RegulationofGuangdongProvinceonthePaymentofWages
(Adoptedatthe16thmeetingoftheStandingCommitteeofthe10thPeople'sCongressofGuangdongProvinceonJanuary19,2005)
ChapterIGeneralProvisions
Article1Forthepurposeofregulatingthepaymentofwages,safeguardingtherightsofemployeestogetremunerationsfortheirlabor,establishingaharmoniouslaborrelationshipandpromotingsocialstabilityandeconomicdevelopment,thisRegulationisformulatedinaccordancewiththeLaborLawofthePeople'sRepublicofChinaandtherelevantlawsandadministrativeregulations,andincombinationwiththeactualsituationofthisProvince.
Article2
ThisRegulationshallapplytoenterprises,privatenon-enterpriseentitiesandindividualeconomicorganizations(hereinafterreferredtojointlyasemployingentities)withinthejurisdictionofthisProvinceandtheemployeeswhohaveestablishedlaborrelationshiptherewith.
Thestateorgans,publicinstitutionsandsocialorganizationswithinthejurisdictionofthisProvinceandtheemployeeswhohaveestablishedlaborrelationshiptherewithshallbegovernedbythisRegulationthroughanalogy.
Article3
TheProvincialPeople'sGovernmentshallformulateaminimumwagestandardpursuanttotherelevantprovisions,andthepeople'sgovernmentsat or abovethelevelofdistrictedcityshalldeterminetheminimumwagelevelsoftheirrespectivecitieswithintheminimumwagelevelsaspromulgatedbytheProvincialPeople'sGovernment.
Thepeople'sgovernmentsat or abovethecountylevelshallregularlyannouncetheguidingwageandguidingwagelevelofthelabormarket,andprovideguidanceandservicestotheemployingentitiesandemployees.
Article4
Thewagesshallbepaidonschedule,infullamountandwithpriority.
Whereanemployeeprovidesnormallaborwithinthestatutoryworkinghours or theworkinghoursasstipulatedinthelaborcontract,theemployingentityshalldeterminehiswagestandardnotlowerthanthelocalminimumwagelevel.
Article5
Thepeople'sgovernmentsatalllevelsshallestablishandimprovetheirrespectiveearly-warningmechanismsofwagepayment,creditsupervisorymechanismsandemergencyhandlingmechanisms.
Article6
Theadministrativedepartmentsoflaborandsocialsecurityofthepeople'sgovernmentsatalllevels(hereinafterreferredtoasthelaborandsecuritydepartment)shallberesponsiblefortheguidance,supervisionandinspectionofwagepaymentbyemployingentitieswithintheirrespectivejurisdictions.
Thedepartmentsofindustryandcommerce,construction,customs,taxation,andthebanksshallhelpthelaborandsecuritydepartmentintherespectofsupervisionoverthepaymentofwageswithintheirrespectivefunctions.
Laborunionsandwomen'sfederationsshalllawfullymaintaintherightsofemployeesforremunerationfortheirlabor.
Anyentity or individualshallhavetherighttoreportanyillegalactrelatedtothepaymentofwages.
ChapterIIPaymentofWages
Article7
Anemployingentityshallestablishitssystemontherulesofwagesaccordingtolaw,andmakeitknowntoalltheemployeesthereofinwrittenform.
Therulesforpaymentofwagesshallcoverthefollowingmatters:
(1)Waysfordistributionofwages,items,standardsandmethodsforthedeterminationandadjustmentthereof;
(2)Periodanddateforthepaymentofwages;
(3)Overtimewages,wagesforextraworkinghours,wagesforspecialcircumstances,andthepaymentmethodsthereof;
(4)Wagestobewithheldanddeducted,andthewithholdinganddeductionmatters;and
(5)Otherrelevantmatters.
Anemployeeisentitledtoinquiretheemployingentityaboutthecontentsoftherulesonthepaymentofwages.
Article8
Anemployingentityshallstipulatethewagesfornormalworkinghourspaidtoemployeesinthelaborcontract,andthestipulatedwagesmaynotbelowerthantheminimumwagelevelofthatyearaspromulgatedbythelocalgovernment.
Wherethereisnostipulation or definitestipulationinthisrespect,theaveragemonthlywagesoftheemployeesasproclaimedbythecountypeople'sgovernmentatthelocalitywheretheemployingentityisdomiciledshallbethewagesfornormalworkinghours;wherethewagesactuallypaidarehigherthantheaveragemonthlywagesofemployeesasproclaimedbythelocalgovernment,thewagesactuallypaidshallberegardedasthewagesfornormalworkinghoursasagreedonbytheemployees.
Article9
Anemployingentitymayconductcollectiveconsultationwiththelabor union oremployeerepresentativesthereofinregardtothepaymentofwages,andshallconcludeacollectiveagreementthereon.
Article10
Anemployingentityshallpaywagesincurrency,atthedeterminedcyclesforpayingwagesandinfullamount.Nodelinquency or skimpisallowed.
Wherethewagesarepaidatthecycleofmonth,week,day or hour,theperiodforpayingwagesmaybedeterminedaccordingtothemonth,week,date or hour.
Wherethesystemofpayingwagesbypieceworkisimplemented or thewagesarepaidforacertaintasktobeaccomplished,thecycleforpayingwagesmaybestipulatedaccordingtothenumberofpieceworkdone or theaccomplishedtasks,whileifthecycleforpayingwagesinexcessofonemonth,theemployingentityshallpaywagesonamonthlybasispursuanttothestipulations.
Whereanannualpaymentsystemisimplemented or thewagesarepaidonthebasisoftheexaminationperiod,theemployingentityshallpaywagespermonthaccordingtothestipulations,andshallsettleandpaythemoffattheendoftheyear or attheexpiryoftheexaminationcycle.
Article11
Anemployingentityshallpaywagesdirectlytotheemployeehimself.Ifanemployeefailstodrawwagesduetoanyreason,hemayentrustanyothertodrawit,andapowerofattorneyshallbeprovided.
Ifanemployingentityentrustsabanktopaywages,itshalldepositthefullwagesintotheaccountsofemployeesthemselvesatthestipulateddateforthepaymentofwages.
Article12
Anemployingentityshallpaywagestoitsemployeesatthestipulateddate.Inthecaseoflegalholidays or restdays,theemployingentityshallpaytheirwagesatthenearestworkingdayinadvance.
Article13
Whenanemployingentityterminates or dissolvesthelaborrelationshipwithanemployeeaccordingtolaw,itshallpayoffthewagesoftheemployeeonceandforallonthedaywhenthelaborrelationshipisterminated or dissolved.
Article14
Anemployingentitymaywithholdthefollowingfundsfromthewagesofemployeespursuanttotherelevantprovisions:
(1)Individualincometaxesthatshouldbepaidbyemployees;
(2)Varioussocialinsurancefeesandhousingreservesthatshouldbepaidbyemployeesthemselves;
(3)Alimony,estoversandchildsupportpaymentthatshouldbewithheldasrequiredbytherulingsandverdictsofthepeople'scourt;or
(4)Otherfeesthatmaybedeductedfromthewagesofemployeesasprescribedbylawsandregulations or asagreedonbybothparties.
Article15
Incaseanemployeeshallcompensateforthedirecteconomiclosseshehasincurredtotheemployingentityduetohisfault,theemployingentitymaydeductthecompensationsfromhiswages,butshallgiveawrittennoticeonthereasonsfordeductionandtheamounttobedeductedinadvance;otherwise,itmaynotdeductthewages.Andthemonthlywagesremainedafterthedeductionofcompensationsmaynotbelowerthanthelocalminimumwagestandard.
Article16
Anemployingentityshallcompileledgersforthepaymentofwagesonthebasisofthecyclesofpaymentofwages,andkeepthemforatleasttwoyears.
Theledgersforthepaymentofwagesshallmainlyspecifythedateandcycleofpayment,thenamesofemployees,workinghours,theitemsandamountofwagespayable,theitemsandamountwithheldanddeducted,theamountofwagesactuallypaid,aswellasthevouchersissuedbythebankontheentrustedpaymentofwages or thesignaturesofemployees,etc.
Article17
Whenanemployingentitypayswages,itshallprovidelistsofwagestotheemployeesthemselves.
Whenanemployingentityextendstheworkinghours or arrangesemployeestoworkonrestdays or legalholidays,itshallputcorrespondingwagesandremunerationsonthelistofwagesIftheemployingentityfailstodosoandcannotprovethepayment,itshallberegardedasafailuretopaycorrespondingwagesandremunerations.
Theitemsandamountonthelistofwagesshallbeidenticalwiththeledgersforthepaymentofwages.
Anemployeehastherighttoconsultandverifyhislistforpaymentofwages.
Article18
DailywagesshallbedeterminedpursuanttothemonthlywagesdeductedbytheaveragemonthlyworkingdaysasprescribedbytheState,whilehourlywagesshallbedeterminedpursuanttothedailywagesdeductedbytheaveragedailyworkinghours,whichmaynotbemorethan8hours.
Article19
Whereanemployeeenjoyssuchvacationsaslegalholidays,annualleave,leaveforgoinghometovisittheirfamilies,weddingleave,leaveforarrangingfuneral,maternityleave,nursingleave,andvacationforchildbirth,etc.,thisshallberegardedasnormallaborofferedbytheemployeeandtheemployingentityshallpaywagestohim.
Article20
Whenanemployingentityarrangesemployeestoworkovertime or extendstheirworkinghours,itshallpaytheovertimewagesandwagesfortheextendedworkinghourstotheemployeespursuanttothefollowingstandards:
(1)Overtimewagesandremunerationsshallbepaidattherateof150%ofthedaily or hourlywagesoftheemployeesthemselvesfortheextendedworkinghoursinaworkingday;
(2)Overtimewagesandremunerationsshallbepaidattherateof200%ofthedaily or hourlywages
