Chapter1:

　　Article1.ThisLawisenactedtoprotectpatentrightsforinventions-creations,toencourageinventions-creations,tofosterthespreadingandapplicationofInventions-creations,andtopromotethedevelopmentofscienceandtechnology,formeetingtheneedsoftheconstructionofsocialistmodernization.

　　Article2.InthisLaw,"

inventions-creations"

meaninventions,utilitymodelsanddesigns.

　　Article3.ThePatentAdministrativeOrganundertheStateCouncilisresponsibleforthepatentworknationwide,receivesandexaminespatentapplicationsandgrantspatentrightsforinventions-creationsthatconformwiththeprovisionsofthisLaw.

　　Theauthoritiesforpatentworkunderhepeople'

sgovernmentsofprovincesautonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentareresponsibleforthepatentadministrationworkoftheirownadministrativeareas.

　　Article4.Whereaninvention-creationforwhichapatentisappliedrelatestothesecurityorothervitalinterestsoftheStateandisrequiredtobekeptsecret,theapplicationshallbetreatedinaccordancewiththerelevantprescriptionsoftheState.

　　Article5.Nopatentrightshallbegrantedforanyinvention-creationthatiscontrarytothelawsoftheStateorsocialmoralityorthatisdetrimentaltopublicinterest.

　　Article6.Aninvention-creation,madebyapersoninexecutionofthetasksoftheentitytowhichhebelongs,ormadebyhimbymainlyusingthematerialandtechnicalmeansoftheentityisaserviceinvention.Foraserviceinvention-creation,therighttoapplyforapatentbelongstotheentity.Aftertheapplicationisapproved,theentityshallbethepatentee.Foranon-serviceinvention-creation,therighttoapplyforapatentbelongstotheinventororcreator.Aftertheapplicationisapproved,theinventororcreatorshallbethepatentee.Foraninvention-creation,madebyapersonbyusingthematerialandtechnicalmeansoftheentitytowhichhebelongs,andwheretheentityandtheinventororcreatorhasenteredintoanagreementunderwhichthereisprovisiononwhohasrighttoapplyforapatentandtowhomthepatentrightbelongs,theprovisionsoftheagreementshallprevail.

　　Article7.Noentityorindividualshallpreventtheinventororcreatorfromfilinganapplicationforapatentforanon-serviceinvention-creation.

　　Article8.Foraninvention-creationjointlymadebytwoormoreentitiesorindividuals,ormadebyanentityorindividualinexecutionofacommissionforanotherentityorindividual,therighttoapplyforapatentbelongs,unlessotherwiseagreedupon,totheentityorindividualwhichmade,ortotheentitiesorindividualwhichjointlymade,theinvention-creation.Aftertheapplicationisapproved,theentityorindividualthatappliedforitshallbethepatentee.

　　Article9.Wheretwoormoreapplicantsfileapplicationsforpatentfortheidenticalinvention-creation,thepatentrightshallbegrantedtotheapplicantwhoseapplicationwasfiledfirst.

　　Article10.Therighttoapplyforapatentandthepatentrightmaybeassigned.Anyassignment,byaChineseentityorindividual,oftherighttoapplyforapatent,orofthepatentright,toaforeignermustbeapprovedbythecompetentdepartmentconcernedoftheStateCouncil.Wheretherighttoapplyforapatentorthepatentrightisassigned,thepartiesmustconcludeawrittencontractandshouldregisteritwiththepatentadministrativeorganundertheStateCouncil.Thepatentadministrativeorganshallannouncetheregistration.Theassignmentwillcomeintoforceuponthedateofregistration.

　　Article11.Afterthegrantofthepatentrightforaninventionorutilitymodel,exceptasotherwiseprovidedforinthelaw,noentityorindividualmay,withouttheauthorizationofthepatentee,exploitthepatent,thatis,make,use,offertosell,sellorimportthepatentedproduct;

orusethepatentedprocessoruse,offertosell,sellorimporttheproductdirectlyobtainedbythepatentedprocess,forproductionorbusinesspurposes.Afterthegrantofthepatentrightforadesign,noentityorindividualmay,withouttheauthorizationofthepatentee,exploitthedesign,thatis,make,sellorimporttheproductincorporatingitsorhispatenteddesign,forproductionorbusinesspurposes.

　　Article12.Anyentityorindividualexploitingthepatentofanothermust,exceptasprovidedforinArticle14ofthisLaw,concludewiththepatenteeawrittenlicensecontractforexploitationandpaythepatenteeafeefortheexploitationofthepatent.Thelicenseehasnorighttoauthorizeanyentityorindividual,otherthanthatreferredtointhecontractforexploitation,toexploitthepatent.

　　Article13.Afterthepublicationoftheapplicationforapatentforinvention,theapplicantmayrequiretheentityorindividualexploitingtheinventiontopayanappropriatefee.

　　Article14.Foranypatentforinventionbelongingtostate-ownedenterprisesorentities,whichisofgreatsignificancetonationalorpublicinterests,thecompetentdepartmentsconcernedoftheStateCouncilaswellasthepeople'

sgovernmentsofprovinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernmenthavethepowertodecide,afterapprovedbytheStateCouncil,thesaidpatentedinventionbespreadandexploitedwithintheprescribedscopeandtoallowdesignatedentitiestoexploitit.Theentitiesthatexploititshall,accordingtotheprescriptionsoftheState,payexploitationfeestothepatentee.AnypatentforinventionbelongingtoaChineseentityundercollectiveownershiporanindividual,whichisofgreatsignificancetonationalorpublicinterestsandisinneedofspreadingandexploitation,maybetreatedalikebymakingreferencetotheprovisionsoftheprecedingparagraph.

　　Article15.Thepatenteehastherighttoaffixapatentmarkingandtoindicatethenumberofthepatentonthepatentedproductoronthepackingofthatproduct.

　　Article16.Theentitythatisgrantedthepatentrightshallawardtotheinventororcreatorofaserviceinvention-creationarewardand,upontheexploitationofthepatentedinvention-creation,shallawardtotheinventororcreatoranappropriateremunerationbasedontheextentofexploitationandapplicationandtheeconomicbenefitsyielded.

　　Article17.Theinventororcreatorhastherighttobenamedassuchinthepatentdocument.

　　Article18.Whereanyforeigner,foreignenterpriseorotherforeignorganizationhavingnohabitualresidenceorbusinessofficeinChinafilesanapplicationforapatentinChina,theapplicationshallbetreatedunderthisLawinaccordancewithanyagreementconcludedbetweenthecountrytowhichtheapplicantbelongsandChina,orinaccordancewithanyinternationaltreatytowhichbothcountriesareparty,oronthebasisoftheprincipleofreciprocity.

　　Article19.Whereanyforeigner,foreignenterpriseorotherforeignorganizationhavingnohabitualresidenceorbusinessofficeinChinaappliesforapatent,orhasotherpatentmatterstoattendto,inChina,heoritshallappointapatentagencydesignatedbythepatentadministrativeorganundertheStateCounciltoactashisoritsagent.WhereanyChineseentityorindividualappliesforapatentorhasotherpatentmatterstoattendtointhecountry,itorhemayappointapatentagencytoactasitsorhisagent.Thepatentagenciesshouldabidebythelawsandadministrativeregulationsandshoulddealwithpatentapplicationsandotherpatentmattersaccordingtothecommissionsoftheclients.Exceptforthoseapplicationsthathavebeenpublishedorannounced,theagenciesshouldbeartheresponsibilityforkeepingconfidentialthecontentofitsclients'

inventions-creations.TheadministrativeregulationsforadministeringthepatentagenciesshallbeformulatedbytheStateCouncil.

　　Article20.WhereanyChineseentityorindividualintendstofileanapplicationinaforeigncountryforapatentforitsorhisdomesticinvention-creation,itorheshallfilefirstanapplicationforpatentwiththepatentadministrativeorganundertheStateCounciland,shallappointapatentagencydesignatedbythesaidorgantoactasitsorhisagent,andshallabidebytheprescriptionsofArticle4inthislaw.AnyChineseentityofindividualmay,accordingtotheinternationaltreatiesconcernedtowhichChinaisaparty,fileaninternationalapplicationforpatentforitsorhisinvention-creation.Theapplicantfortheinternationalapplicationshouldabidebytheprovisionsoftheprecedingparagraph.ThepatentadministrativeorganundertheStateCouncilshallhandletheint
