背景
终止程序命令

DISCUSSION
TheperiodicreportsreceivedfromallthecarriersfollowingtheAugust9,2001Ordersuggestthatthepotentialbenefitsofcontinuingtheproceedinganditssemi-annualreportingrequirementsnolongerjustifytheaccompanyingregulatoryburdensontheaffectedoceancarriers.
TheCommissionhasreceivedreportsthatshowedsomeimprovementsin2001and2002intwoareasofconcernthathavebeenthesubjectofthisproceeding:
1.“Priorconsultation”systemforcarrierservicechangesinJapan:
In1997,theCommissionfoundthatasignificantunfavorableconditionintheU.S.-JapantradeswastherequirementthatshippinglinesobtainpermissionoftheJapanHarborTransportationAssociation(JHTA)throughasystemof“priorconsultation”beforemakingmajororminoroperationalchanges.TheCommission

observedthatunderthis“priorconsultation”process,theJHTAhadabsoluteandunappealablediscretiontowithholdpermissionforproposedoperationalchanges,andthattheJHTAusedthatdiscretiontopunishitsdetractors,extractfees,imposeoperationalrestrictions,andallocateworkamongitsmembercompanies.See1997FinalRule.
Theshippinglinesreportedthat,effectiveAugust2002,theJHTAandJapaneselongshoreunionsreachedanagreementtoreviseandsimplifythepriorconsultationprocess.Itlimitedthescopeofeventsrequiringpriorconsultationtothreetypesof“major”mattersthatchangetheworksystematacontainerberth.Allotherchangesareconsidered“minor,”andreceiveconsentwithinaweek.Intheyearssincethatchange,theshippinglineshavereportednodisputesarisingfromthepriorconsultationsystem.
2.Sundayandeveningworkinghours
Inaddition,onenon-JapaneseentityhassucceededinenteringtheJapaneseterminalmarket.In2005,PSAInternationalPte,Ltd.which,likeAmericanPresidentLines,Ltd.,isownedandcontrolledbytheGovernmentofSingapore,becamethefirstnon-JapaneseentitypermittedtooperateaterminalinJapan,theHibikiContainerTerminal.:
Whentheseproceedingsbegan,theCommissionreceivedcomplaintsofrestrictivehoursforunloadingcargo.ShipsgenerallycouldnotbeunloadedonSundaysornumerousholidays,andcontainerterminalsclosedfromnoonto1:

30p.m.FollowingagreementsbetweenJHTAandJapaneselaborunionsinAprilandOctober2001,theCommissionreceivedreportsin2002thatJapaneseportsforthefirsttimehadmovedto364-dayperyearand24-hourservice.
NeithernewissuesnornewprogresswithJapan’sportandterminalrestrictionshavebeenreportedtotheCommissionsincethattime.Reportsindicatethatchangedeconomiccircumstances,alongwiththeremainingobstacles,havediminishednon-Japaneseentities’interestinprovidingstevedoringorterminaloperationservicesinJapan.

CONCLUSION
TheCommissioncontinuestohaveconcernsregardingtheJapaneselicensingrequirementsfornewentrantsintheterminalservicesindustryandthesystemofpriorconsultation.*
THEREFORE,ITISORDERED,ThatthisproceedingandthereportingrequirementsintheCommission’sAugust9,2001Orderinthisproceedingarediscontinued.TheCommissionhasdetermined,however,thatthemostefficientcourseofactionnowistoterminatethecurrentproceedinganditssemi-annualreportingrequirements,whileencouragingtheindustryandshippingpublictoreportanynewrestrictionsordisputesaffectingshippingintheU.S.-Japantradesastheyarise.TheCommissionwillremainwatchfulforunfavorableconditionsthatharmtheforeignoceanbornetradebetweentheUnitedStatesandJapan.
