Article1ForentryintoChina,aliensshallapplyforvisastoChinesediplomaticmissions,consularpostsorotherforeign-basedagenciesauthorizedbytheMinistryofForeignAffairsofthePeople’sRepublicofChina.
AliensholdinglettersortelegramsfromauthorizedorganizationsinChina andordinarypassportsissuedbycountriesthathavediplomaticrelationsorofficialtradecontactswithChinamayapplyforvisastoportvisaagenciesauthorizedbytheMinistryofPublicSecurityincaseofanurgentneedtotraveltoChinaandalackoftimetoapplyforvisastotheabove-mentioned Chineseagenciesabroad,forthefollowingreasons:
(1)beinginvitedatshortnoticebytheChinesesidetoattendatradefairinChina;
(2)beinginvitedtoChinatoenterabidortoformallysignaneconomicortradecontract;
(3)comingtoChinaundercontractforsupervisionoverexportshipment,importcommodityinspectionorcheckonthecompletionofacontract;
(4)beinginvitedtoinstallequipmentormakerushrepairs;
(5)comingtoChinaattherequestoftheChinesesideforsettlingclaims;
(6)beinginvitedtoChinaforscientificortechnologicalconsultingservices;
(7)alast-minutereplacementoraddition,approvedbytheChineseside,toadelegationorgroupthathasbeeninvitedandhasalreadyobtainedvisasfortravellingtoChina;
(8)forvisitingapatientinacriticalconditionormakingfuneralarrangements;
(9)aspersonsinimmediatetransitwho,becauseofforcemajeure,areunabletoleaveChinabytheoriginalaircraftwithin24hoursorhavetoleaveChinabyothermeansoftransport;
(10)asotherinviteeswhoreallydonothaveenoughtimetoapplyforvisastotheabove-mentionedChinesagenciesabroadbutholdlettersortelegrams fromdesignatedcompetentauthoritiesapprovingtheapplicationforvisasatportvisaagencies;
Portvisaagenciesshallnothandlevisaapplicationsofalienswhodonotcomeundertheabove-listedcategories.
Article2PortvisaagenciesauthorizedbytheMinistryofPublicSecurityaresetupatthefollowingports:
Beijing,Shanghai,Tianjing,Dalian,Fuzhou,Xiamen,Xi'
an,Guilin,Hangzhou,Kunming,Guangzhou(BaiyunAirport),Shenzhen(Luohu,Shekou),andZhuhai(Gongbei).
Article3Inaccordancewiththeirstatusandthetypesofpassportstheyhold,differentalienscomingtoChinashallbeissueddiplomatic,courtesy,serviceorordinaryvisasrespectively.
Article4OrdinaryvisasshallbemarkedwithdifferentChinesephoneticlettersandissuedtodifferentaliensaccordingtotheirstatedpurposesofvisittoChina:
(1)VisaDtoalienswhoaretoresidepermanentlyinChina;
(2)VisaZtoalienswhocometoChinatotakeuppostsoremploymentandtotheiraccompanyingfamilymembers;
(3)VisaXtoalienswhocometoChinaforstudy,advancedstudiesorjob-trainingforaperiodofsixmonthsormore;
(4)VisaFtoalienswhoareinvitedtoChinaonavisitoronastudy,lectureorbusinesstour,forscientific-technologicalorculturalexchanges,forshort-termrefreshercourseorforjob-training,foraperiodnotmorethansixmonths;
(5)VisaLtoalienswhocometoChinaforsight-seeing,visitingrelativesorotherprivatepurposes(Agroupvisamaybeissuedtoagroupofnineormorealiensonasight-seeingtriptoChina);
(6)VisaGtoalienspassingthroughChina;
(7)VisaCtotrainattendants,aircrewmembers,andseamenoperatinginternationalservices,andtotheiraccompanyingfamilymembers;
(8)VisaJ-1toresidentforeigncorrespondentsinChina;
VisaJ-2toforeigncorrespondentswhomakeshorttriptoChinaonreportingtasks.
Article5Inapplyingforvisas,aliensshallprovidesuchpertinentinformationasrequestedandcompletethefollowingprocedures;
(1)presentvalidpassportsorreplacementcertificates;
(2)fillinvisaapplicationformsandsubmitrecently-taken,two-inchhalf-length,bareheadedandfull-facedphotos;
(3)submitforexaminationpaperssupportingtheapplicationforentryintoortransitthroughChina.
Article6ThesupportingpapersmentionedinArticle5(3)oftheserulesrefertothefollowing:
(1)inapplicationforVisaD,apermanentresidenceconfirmationform,whichmaybeobtainedthroughapplicationbytheapplicantorbyhis/herdesignatedrelativesinChinafromtheexit-and-entrydepartmentofthemunicipalorcountypublicsecuritybureaulocatedattheplaceofapplicant’sintendedresidence;
(2)inapplicationforVisaZ,aletterofappointmentoremploymentfromthesponsororemployerorganizationinChinaoraletterortelegramfromanauthorizedorganization;
(3)inapplicationforVisaX,acertificatefromthereceivingorganizationorthecompetentdepartment;
(4)inapplicationforVisaF,aletterortelegramfromtheauthorizedorganization;
(5)inapplicationforVisaLforatouristtripinChina,acertificateofreceptionfromaChinesetravelservice;
and,whennecessary,plane,trainorshipticket(s)tothecountry(region)afterleavingChina;
(6)inapplicationforVisaG,avalidvisaforenteringthecountry(region)ofdestination,orconnectingticketsincasesuchavisaisexempt;
(7)inapplicationforVisaC,relevantcertificatesinaccordancewithagreementsconcerned.
(8)inapplicationforVisaJ-1andJ-2,acertificatefromthecompetentdepartment.
AlienswhocometoChinaforpermanentresidenceorforresidenceofoneyearandupwardsshall,inapplyingforentryvisas,submitforexaminationhealthcertificatesissuedbyhealthormedicalinstitutionsdesignatedbythegovernmentsofthecountriesoftheircurrentresidenceorthoseissuedbyhealthormedicalinstitutionsandcertifiedbynotarialorgans.Healthcertificatesarevalidforsixmonthsfromthedateofissuance.
Article7AlienscomingunderthefollowingcategoriesshallnotbeallowedtoenterChina:
(1)analienexpelledbytheChineseGovernmentandbeforetheexpiryoftheperiodwhenhis/herre-entryisprohibited;
(2)analienconsideredlikelytoengageinterrorism,violence,orsubversionuponenteringChina;
(3)analienconsideredlikelytoengageinsmuggling,drugtraffickingorprostitutionuponenteringChina;
(4)analiensufferingfrommentaldisorder,leprosy,AIDS,venerealdiseases,contagioustuberculosisorotherinfectiousdiseases;
(5)analienwhocannotguaranteetocoverhis/herownexpensesduringhis/herstayinChina;
(6)analienconsideredlikelytoengageinotheractivitiesprejudicialtoChina’snationalsecurityandinterests.
Article8TransitvisasarenotrequiredforthosealienswhoareinimmediatetransitthroughChinaoncontinuedinternationalflights,whoholdconnectingflightticketsandhaveseatsbookedandwhostayfornotmorethan24hourswithintheairportofthein-transitcity.Alienswishingtoleavetheairportshallapplytothebordercheckpostsforstop-overpermits.
Article9WhenvesselsoperatinginternationalserviceanchoratChineseports,foreigncrewmembersandtheiraccompanyingfamilymemberswishingtodisembarkattheportcityshallapplytobordercheckpostsfordisembarkationpermits,orlodgingpermitsiftheydesiretostayovernightonland.Thosewho,forproperreasons,needtotraveltoareasbeyondtheportcityorwhocannotleaveChinaontheoriginalvesselshallapplytothelocalpublicsecuritybureauforappropriatevisas.
Article10UponarrivalataChineseport,aliensshallsubmittheirvalidpassports,Chinesevisasandcertificatestobordercheckpostsforexaminationandshallfillinentryandexitforms.TheymayenterChinaafterthebordercheckpostscompleteinspectionandaffixinspectionseals.
Article11WhenaforeignaircraftorvesselarrivesataChineseport,thepersoninchargeshallfulfilthefollowingobligations:
(1)thecaptainorhis/heragentmustsubmitlistsofthecrewmembersandpassengerstothebordercheckpost;
(2)report,immediatelyupondiscovery,casesofpersonsabroadattemptingtoillegallycrossChina’sborderstothebordercheckpostforaction;
(3)seetoitthatpersonsnotpermittedtoenterChinaleaveontheoriginalmeansoftransportandthattheexpensesduringthestayinChinaofpersonswhocannotpromptlyleavethecountrythroughforcemajeurearecoveredalongwiththeirtravelexpensesfordeparture.
Article12Thebordercheckpostshavetherighttopreventtheentryorexitofalienscomingunderthefollowingcategories:
(1)Thosewhodonotholdvalidpassports,certificatesorvisas;
(2)Thosewhoholdforged,alteredorotherthantheirownpassportsorcertificates;
(3)Thosewhorefusetohavetheircertificatesexamined;
(4)Thosew
