Article1

Thislawisformulatedtoguaranteeandpromotethedevelopmentofthe

electricpowerindustry,tosafeguardthelegalrightsandinterestsof

investors,operatorsandusersofelectricpower,andtomaintainthesafe

operationofelectricpower.

Article2

Thislawisapplicabletoactivitiesconcerningtheconstruction,

production,supplyandutilizationofelectricpowerwithintheboundaries

ofthePeople'

sRepublicofChina.

Article3

Theelectricpowerindustryshallfittheneedsofnationaleconomy

andsocialdevelopmentanddevelopinadvanceappropriately.TheState

encouragesandguideslegalinvestmentinthedevelopmentofpowersources

andtheestablishmentofpowerproductionenterprisesbydomesticand

overseaseconomicorganizationsorindividuals.

Investmentinthepowerindustryshallimplementtheprincipleof

Article4

ElectricpowerfacilitiesshallbeundertheprotectionoftheState.

Itisforbiddenforanyunitorindividualtoendangerthesafetyof

electricpowerfacilitiesortoillegallyoccupyorutilizeelectric

energy.

Article5

Theconstruction,production,supplyandutilizationofelectricpower

shallprotecttheenvironmentaccordingtolaw,adoptnewtechnologies,

minimizedischargeofpoisonouswaste,andpreventpollutionandother

publichazards.

TheStateencouragesandsupportselectricitygenerationbyusing

renewableandcleanenergyresources.

Article6

TheadministrativedepartmentofelectricpowerundertheState

Councilshallberesponsibleforthesupervisionandcontrolofthe

electricpowerindustrythroughoutthecountry.Thedepartmentsconcerned

undertheStateCouncilshall,withinthescopeoftheirrespective

authorities,beresponsibleforthesupervisionandcontrolofelectric

powerindustry.

Thecomprehensiveadministrativedepartmentsofeconomyunderthe

localpeople'

sgovernmentsatandabovethecountylevel,actingasthe

administrativedepartmentsofelectricpowerintheirownadministrative

divisions,shallberesponsibleforthesupervisionandcontrolofthe

electricpowerindustry.Thedepartmentsconcernedunderthelocal

people'

sgovernmentsatandabovethecountylevelshall,withinthescope

oftheirrespectiveauthorities,beresponsibleforthesupervisionand

controlofelectricpowerindustry.

Article7

Electricpowerconstructionenterprises,productionenterprisesand

networkoperationenterprisesshalloperateautonomously,beresponsible

fortheirownprofitsandlosses,andbesubjecttothesupervisionofthe

administrativedepartmentsofelectricpower,accordingtolaw.

Article8

TheStateassistsandsupportsminoritynationalityareas,frontier

andremoteareas,andpoverty-strickenareastodeveloptheirelectric

powerindustries.

Article9

TheStateencouragestheadoptionofadvancedscienceandtechnology

aswellasmanagerialmethodsintheconstruction,production,supplyand

utilizationofelectricpower,andgivesawardstothoseunitsand

individualsthatachieveremarkablesuccesseswithregardtoresearch,

development,andadoptionofadvancedscienceandtechnologyaswellas

managerialmethods.

ChapterIIConstructionofElectricPower

Article10

Theplanningforelectricpowerdevelopmentshallbedrawnuponthe

basisoftherequirementsofnationaleconomyandsocialdevelopmentand

shallbeputintotheplanofnationaleconomyandsocialdevelopment.

Theplanningforelectricpowerdevelopmentshallreflectthe

principlesofrationalutilizationofenergy,coordinateddevelopmentof

thepowersourcesandpowernetworks,increasingeconomicbenefits,and

beingconducivetoenvironmentalprotection.

Article11

Theconstructionandretrofitplanningofurbanpowernetworksshall

beputintotheoverallurbanplanning.Theurbanpeople'

sgovernments

shallarrangetoprovidelandforsubstationfacilities,transmission

linecorridors,andcablechannelsinaccordancewiththeplanning.

Nounitorindividualmayillegallyoccupyorutilizetheland

designatedtosubstationfacilities,transmissionlinecorridors,and

cablechannels.

Article12

TheStateformulatesrelevantpoliciestosupportandpromoteelectric

powerconstruction.

Thelocalpeople'

sgovernmentsshalladoptdiversifiedmeasuresin

linewithlocalconditionstodeveloppowersourcesandpromotepower

constructiononthebasisoftheelectricpowerdevelopmentplanning.

Article13

Investorsinelectricpowershallenjoylegalrightsandinterests

overtheelectricitygeneratedfromtheirinvestment.Whereelectricity

thusgeneratedfeedsintothepowernetwork,theinv
