1.TheAmericanlegalsystemfeaturesacomplexityresultingfromAmericanfederalism.Withinthefederalstructure,eachstateretainsasubstantialdegreeofautonomy.Eachhasitsownconstitution,statutesmadebyitsownlegislature,andabodyofcaselawcreatedbyitsowncourts.SoitcanbesaidthatinsteadofoneuniformsetoflawsAmericahasfiftyoneasetoflawsforeachofthefiftystatesandoneforthefederation.
美国的法律制度的复杂性归因于美国的联邦制。
在联邦分权制下,
每个州保存相当程度的自治。
各州都有自己的宪法、立法机关制定的成文法和大量的由州法院作出的判例法。
所以可以说美国没有一套全国统一的法律,取而代之的是美国51个州各自拥有的51套州法律,还有一套联邦的。
