Article8Deliverydeadline

Butincaseofthefollowingexceptionalreasons,exceptforbothpartiesagreetheterminationoralternationofcontract,thesellercanprolongthedeadlineasperactualfact.

Article9Responsibilityofdelayinhandoverapartment

Exceptforthespecialcasesstipulatedinarticle8,ifthesellercannothandovertheapartmenttobuyerinthestipulatedscheduleinthiscontract,thebuyershouldbetreatedinthefollowingmode:

1.Accordingtotheoverduetime,thesellershouldbetreatedseparately(notbeaccumulated)

(1)Foroverduedatelessthandays,fromthe2nddayofdeadlinestipulatedinarticle8totheactualdeliverday,thesellershouldpay_____%defaultfineofthealreadyeffectedpayment,thiscontractwillbeperformedcontinuously.

(2)Foroverduedatemorethandays,thebuyercanterminatethecontract.Inthiscase,thesellershouldreturnallthepaymentwithindaysafterthedateoftermination,andpay__%defaultfineofthealreadyeffectedpayment.Ifthebuyerrequestscontinuouslyperformthecontract,thiscontractwillbeperformedcontinuously.Fromthe2nddayofdeadlinestipulatedinarticle8totheactualdeliverday,thesellershouldpaythebuyer%(thisratiocannotbelessthantheratesin1)ofthealreadyeffectedpayment

Article10Agreementontheplanninganddesigningvariation

Article11Handover

Whenthecommodityresidentialmeettheusagecondition,thesellershouldsendwrittennotificationtothebuyertomakehandoverprocedure.Duringthehandover,thesellermustissuetheproofdocumentsstipulatedinarticle8,andsigntheresidentialhandoversheet.Fortheresidentialwhichbelongstohabitation,theselleralsoneedtoprovidethe[habitationqualityguarantee]and[habitationusageinstructions].Ifsellerfailstoissuetheabovedocumentsorissueincompletedocuments,thebuyerhasrightstorefuseacceptingthehandover;delaycausedbythiscasewillshallbebearwiththeseller.

Forthedelayhandovercausedbythebuyer,bothpartiesagreedtomanageasbelow:

 

Article12sellermustensuretheresidentialsoldwithoutpropertyrightsandcreditor'srightdisputes.Unabletomakepropertyrightsregistrationoroccurrenceindisputes,theresponsibilitymustbebornbytheseller.

 

Article13SellerbreachofDecorativeequipmentstandardspromise

Thedecorativeequipmentstandardshandoverbythesellershouldmeetthestandardagreedbybothparties(Appendix3).Ifnotachievethestandard,thebuyerhastherightstomanageaccordingtothefollowing___mode.

1.Thesellercompensatesthedecorativeequipmentindoublebalanceofthedifferent.

Article14Promiseofselleronthenormalusageofinfrastructure,publicaffiliatedequipments

Thesellerpromisethefollowinginfrastructure,affiliatedequipmentsdirectlyrelateswiththenormalusageofthisresidentialachievetheusageconditionaccordingtothebelowdate:

Article15Agreementsonthepropertyrightsregistration

Thesellershouldsubmittherelateddocumentsrequestedformakingpropertyrightsregistrationtotheresidentialadministrationdeptandmaketheprocedureindaysafterhandover.Ifthebuyercannotgettheregistrationproprietarycertificateintimecausedbytheseller,bothpartiesagreetotreatinthefollowingmode:

1.Thebuyercancelstheorder,thesellermustreturntheeffectedpaymentwithinxxdaysafterbuyerraisedtherequirement,andcompensatethebuyerwith%oftheeffectedpayment.

2.Thebuyerdoesnotcanceltheorder,thesellershouldpaythedefaultfinewith%oftheeffectedpayment.

Article16Repairguaranteeresponsibility

Forthebuyerwhobuycommodityresidential,the[residentialqualityguarantee]willbeaffixedtothiscontract.Thesellerwillstandtherepairresponsibilityaccordingto[residentialqualityguarantee]fromthehandoverday.

Forthebuyerwhobuycommoditypropertyidnon-residential,bothpartiesshouldmakesupplementalagreementasappendixofthiscontractwhichstipulatestherepairscope,deadline,andresponsibility.

Fortheproblemshappenedwithintherepairscope,deadline,thesellershouldperformtherepair.Forthemajeureordamagednotcausedbytheseller,thesellerwillnotstandtheresponsibility,butcanassistfortherepairing,thebuyershallbeartherepairfee.

 

Article17Bothpartiescanstipulatesthefollowing:

1.Theusageoftheresidentialroofing;

2.Theusageoftheresidentialexternalwall;

Article18Thebuyer’shousecanonlybeuseasl,thebuyercannotchangethemainstructure,partitionstructureandusageduringtheusage.Exceptforadditionalstipulatedintheotherattachmentincontract,thebuyerhastherightstosharethepublicareaandinfrastructurewithotherpeoplewiththerights,andbearthedutyaccordingtolandareaoccupyingandpublicsharedarea.

Thesellercannotchangetheperformanceofthepublicareaandinfrastructure.

 

Article19DisputesintheCourseofContractFulfillment,shallbesettledthroughconsultationamongpartiesconcerned,iffailtoconsultations,andcanbesettledbythewayoffollowingmode:

1、Submittedforarbitrationcommissionof.

2、Bringasuitinthepeople’scourtinaccordancewithlaw.

 

Article20Whatisleftunmentionedinthecontract,bothpartiesshouldsignacomplementaryagreement(Appendix5).

 

Article21Complementaryagreementhasthesamelegalefficiencywiththecontract.Thewordswroteinblankparthavethesamelegalefficiencywithprintwordsonthiscontractanditsappendix.

Article22Thecontractanditsappendixcontainaretotalpages,in,hasthesamelegalefficiency,thecontractholdingsituationincludethefollowings:
