetallapplicablelegalandethicalobligations,includingthelaws,rules,andcustomsofthecommunityandnationinwhichtheyfunction,work,orconductprofessionalactivities.
2.PMIMemberswillperformtheirworkconsistentandinconformancewithprofessionalstandardstoensurethatthepublicisprotectedfromharm.
II.ObligationstoPMI.
A.ResponsibilitiesofPMIMembership.
1.PMIMemberswillabidebythebylaws,policies,rules,requirements,andproceduresoftheProjectManagementInstitute,andwillnotknowinglyengageorassistinanyactivitiesintendedtocompromisetheintegrity,reputation,property,and/orlegalrightsoftheInstitute.
2.PMIMemberswillabidebythelaws,regulations,andotherrequirementsoftheirrespectivecommunitiesandnations,andwillnotknowinglyengagein,orassistin,anyactivitiesintendedtohavenegativeimplications,includingcriminalconduct,professionalmisconduct,ormalfeasance.
3.PMIMemberswillcooperatewiththeInstituteconcerningthereviewofpossibleethicsviolations,andotherPMImatters,completely,consistentwithapplicablepoliciesandrequirements.
4.PMIMemberswillaccurately,completely,andtruthfullyrepresentinformationtoPMI.
MEMBERETHICSCASEPROCEDURES
Thefollowingethicscaseproceduresaretheonlyrulesforprocessingpossibleviolationsoftheseethicalstandards.TheseproceduresareapplicabletomembersoftheProjectManagementInstitute(hereinafterreferredtoasPMIortheInstitute),andthosewhoareseekingInstitutemembership.PMImembersandindividualsseekingPMImembershipunderstandandagreethattheseproceduresareafairprocessforresolvingallethicsmattersdulyadoptedbyPMI;
andtheywillbeboundbydecisionsmade,andrequirementsissued,pursuanttotheseprocedures.
A.GeneralProvisions
1.NatureoftheProcess.PMIhastheonlyauthoritytoresolveandendanyethicsmatter,regardlessofcircumstances.ByapplyingformembershipintheInstitute,PMImembersandapplicantsagreethattheywillaccepttheauthorityoftheInstitutetoapplytheMemberCodeofEthics,MemberStandardsofConduct,andtheMemberEthicsCaseProcedures,andotherrelevantpoliciestoresolveethicsmatters.
Theseethicsproceduresarenotaformallegalprocess;
therefore,manylegalrulesandpracticesarenotobserved,andtheproceduresaredesignedtooperatewithouttheassistanceofattorneys.Anyparty,ofcourse,mayberepresentedbyanattorneywithrespecttoanethicsmatter.Ifapartyhasretainedanattorney,thatattorneymaybedirectedtocommunicatewiththeInstitutethroughthePMILegalCounsel.ThepartiesareencouragedtocommunicatedirectlywiththeInstitute.TheInstitutemayusetheservicesofPMILegalCounselwithoutlimitation.
2.Participants.EthicscasesmaybedecidedbythePMIEthicsReviewCommittee,theEthicsAppealsCommittee,and/oranyauthorizeddesignee.APMImemberorapplicantwhoisthesubjectofanethicscomplaintorinvestigationwillbeidentifiedastheRespondent.Theperson(s)initiatinganethicscomplaintwillbeidentifiedastheComplainant(s).
3.TimeRequirements.TheInstitutewillmakeeveryreasonableefforttofollowthetimerequirementsnotedintheseprocedures.However,theInstitute’sfailuretomeetatimerequirementwillnotprohibitthefinalresolutionofanyethicsmatter,orotherwisepreventPMIfromactingundertheseprocedures.ComplainantsandRespondentsarerequiredtocomplywithalltimerequirementsspecifiedintheseprocedures.TimeextensionsorpostponementsmaybegrantedbytheInstituteifatimelywrittenrequestexplainsareasonablecause.
4.RelaxationofRequirements/GlobalAccommodations.Inlightoftheglobalnatureoftheinternationalprojectmanagementcommunity,includingdifferencesrelatedtothelanguage,custom,geographiclocation,andothercharacteristicsofPMImembersandapplicants,theInstituterecognizesthatPMImembersandapplicantsmayhavedifficultymeetingcertaintimeorotherrequirementsintheseprocedures.Accordingly,aPMImemberorapplicantmaysubmittotheExecutiveDirectorawrittenrequestforanextensionofoneormoreofthetimerequirements;
or,areasonableaccommodationrelatedtomattersoflanguage,custom,geographiclocation,orthelike.TheExecutiveDirectorwillforwardsuchrequeststotheChairoftheEthicsReviewCommitteeortheChairoftheEthicsAppealCommittee,asapplicable.Generally,requestsforsuchtimeextensionsthatseektoincreaseadeadlineandotherreasonableaccommodationswillbegranted.
5.Litigation/OtherProceedings.TheInstitutemayacceptandresolveethicscomplaintswhencivilorcriminallitigation,orotherproceedingsrelatedtothecomplaint,arealsobeforeacourt,regulatoryagencyorprofessionalbody.TheInstitutemayalsocontinueordelaytheresolutionofanyethicscomplaintsinsuchcases.
6.ImproperDisclosure.TheInstitutemayissueanyappropriatedirective(s)andrequirement(s)whereaPMImemberorapplicantprovidesamisleadingdisclosure,orfailstodiscloserequestedinformationrelatedto:
PMImembership;
anethicscomplaint;
anethicscase;
orsimilarmatter.Whereadiscipline,order,directive,orotherrequirementisissuedbytheInstituteunderthisSection,thememberorapplicantinvolvedmayseekreviewandappealpursuanttotheseprocedures.
7.Confidentiality.Inordertoprotecttheprivacyofthepartiesinvolvedinanethicscase,allmaterialpreparedby,orsubmittedto,theInstitutewillbeconfidential,unlessotherwiseauthorizedbytheseprocedures.Amongotherinformation,theInstitutewillnotconsiderthefollowingmaterialstobeconfidential:
materialswhicharedisclosedastheresultofalegalrequirement;
materialswhicharediscloseduponthewrittenrequestofthememberorapplicantwhoisthesubjectofanethicscomplaintorinvestigation,anyinformationrelatingtothememberorapplicantwhichhe/shewouldlikereleasedtootherprofessionalorganizationsorthirdparties,andwhichisnototherwiseconfidential;
and,allfinalpublishedrulings,decisions,r
