菲方提请仲裁事项虽经精心包装,但实质是中菲在南海岛礁主权争端和部分海域的海洋划界问题,而领土主权问题并非《公约》的解释和适用问题。
菲方对南海“断续线”是否符合《公约》提出质疑,并强调应以《公约》为判定南海争端的标准。
但根据《维也纳条约法公约》“条约不溯既往”的规定,1994年生效的《公约》无法否定近半世纪前已公布的南海“断续线”。
对于中国在南海“历史性权利”之判定,应遵循时际法原则。
菲律宾还以《公约》第121条“岛屿制度”为根据,指责中国对黄岩岛、美济礁、永暑礁等岛礁附近海域主张管辖权利范围过大,但中方对以上岛礁的海洋划界地位并未发表过意见,菲方所述既与事实严重不符,又逻辑不通,因为岛礁主权是确定可主张管辖权利的前提和条件。
没有“源”,何以产生“流”?
正如中国外交部发言人所说,中菲南海争议的核心,是涉及双方对岛礁主权和部分海域划界的争端。
仲裁庭因此没有管辖权。
中国一贯致力于通过与菲方的双边谈判和协商解决有关争议,菲方明知中方立场,却执意采不合作态度。
尤其要指出的是,关于提请仲裁之“争议”,菲方显已违反《公约》第283条所规定“交换意见的义务”。
依据《公约》第286条,如未履行此项义务,便无权提交“导致有拘束力裁判的强制程序”。
事实上,菲方极为清楚此项义务之重要性,将涉及个别岛礁主权争端的外交磋商作为其已履行“交换意见的义务”的证据。
如前所述,《公约》仲裁不可涉及岛礁主权争端,菲方在其陈述中亦明言,本次提请仲裁事项不含主权争议。
但菲方在论证其已履行“交换意见的义务”之时,却以岛礁主权争议的外交磋商作为证据,这显然是偷梁换柱,事实上中菲之间从未就其陈述中所谓的岛礁法律地位和权利进行过谈判或交换过意见。
菲律宾强推国际仲裁不外乎是想使南海问题国际化,以便巩固其在南海侵占岛礁的同时,捞取更多利益。
菲方一面推进仲裁,在舆论宣传上大打悲情牌,一面在实际行动上却肆行“使争议复杂化、扩大化”之举,如其最近对仁爱礁非法坐滩军舰的“打桩行动”。
可见,菲律宾并非是其所伪装的楚楚可怜的“弱者”,国际社会对其真面目当有清醒认识。
