ThemeasuresfortheadministrationoflargebridgesandtunnelsinXiamenhavebeenadoptedbythe139thexecutivesessionoftheMunicipalPeople'sGovernmentonNovember25,2011andareherebypromulgatedandshallcomeintoforceasofMarch1,2012.

ChapterIGeneralProvisions

Article1Thesemeasuresareformulatedinaccordancewiththerelevantlawsandregulations,andinlightoftheactualsituationofthisMunicipality,inordertostrengthentheadministrationoflargebridgesandtunnelsandensuretheintegrity,safetyandsmoothnessoflargebridgesandtunnels.

Thesecondtermofthelargebridgethatcomplieswiththerelevantindustrystandardsandnationalbridgebridge;tunnelreferstovehicles,mountains,shallowburiedsubseatunnelandwear.Exceptforlargebridgesandtunnelsonrailwaysandhighways.

Cataloguemanagementoflargebridgesandtunnelsasprescribedintheprecedingparagraph.ThecatalogueoflargebridgesandtunnelsshallbecompiledbythecompetentdepartmentofCommunicationsAdministrationofthecityinconjunctionwiththemunicipalcompetentdepartmentandpromulgatedbytheMunicipalPeople'sgovernmentforapproval.

Thirdmunicipaltransportation,municipaladministrationdepartments（hereinafterreferredtoasthecompetentdepartments）inaccordancewiththelargebridgetunneldirectoryidentifiedbythemanagementscope,isresponsibleforthecity'slargebridges,tunnelsmanagement.

Therelevantadministrativedepartments,suchaspublicsecurityandplanning,areresponsiblefortherelevantmanagementoflargebridgesandtunnelswithintheirrespectivefunctionsandresponsibilities.

Fourthlargebridge,tunnelmanagementunits（hereinafterreferredtoasmanagementunits）inaccordancewiththesemeasuresinchargeoflarge-scalebridges,tunnelsdailymanagementandmaintenancework.

Theexpensesforthemanagementandmaintenanceoffifthlargebridgesandtunnelsshallbeincludedinthefinancialbudgetofthecityinaccordancewiththerelevantregulationsofthestate,theprovinceandthecity.

Thesecondchapterisplanningandconstruction

Sixthplansandconstructionoflargebridges,tunnelsshouldbeconsistentwiththeoveralllanduseplanningandurbanplanning.Ifitinvolvestheuseofseaareas,itshallconformtothemarinefunctionalzoningofXiamen,andshallalsoconformtotheoverallplanningandwaterwayplanningoftheXiamenport,includingtheports,waterwaysandothernavigablewaters.

Seventhlargebridgeandtunnelconstructionprojectsshouldbebasedonmanagementneeds,supportingtheconstructionofemergencyrescue,maintenancemanagement,trafficsafetyservicesandotherfacilities,aswellasspecialbuildingsandstructures.

Eighthlargebridges,tunnelconstructionprojectssupportingtheconstructionofthefollowingfacilities,systemsshouldbesynchronizedwiththemainprojectdesign,synchronousconstruction,synchronousacceptance,therequiredfundsincludedintheprojectbudget:

（1）fireprotection,lightningprotection,emergencyrescueandothersecuritysystems;

（two）operationmanagementsystem;

（three）dynamicmonitoringsystem;

（four）detectionsystemofoversizetransportationvehicle;

（five）guidance（assist）navigationsignsystem;

（six）majormeteorologicaldisasterdefensesystem;

（seven）othersystemsthatshouldbeincludedintheprojectbudgetestimateaccordingtolaw.

Theninthtunnelconstructionshouldtakeintoaccounttheneedsofcivilairdefenseandtomeetwartimerequirements.

Tenthlargebridgetunnelconstructionprojectacceptance,theconstructionunitshallformulatethemaintenanceplan,submittedtothecompetentdepartmentsfortherecord.

Aftercompletionoftheacceptanceofalargebridgeortunnelconstructionproject,theconstructionunitshalltransferthecompletearchivesinaccordancewiththerelevantregulations.

Thethirdchaptersafetyandmaintenance

Eleventh,nounitorindividualshallnotentertheimportantareaoflargebridgesortunnelswithouttheconsentofthemanagementunit.Theimportantareashallbesetupbythemanagementunitandthesignshallbedetermined,exceptthatthemarkshallnotbesetaccordingtothemanagementneeds.

Theimportantareasmentionedintheprecedingparagraphrefertosuchareasasboxgirders,piers,caps,pylons,anchors,substations,cablesystems,tunnels,pumpingstations,substations,ventilationtowers,servicetunnels,etc..

Thetwelfthprohibitsthedestruction,illegaloccupationoflargebridges,tunnelsancillaryfacilities.Itisforbiddentoundertakethefollowingactsonlargebridges,tunnelsandtheirancillaryfacilities:

（1）settingupnontrafficsigns,suchasadvertisements;

（two）unauthorizedposting,graffiti,scratching,hanging;

（three）smokingorthrowingfireinthetunnel;

（four）fishingonlargebridges;

（five）openfirewithoutpermissionandsetofffireworksandfirecrackers.

Theaffiliatedfacilitiesmentionedintheprecedingparagraphreferstotheprotectionandmaintenanceoflargebridgetunnel,bridgeandtunnelsafety,largesmoothsetofbridgesandtunnels,drainage,protection,maintenanceservices,lighting,trafficsafety,monitoring,alarm,communicationandchargingfacilities,equipmentandspecialbuildingsandstructures.

Articlethirteenthprohibitstheconductofthefollowingactsinthesafetyprotectionzonesoflargebridgesandtunnels:

（a）dredging,quarrying,mining,soil,wastedumping,blastingoperations;

（two）establishmentofinflammableandexplosivewarehousesandstorageofdangerouschemicals;

（three）breedingandberthingofships.

Inthesafetyprotectionzonesoflargebridgesandtunnels,awharfmaybedockedinaccordancewiththelaw,andshallnotbesubjecttotherestrictionsasspecifiedintheprecedingparagraph.Butwhentheshipisdocked,safetymeasuresshouldbetakentoensurethatthebridgeandtunnelarenothiddensafely.

Safetyprotectionareasmentionedintheprecedingtwoparagraphs,referstothebridgeverticalplane200metersonbothsidesofthebridge,onbothsidesoftheverticalplanewithin60metersoflandandwater,overpass,approachroadonbothsidesoftheverticalplanewithin30metersofthelandarea,andtoprotectthetunnelaxisandholeonbothsidesthe100metersrange.

Articlefourteenthshallnotexamineandapproveaccordingtolaw,andshallnotengageinthefollowingactswithinthesafetyprotectionzonesoflargebridgesortunnels:

（I）constructionofbuildingsorstructures;

（two）operategasstationsandgasstations;

（three）piling,digging,jacking,buryingsubmarinepipelinesandcablefacilities;

（four）otheractivitiesthatmayendangerthesafetyoflargebridges,tunnelsandtheirancillaryfacilities.

Fifteenthwhenthecompetentmeteorologicaldepartmentsofthecitymeteorologicalstationissuedagaleandstormrelateddisasterweatherwarningandmeteorologicaldisasterwarningsignal,theshipshallbeparkedinthevicinityofthesafetyprotectionzonesshall,inaccordancewiththecitymeteorologicaldisasteremergencyplanrequirements,theshipreachedthedesignatedsafeparkingplace,andtakethesecurityreinforcementmeasures,toensurethattheshipdoesnotposeasafetyhazardforlargebridgetunnel.

Thesixteenthadministrativedepartmentsshall,togetherwiththeadministrativedepartmentsconcerned,formulateemergencyplansforlarge-scalebridgesandtunnels,whichshallbeimplementedafterapprovalbytheMunicipalPeople'sgovernment.

Seventeenthmanagementunitsshouldbethemainstructureofnationaltechnicalspecificationsrelatedtoengineeringandoperatingproceduresfortheregularinspectionoflargebridgesandtunnels,drainage,ventilation,lighting,monitoring,alarm,firefighting,rescueandotherancillaryfacilitiesinaccordancewiththemainstructure,guaranteeoflargebridgesandtunnelsandrelatedancillaryfacilitiesingoodconditionanduse.

Eighteenthlargebridgesandtunnelsconstructionofmaintenancemaycausetrafficdisruption,shouldfirstobtainthetrafficadministrativedepartmentofthepublicsecurityorganagreed.Thetrafficadministrativedepartmentsofthepublicsecurityorgansshallstrengthenthesupervisionandinspectionoftrafficsafety,andmaintaintheorderoftraffic.

Thenineteenthadministrativeunitsshallreporttheinspectionresultsofthelargebridgesandtunnelsaswellastheimplementationofthemaintenanceplantothecompetentdepartmentfortherecordonaquarterlybasis.

Articletwentiethduetoroadtrafficaccidentsorotherreasonscausingdamagetolargebridges,tunnelsandtheirauxiliaryfacilities,themanagementunitshallpromptlyinvestigatethelossesandorganizetherestoration.

Thetrafficadministrativedepartmentofthepublicsecurityorganshallnotifythemanagementunitoftheroadtrafficaccidentcausedbythedamagetothelargebridge,tunnelanditsauxiliaryfacilities.
