Part1:
Introduction
1.Thepurposeofthisguidanceistoexplainthequestionsprocedureundersection65oftheRaceRelationsAct1976(‘theAct’).
ThisguidancehasbeenupdatedtotakeintoaccounttheprovisionsoftheRaceRelations(Amendment)Act2000(“theAmendmentAct”),andtheRaceRelationsAct1976(Amendment)Regulations2003(“theRaceRegulations”).
Theprocedureisintendedtohelpaperson(referredtointhisguidanceasthecomplainant)whothinkshehasbeendiscriminatedagainstbyanother(therespondent)toobtaininformationfromthatpersonaboutthetreatmentinquestioninorderto:
a)decidewhetherornottobringlegalproceedings,and
b)ifproceedingsarebrought,topresenthiscomplaintinthemosteffectiveway.
Aquestionnairehasbeendevisedwhichthecomplainantcansendtotherespondentandthereisalsoamatchingreplyformforusebytherespondent(bothareincludedhere).
Thequestionnaireandthereplyformhavebeendesignedtoassistthecomplainantandrespondentinidentifyinginformationwhichisrelevanttothecomplaint.Itisnot,however,obligatoryforthequestionnaireorthereplyformtobeused;theexchangeofquestionsandrepliesmaybeconducted,forexample,byletter.Thisquestionnaireshouldnotbeusedinrespectofracerelationscomplaintsrelatingtoimmigrationdecisionsthataretobeconsideredaspartofone-stopimmigrationandasylumappeals(seesection57AoftheAct,insertedbysection6
(2)oftheAmendmentAct).
2.Thisguidanceisintendedtoassistboththecomplainantandtherespondent.GuidanceforthecomplainantonthepreparationofthequestionnaireissetoutinPartII;andguidancefortherespondentontheuseofthereplyformissetoutinPartIII.
Guidanceisalsoprovidedinthemarginsofthequestionnaire.Theguidanceisnotpartofthequestionnaire.ThemainprovisionsoftheActarereferredtointheappendixtothisguidance.

Howthequestionsprocedurecanbenefitbothparties
3.Theprocedurecanbenefitboththecomplainantandtherespondentinthefollowingways:
a)Iftherespondent’sanswerssatisfythecomplainantthatthetreatmentwasnotunlawfuldiscrimination,therewillbenoneedforlegalproceedings.
b)Eveniftherespondent’sanswersdonotsatisfythecomplainant,theyshouldhelptoidentifywhatisagreedandwhatisindisputebetweentheparties.Forexample,theanswersshouldrevealwhetherthepartiesdisagreeonthefactsofthecase,or,iftheyagreeonthefacts,whethertheydisagreeonhowtheActapplies.Insomecases,thismayleadtoasettlementofthegrievance,againmakinglegalproceedingsunnecessary.
c)Ifitturnsoutthatthecomplainantinstitutesproceedingsagainsttherespondent,theproceedingsshouldbethatmuchsimplerbecausethemattersindisputewillhavebeenidentifiedinadvance.
Whathappensiftherespondentdoesnotreplyorrepliesevasively?
4.Therespondentcannotbecompelledtoreplytothecomplainant’squestions.However,byvirtueofsection65oftheAct,thisquestionnaireandanyreplyare(subjecttotheprovisionsofthesection)admissibleinproceedingsundertheActandacourtortribunalmaydrawanysuchinferenceasisjustandequitablefromafailurewithoutreasonableexcusetoreplywithinareasonableperiod,orfromanevasiveorequivocalreply,includinganinferencethatthepersonquestionedhasdiscriminatedunlawfully.Therespondent’sattentionisdrawntothesepossibleconsequencesinthenoteattheendofthequestionnaire.
5.Newsection65(4A)oftheAct,insertedbysection5
(2)oftheAmendmentAct,providesthat,inproceedingsundernewsection19BoftheAct,acourtwillnotbeabletodrawtheinferencesinparagraph4aboveif:
a)atthetimeofdoingtherelevantacttherespondentwascarryingoutpublicinvestigationorpublicprosecutorfunctions;and
b)heorshereasonablybelievesthatareplyoradifferentreplywouldbelikelytoprejudiceanycriminalinvestigation,anydecisiontoinstitutecriminalproceedings,oranycriminalproceedings,orwouldrevealthereasonbehindadecisionnottoprosecute,ornottocontinue,criminalproceedings.
TheActdoesnotpreventacomplainantfromseekingareplyatalaterdatewhenthecircumstancessetoutabovemaynolongerapply.
Periodwithinwhichquestionnairemustbeservedontherespondent
6.Therearedifferenttimelimitswithinwhichaquestionnairemustbeservedinordertobeadmissibleinanyensuinglegalproceedings.Whichtimelimitappliesdependsonwhetherthecomplaintwouldbeundertheemployment,trainingandrelatedprovisionsoftheAct(inwhichcasetheproceedingswouldbebeforeanemploymenttribunal),orwhetheritwouldbeunderthefunctionsofapublicnature,education,goods,facilitiesandservicesorpremisesprovisions(inwhichcaseproceedingswouldbebeforeadesignatedcountycourtor,inScotland,asheriffcourt).
Employmenttribunalcases
7.Inordertobeadmissibleunderthequestionsprocedureinanyensuingemploymenttribunalproceedings,thecomplainant’squestionnairemustbeservedontherespondenteither:
a)beforeacomplaintaboutthetreatmentconcernedismadetoanemploymenttribunal,butnotmorethan3monthsafterthetreatmentinquestion;or
b)ifacomplainthasalreadybeenmadetoatribunal,within21daysbeginningwhenthecomplaintwasreceivedbythetribunal.
However,wherethecomplainanthasmadeacomplainttoatribunalandtheperiodof21dayshasexpired,aquestionnairemaystillbeservedprovidedthepermissionofthetribunalisobtained.ThismaybedonebysendingtotheSecretaryoftheTribunalsawrittenapplication,whichmuststatethenamesofthecomplainantandtherespondentandsetoutthegroundsoftheapplication.Howevereveryeffortshouldbemadetoservethequestionnairewithintheperiodof21daysasthepermissionofthetribunaltoservethequestionnaireaftertheexpiryofthatperiodwillnotnecessarilybeobtained.
Courtcases
8.Inordertobeadmissibleunderthequestionsprocedureinanyensuingcountyorsheriffcourtproceedings,thecomplainant’squestionnairemustbeservedontherespondentbeforeproceedingsinrespectofthetreatmentconcernedarebrought,butnotmorethan6monthsafterthetreatment
However,whereproceedingshavebeenbrought,aquestionnairemaystillbeservedprovidedthepermissionofthecourthasbeenobtained.Inthecaseofcountycourtproceedings,thismaybedonebyobtainingformN244fromthecountycourtoffice,andcompletingitandsendingittothecourt,withtheappropriatefee,andtherespondent.Inthecaseofsheriffcourtproceedings,thismaybedonebymakinganapplicationtoasheriff.

Notesonpreparingthequestionnaire
9.Beforefillinginthequestionnaire,youareadvisedtopreparewhatyouwanttosayonaseparatepieceofpaper.Ifyouhaveinsufficientroomonthequestionnaireforwhatyouwanttosay,youshouldcontinueonanadditionalpieceofpaper,whichshouldbesentwiththequestionnairetotherespondent.

10.Youshouldgive,inthespaceprovidedinparagraph2,asmuchrelevantfactualinformationasyoucanaboutthetreatmentyouthinkmayhavebeenunlawfuldiscrimination,andaboutthecircumstancesleadinguptothattreatment.Youshouldalsogivethedate,andifpossibleandifrelevant,theplaceandapproximatetimeofthetreatment.Youshouldbearinmindthatinparagraph4ofthequestionnaireyouwillbeaskingtherespondentwhetherheagreeswithwhatyousayinparagraph2.

11.Inparagraph3youaretellingtherespondentthatyouthinkthetreatmentyouhavedescribedinparagraph2mayhavebeenunlawfuldiscriminationbyhimagainstyou.Itwillhelptoidentifywhetherthereareanylegalissuesbetweenyouandtherespondentifyouexplaininthespaceprovidedwhyyouthinkthetreatmentmayhavebeenunlawfuldiscrimination.
