Introduction

Awalkthroughofthefacilitywasconductedduringtheassessment.Itwasfoundthatmostoftheemployeesappearmature.Theyounglookingemployeeswereselectedforprivateinterviewsinordertoverifytheirages.Allinterviewedemployeesreportedtobeelderthanthelegalworkingageof18.

EmployeeDocumentation

Employeesinterviewedstatedthattheyhadtoprovidetheirpersonalidentificationcardswhentheywereemployed.Agedocumentsaremaintainedintheformofphotocopiednationalidentificationcardswhichcontaintheemployees’names,datesofbirthandpersonalpictures.Aspertheemployees’testimoniesandthefacilitymanagement,theoriginalagedocumentationismaintainedbyemployeesthemselves.Agedocumentsforallemployeeswererequestedandprovided.100%ofemployees’agedocumentswerereviewed.Itappearsthatthefacilityhasasysteminplacetoensurenochildlaborishired.

Themanagementteamwasrequestedtoprovidethelaborcontractsforreview.Itwasfoundthatthelaborcontractshadbeensignedwithallemployees.Meanwhile,alltheinterviewedemployeesstatedthattheywouldsignlaborcontractswithfacilitywhentheywereemployedandacopyofthecontractisprovidedtothemaswell.

InvoluntaryLabor

Atotalof#employeeswereselectedfromdifferentworkshopforprivateinterviews.Voluntaryemploymentwasreportedbyallintervieweesandovertimewasconductedonavoluntarybasisaswell.Theintervieweesdidnotreportanydailyproductionquota.Employeesarefreetoleavetheworkplaceafterregularhours.Theemployeesstatedthattheypossesstheirownidentificationcardsandcouldeasilyobtainpermissiontogohomewhentheyaresickorforpersonalreasons.Employeesarehiredthroughout-dooradvertisementratherthanoutsourceagency.Aspertheemployees’testimonies,nodepositisrequireduponhire.Moreover,intervieweesstatedthattheyarefreetotakerestroomanddrinkingwaterbreaks.

AbuseofLabor

Employeesinterviewedstatedthattheyaretreatedwithdignityandrespectbythefacilitymanagement.Noabusepracticewasobservedonthedayoftheassessment.Therearenotinstancesorreportsofphysical,psychologicalorverbalabuseduringthecurrentassessment.

WagesandHours

Afullpayrollassessmentwasconducted.ThepayrollregistersandtimerecordsforMarchtoMay2006wererequestedandprovidedforreview.Therecordsfor***weretakenasaprimarysamplefortheassessment.Thenumberofemployeesreportedonthepayrollis##,including##hourlyrateemployeesand##piecerateemployees.Thereare##employeespresentonthedayoftheassessment.Allofthemarepaidonmonthlybasisaround20thofeachmonth.Wagesaregivenintheformofcash.Aspertheemployees’testimonies,payslipsareissuedtothemwhenwagesaregiven.

Thepayrollregistersprovidedareitemizedastheemployees’:

Asperthepayrollregisters,whenovertimeisconducted,itiscorrectlycalculatedat150%,200%and300%ofthenormalwagesforovertimeonweekdays,restdaysandofficialholidays.ThenormalwagesshowonthepayrollrangefromRMB403toRMB984,higherthanthelocalminimumwageofRMB400.AndtheaveragenormalwageisRMB660,theaverageovertimecompensationisRMB481,therefore,theaveragetotalwageisRMB1141.Nobenefitisgiventotheemployeesandnodeductionistakenfromtheirpay.
