GeneralProvisions

Article1ThisLawisenactedinaccordancewiththeConstitutionandtheEducationLawwithaviewtoimplementingthestrategyofinvigoratingthecountrythroughscience,technologyandeducation,promotingthesounddevelopmentofprivately-runschools,andsafeguardingthelawfulrightsandinterestsoftheprivately-runschoolsandtheeducatees.

Article2ThisLawshallbeapplicabletoactivitiesconductedbypublicorganizationsorindividuals,otherthanStateorgans,toestablishandrunschoolsandotherinstitutionsofeducationwithnon-governmentalfinancialfunds,whicharegearedtotheneedofsociety.IncasestowhichnoprovisionsofthisLawareapplicable,theprovisionsintheEducationLawandotherlawsconcerningeducationshallapply.

Article3Privately-runschoolsbelongtopublicwelfareundertakingsandconstituteacomponentpartofthecauseofsocialisteducation.

Withregardtoprivately-runschools,theStateappliestheprinciplesofenthusiasticencouragement,vigoroussupport,correctguidance,andadministrationaccordingtolaw.

People'sgovernmentsatalllevelsshallincorporatetheundertakingsoftheprivately-runschoolsintotheirplansofnationaleconomicandsocialdevelopment.

Article4Privately-runpolicyschoolsshallabidebylawsandregulations,implementtheeducationoftheState,guaranteetheeducationalqualityanddevotetheireffortstothetrainingofvarioustypesofpeopleforthecauseofsocialistdevelopment.

Privately-runschoolsshallimplementtheprincipleofseparatingeducationfromreligion.NoorganizationsorindividualsmaymakeuseofreligiontoconductactivitiesdesignedtointerferewiththeeducationalsystemoftheState.

Article5Privately-runschoolsandgovernment-runschoolsshallshareequallegalstatus,andtheStatesafeguardstheautonomyoftheprivately-runschools.

TheStateprotectsthelawfulrightsandinterestsofthesponsors,principals,teachersandstaffmembersandeducateesofprivately-runschools.

Article6TheStateencouragesdonationsmadeforestablishingandrunningschools.

TheStaterewardsandcommendsorganizationsandindividualsthathavemadeoutstandingcontributionstothedevelopmentoftheundertakingsofprivately-runschools.

Article7TheadministrativedepartmentforeducationundertheStateCouncilshallbeinchargeoftheoverallplanning,comprehensivecoordinationandmacro-administrationoftheworkrelatingtoprivately-runschoolsnationwide.

TheadministrativedepartmentforlaborandsocialsecurityandtherelevantdepartmentsundertheStateCouncilshallrespectivelybeinchargeoftheworkrelatingtotheprivately-runschoolswithinthescopeoftheirdutiesasdefinedbytheStateCouncil.

Article8Theadministrativedepartmentsforeducationunderthelocalpeople'sgovernmentsatorabovethecountylevelshallberesponsiblefortheworkrelatingtoprivately-runschoolsintheirownadministrativeregions.

Theadministrativedepartmentsforlaborandsocialsecurityandtherelevantdepartmentsunderthelocalpeople'sgovernmentsatorabovethecountylevelshallrespectivelyberesponsiblefortheworkrelatingtoprivately-runschoolswithinthescopeoftheirduties.

ChapterII

Establishment

Article9Publicorganizationsthatestablishprivately-runschoolsshallpossessthequalificationsofalegalperson.

Individualsthatestablishprivately-runschoolsshallpossesspoliticalrightsandfullcapacityforcivilconduct.

Aprivately-runschoolshallhavethequalificationsofalegalperson.

Article10Theestablishmentofaprivately-runschoolshallmeetthelocalneedforeducationaldevelopmentandtherequirementsprovidedforbytheeducationLawandrelevantlawsandregulations.

Thestandardsfortheestablishmentofprivately-runschoolsshall,mutatismutandis,conformtothosefortheestablishmentofgovernment-runschoolsofthesamegradeandcategory.

Article11Theestablishmentofprivately-runschoolsthatprovideeducationforacademiccredentials,pre-
