Rule3CommencementofAction

Acivilactioniscommencedbyfilingacomplaintwiththecourt.

Rule4Summons

a>

Form.Thesummonsshallbesignedbytheclerk,bearthesealofthecourt,identifythecourtandtheparties,bedirectedtothedefendant,andstatethenameandaddressoftheplaintiff'

sattorneyor,ifunrepresented,oftheplaintiff.Itshallalsostatethetimewithinwhichthedefendantmustappearanddefend,andnotifythedefendantthatfailuretodosowillresultinajudgmentbydefaultagainstthedefendantforthereliefdemandedinthecomplaint.Thecourtmayallowasummonstobeamended.

Issuance.Uponorafterfilingthecomplaint,theplaintiffmaypresentasummonstotheclerkforsignatureandseal.Ifthesummonsisinproperform,theclerkshallsign,seal,andissueittotheplaintiffforserviceonthedefendant.Asummons,oracopyofthesummonsifaddressedtomultipledefendants,shallbeissuedforeachdefendanttobeserved.

Adefendantthat,beforebeingservedwithprocess,timelyreturnsawaiversorequestedisnotrequiredtoserveananswertothecomplaintuntil60daysafterthedateonwhichtherequestforwaiverofservicewassent,or90daysafterthatdateifthedefendantwasaddressedoutsideanyjudicialdistrictoftheUnitedStates.
