CharterⅠGeneralProvisions

　　Article1ThisLawisenactedforenhancingsupervisionandcontroloverworksafety,preventingaccidentsduetolackofworksafetyandkeepingtheiroccurrenceatalowerlevel,ensuringthesafetyofpeople'slivesandpropertyandpromotingthedevelopmentoftheeconomy.

　　Article2ThisLawisapplicabletoworksafetyinunitsthatareengagedinproductionandbusinessactivities（hereinafterreferredtoasproductionandbusinessunits）withintheterritoryofthePeople'sRepublicofChina.Wherethereareotherprovisionsinrelevantlawsandadministrativeregulationsgoverningfirefighting,roadtrafficsafety,railwaytrafficsafety,waterwaytrafficsafety,thoseprovisionsshallapply.

　　Article3Inensuringworksafety,principleofgivingfirstplacetosafetyandlayingstressonpreventionshallbeupheld.

　　Article4ProductionandbusinessunitsshallabidebythinLawandotherlawsandregulationsconcerningworksafety,redoubletheireffortstoensureworksafetybysettingupandimprovingtheresponsibilitysystemforworksafetyandimprovingtheconditionsforittoguaranteeworksafety.

　　Article5Principalleadingmembersofproductionandbusinessunitsareinfullchargeofworksafetyoftheirownunits.

　　Article6Employeesofproductionandbusinessunitsshallhavetherighttoworksafetyassuranceinaccordancewithlawandtheyshall,atthesametime,performtheirdutyinworksafetyinaccordancewithlaw.

　　Article7Tradeunionsshall,inaccordancewithlaw,makearrangementforemployeestoparticipateinthedemocraticmanagementofandsupervisionoverworksafetyintheirunitsandsafeguardthelegitimaterightsandinterestsoftheemployeesinworksafety.

　　Article8TheStateCouncilandthelocalpeople'sgovernmentsatalllevelsshallstrengthentheirleadershipoverworksafetyandsupportandurgeallthedepartmentsconcernedtoperformtheirresponsibilitiesinexercisingsupervisionandcontroloverworksafetyinaccordancewithlaw.

　　Thepeople'sgovernmentsatorabovethecountylevelshallinatimelymanner,providecoordinationandsolutiontomajorproblemsexistinginsupervisionandoverworksafety.

　　Article9ThedepartmentinchargeofsupervisionandcontroloverworksafetyundertheStateCouncilshall,inaccordancewiththisLaw,exerciseall-roundsupervisionandcontroloverworksafetythroughoutthecountry.Thedepartmentsinchargeofsupervisionandcontroloverworksafetyoflocalpeople'sgovernmentsatorabovethecountylevelshall,inaccordancewiththisLaw,exerciseall-roundsupervisionandcontroloverworksafetyonworksafetywithintheirownadministrativeregions.

　　TherelevantdepartmentsundertheStateCouncilshall,inaccordancewiththeprovisionsofthisLawandrelevantlawsandadministrativeregulations,exerciserelevantsupervisionandcontroloverworksafetywithinthescopeoftheirrespectiveresponsibilities.Thedepartmentsconcernedunderthelocalpeople'sgovernmentsatorabovethecountylevelshall,inaccordancewiththeprovisionsofthisLawandrelevantlawsandadministrativeregulations,exercisesupervisionandcontroloverworksafetywithinthescopeoftheirrespectiveresponsibilities.

　　Article10TherelevantdepartmentsundertheStateCouncilshall,incompliancewiththerequirementsforsafeguardingworksafetyandinaccordancewithlaw,formulaterelevantnationalstandardsorindustrialspecificationswithoutdelayandmaketimelyrevisionsonthebasesoftechnologicaladvancementandeconomicdevelopment.

　　Productionandbusinessunitsshallimplementthenationalstandardsorindustrialspecificationsforworksafetyformulatedinaccordancewithlaw.

　　Article11People'sgovernmentsatalllevelsandtherelevantdepartmentsunderthemshallredoubletheireffortstopublicizelawsandregulationsregardingworksafetyanddisseminateknowledgeaboutitindifferentformsinordertoenhancetheemployees'awarenessoftheimportanceofworksafety.

　　Article12Theintermediaryorganizationsestablishedinaccordancewithlawtoprovidetechnicalservicesforworksafetyshall,incompliancewithlaw,administrativeregulationsandbusinesscriteria,acceptcommissionsentrustedbyproductionandbusinessunitstoprovidesuchservices.

　　Article13TheStateappliestheresponsibilityinvestigationsystemforaccidentsduetolackofworksafety.PersonswhoareresponsibleforsuchaccidentsshallbeinvestigatedfortheirlegalresponsibilitiesinaccordancewiththeprovisionsinLawandrelevantlawsandregulations.

　　Article14TheStateencouragesandsupportstechnologicalresearchinworksafetyandthewideapplicationofadvancedtechnologyinthisareainordertoraisethelevelofworksafety.

　　Article15TheStategivesawardstotheunitsandindividualsthatachieveoutstandingsuccessesinimprovingconditionsforworksafetyandpreventingaccidentsduelackofworksafety,andinrescueoperations.

ChapterⅡWorkSafetyAssuranceinProductionandBusinessUnits

　　Article16ProductionandbusinessunitsshallhavetheconditionsforworksafetyasspecifiedbyprovisionsinthisLawandrelevantlaws,administrativeregulationsandnationalstandardsorindustrialspecifications.Productionandbusinessunitsthatdonothavesuchconditionsarenotallowedtoengageinproductionandbusinessactivities.

　　Article17Theprincipalleadingmembersofproductionandbusinessunitsarechargedwiththefollowingresponsibilitiesofworksafetyintheirownunits;

（1）settingupandimprovingtheresponsibilitysystemforworksafetyintheirownunits;

（2）makingarrangementsforformulatingrulesandoperatingregulationsforworksafetyintheirownunits;

　　（3）guaranteeinganeffectiveinputintoworksafetyintheirownunits;

　　（4）supervisingoverandinspectingworksafetyintheirownunitsand,inatimelymanner,eliminatinghiddendangersthreateningworksafety;

　　（5）makingarrangementsfortheformulationandimplementationoftheirownunits'rescueplansintheeventofaccidents;and

　　（6）submittingtohigherauthoritiestimelyandtruthfulreportonaccidentsduetolackofworksafety.

　　Article18Fundsforinputessentialtomeetingtheconditionsforworksafetyinproductionandbusinessunitsshallbeguaranteedbythedecision-makingbodiesandprincipalleadingmembersoftheunitsorprivateinvestors,andthesebodiesandpersonsshallbeartheresponsibilityfortheconsequencesofinsufficientinputoffundsessentialtoworksafetyintheirownunits.

　　Article19Mines,constructionunitsandunitsformanufacturing,marketingorstoringdangerousarticlesshalluporganizationsorbemannedwithfull-timepersonsforthecontrolofworksafety.

　　Productionandbusinessunits,otherthantheonesspecifiedintheprecedingparagraph,wherethenumberofemployeeseachexceeds300,shallsetuporganizationsorbemannedwithfull-timepersonsforthecontrolofworksafety.Wherethenumberisbelow300,theunitseachshallbemannedwithfull-timeorpart-timepersonsforthepurpose,ortheymayentrustengineersortechnicians,whoareprofessionallyqualifiedaccordingtoStateregulationsinthinfield,withtheprovisionsofservicesforthecontrolofworksafety.

　　Where,inaccordancewiththeprovisionsintheprecedingparagraph,productionandbusinessunitsentrustengineersortechnicianswiththeprovisionofservicesforthecontrolofworksafety,theresponsibilityforguaranteeingworksafetyshallstillrestontheproductionandbusinessunits.

　　Article20Theprincipalleadingmembersandpersonsforthecontrolofworksafetyinproductionandbusinessunitsshallhavetheknowledgeaboutworksafetyandthecompetenceforitscontrol,whicharecommensuratedwiththeproductionandbusinessactivitiesoftheseunits.

　　Principalleadingmembersandpersonsforthecontrolofworksafetyinunitsmanufacture,marketorstoredangerousarticles,inminesandinconstructionunitsshallonlybeappointedtothepostsaftertheypasstheexaminationsintheirknowledgeaboutworksafetyandtheircompetenceinitscontrolconductedbythecompetentdepartments.Nofeesshallbechargedfortakingsuchexaminations.

　　Article21Productionandbusinessunitsshallgivetheiremployeeseducationandtraininginworksafetytoensurethattheemployeesacquirethenecessaryknowledgeaboutworksafetyandarefamiliarwiththerelevantrulesforworksafetyandsafeoperatingregulations.Noemployeeswhofailtopassthequalificationtestsafterreceivingeducationandtraininginworksafetymaybeassignedtoposts.

　　Article22Beforeusingnewtechniques,technologies,materialsorequipment,productionandbusinessunitsshallget
