AcourtbattlebetweenGermanandIsraeliarchives(档案馆)overKafka’smanuscripts(手稿)raisedliterary,notjustlegal,questions.Atthetimeofhisdeath,Kafkahardlyseemedlikeacandidateforworldfame.HehadaminorreputationinGermanliterarycircles.Hepublishedafewstoriesinmagazines,but

Afterhediedin1924,hisfriendMaxBrodcollected,editedandpublishedhisworks-despiteKafka’sowninstructionsinhiswillorderingthemanuscriptstobedestroyed-thusmakingKafkaahouseholdnameafterhisdeath.WhentheNazisinvadedPrague,BrodescapedtoIsrael,bringingthemanuscriptswithhim.Whenhediedin1968,hismanuscripts,togetherwiththoseofKafka,weretransferredtohissecretaryEstherHoffe.

EventhoughBrodaskedinhiswillthatthemanuscriptsbegiventoapublicarchive,Hoffesoldsomeofthemabroadforagreatdealofmoney.ManyofthemeventuallymadeittotheGermanLiteratureArchive.In2007,shediedandleftherpropertiestoherdaughters.Thenthecaseaboutthemanuscriptsstartedafterthedeathofoneofherdaughters.ThecourtsaidHoffehadnorights,andcouldnothaveanysuchrightsforthedocumentsBrodtookfromKafka’sapartmentafterhisdeath.

Ironically,Kafka’sstubbornhomelessnessandnon-belonginginhisworkswereaccuratelywhatensuredhisplaceatthecenterof20th-centuryliterature.W.H.AudenproposedthatKafkawastothecold,absurd20thcenturywhatDanteorShakespearehadbeentotheirtimes-thewriterwhocapturedthespiritoftheage.Thatiswhy,intheend,ithardlymatterswhetherKafka’smanuscriptsstayinGermanyorIsrael.Whatco
