GeneralProvisions

Article1InaccordancewiththeConstitution,thisLawisenactedforthepurposesofstabilizingandimprovingthetwo-tiermanagementsystemthatcombinescentralizedanddecentralizedmanagementonthebasisofhouseholdcontractualmanagement,grantingtothepeasantslong-termandguaranteedland-useright,safeguardingthelegitimaterightsandinterestsofthepartiestolandcontractsinruralareas,andpromotingthedevelopmentofagricultureandruraleconomyandsocialstabilityinthecountryside.

Article2ForpurposesofthisLaw,landinruralareasincludesthearableland,forestlandsandgrasslandsownedcollectivelybythepeasantsandbytheStateandusedcollectivelybythepeasantsaccordingtolaw,aswellasotherlandsusedforagricultureaccordingtolaw.

Article3TheStateappliesthecontractualmanagementsysteminrespectoflandinruralareas.

Landcontractinruralareasshalltaketheformofhouseholdcontractwithinthecollectiveeconomicorganizationsinthecountryside,whilesuchlandinruralareasasbarrenmountains,gullies,hillsandbeaches,whicharenotsuitedtotheformofhouseholdcontract,maybecontractedinsuchformsasbidinvitation,auctionandpublicconsultation.

Article4TheStateprotects,inaccordancewithlaw,thelong-termstabilityoftherelationshipoflandcontractinruralareas.

Afterthelandinruralareasiscontracted,thenatureofownershipofthelandshallremainunchanged.Thecontractedlandmaynotbepurchasedorsold.

Article5Membersofthecollectiveeconomicorganizationsinruralareasshall,accordingtolaw,havetherighttoundertakerurallandcontractswiththeirowncollectiveeconomicorganizationsthatgiveoutthecontracts.

Noorganizationsorindividualsmaydeprivethemembersoftheruralcollectiveeconomicorganizationsoftheirrighttoundertakecontractsorillegallyrestrictsuchright.

Article6Inundertakinglandcontractsinruralareas,womenshallenjoyequalrightswithmen.Thelegitimaterightsandinterestsofwomenshallbeprotectedincontract.Noorganizationsorindividualsmaydeprivetheirrightstolandcontractualmanagement,whichtheyareentitledto,orinfringeuponsuchright.

Article7Inlandcontractinruralareas,theprinciplesofopenness,fairnessandimpartialityshallbeadheredtoandtherelationshipofinterestsamongtheState,thecollectiveandtheindividualshallbecorrectlyhandled.

Article8Inundertakinglandcontractinruralareas,lawsandadministrativerulesandregulationsshallbeobserved,andtherationaldevelopmentandsustainableuseoflandresourcesshallbemaintained.Withoutapprovalgrantedaccordingtolaw,nocontractedlandmaybeusedfornon-agriculturaldevelopment.

TheStateencouragesthepeasantsandtheruralcollectiveeconomicorganizationstoincreasetheirinputinland,improvesoilfertilityandexpandthecapacityofagriculturalproduction.

Article9TheStateprotectsthelegitimaterightsandinterestsoftheownersofthecollectivelandandtherightofthecontractorstolandcontractualmanagement,whichnoorganizationsandindividualsmayinfringeupon.

Article10TheStateprotectsthecirculationoftherighttolandcontractualmanagement,whichiseffectedaccordingtolaw,onavoluntarybasisandwithcompensation.

Article11ThecompetentadministrativedepartmentsforagricultureandforestryundertheStateCouncilshall,incompliancewiththeirrespectivefunctionsanddutiesdefinedbytheStateCouncil,beresponsibleforprovidingguidancetotheadministrationofthecontractingoflandintheruralareasthroughoutthecountryandtotheadministrationofthecontracts.Thecompetentadministrativedepartmentsforagricultureandforestryunderthelocalpeople'

sgovernmentsatorabovethecountylevelshall,incompliancewiththeirrespectivefunctionsandduties,beresponsibleforadministrationofthecontractingoftherurallandwithintheirownadministrativeareasandtheadmin
