ChapterI
GeneralProvisions
Article1ThisLawisformulatedinordertostrengthenthecontrolofmaritimetraffic;ensurethesafetyofvessels,installations,humanlifeandproperty;andsafeguardtherightsandinterestsofthestate.
Article2ThisLawshallapplytoallvessels,installationsandpersonnelandtotheownersandmanagersofsuchvesselsandinstallationsthatnavigate,berthoroperateinthecoastalwatersofthePeople'sRepublicofChina.
Article3TheharboursuperintendencyagenciesofthePeople'sRepublicofChinashallbethecompetentauthoritiesresponsiblefortheunifiedsupervisionandadministrationoftrafficsafetyinthecoastalwaters.
ChapterII
InspectionandRegistrationofVessels
Article4Vesselsandtheirmajorequipmentrelatingtonavigationsafetymusthavevalidtechnicalcertificatesissuedbyvesselinspectiondepartments.
Article5Avesselmusthaveacertificateshowingitsnationality,avesselregistrycertificateoravessellicense.
ChapterIII
PersonnelonVesselsandInstallations
Article6Vesselsshallbemannedwithqualifiedcrewmembersaccordingtoastandardquotatoensurethevessels'safety.
Article7Thecaptain,chiefengineer,pilot,engineers,radioandtelephoneoperatorsandsimilarpersonnelonboardseaplanesorsubmersiblesmustholdvalidjobcertificates.
Allothercrewmembersmustundergospecializedtechnicaltrainingrequiredfortheirwork.
Article8Inaccordancewithstateprovisions,allinstallationsshallbeprovidedwithpersonnelwhohavemasteredthetechniquesofcollisionavoidance,signaling,communications,firecontrol,life-savingandotheroperations.
Article9Allpersonnelonvesselsandinstallationsmustobserverelevantrulesandregulationsconcerningmaritimetrafficsafety,followtheoperatingrulesandensurethesafetyofthevesselsandinstallationsinnavigation,berthingandoperations.
ChapterIV
Navigation,BerthingandOperations
Article10Whilenavigating,berthingorcarryingoutoperations,vesselsandinstallationsmustabidebytherelevantlaws,administrativestatutesandrulesandregulationsofthePeople'sRepublicofChina.
Article11Non-militaryvesselsofforeignnationalitymaynotentertheinternalwatersandharboursofthePeople'sRepublicofChinawithouttheapprovalofitscompetentauthorities.However,underunexpectedcircumstancessuchascriticalillnessofpersonnel,enginebreakdownorthevesselsbeingindistressorseekingshelterfromweatherwhentheydonothavethetimetoobtainapproval,theymay,whileenteringChina'sinternalwatersorharbours,makeanemergencyreporttothecompetentauthorityandshallobeyitsdirections.
MilitaryvesselsofforeignnationalitymaynotentertheterritorialwatersofthePeople'sRepublicofChinawithouttheapprovaloftheGovernmentofthePeople'sRepublicofChina.
Article12VesselssailingoninternationalroutesthatenterandleavetheharboursofthePeople'sRepublicofChinamustacceptinspectionbythecompetentauthorities.VesselsofChinesenationalitysailingondomesticroutesthatenterandleavesuchharboursmustobtainportentryanddeparturevisas.
Article13VesselsofforeignnationalityenteringandleavingaharbourofthePeople'sRepublicofChina,navigatingorshiftingberthsintheharbourarea,orapproachingorleavingmooringpointsorloadingspotsoutsidetheharbourmustbenavigatedbyapilotdesignatedbythecompetentauthority.
Article14Whenenteringorleavingharboursorpassingthroughcontrolledtrafficareas,crowdednavigableareasorareaswherenavigationalconditionsarerestricted,vesselsmustobservethespecialregulationspromulgatedbytheGovernmentofthePeople'sRepublicofChinaorbythecompetentauthority.
Article15Vesselsshallbeprohibitedfromenteringorpassingthroughrestrictednavigationzonesunlessspeciallypermittedbythecompetentauthority.
Article16Towingoperationsontheopenseainvolvinglarge-sizedinstallationsandmobileplatformsmustundergotowinginspectionconductedbyvesselinspectiondepartmentsandbereportedtothecompetentauthorityforexaminationandapproval.
Article17Ifthecompetentauthorityfindstheactualconditionofavesseltobenotinconformitywithwhatisstatedinthevessel'scertificates,itshallhavetherighttorequirethevesseltoapplyforanewinspectionornotifyitsownerormanagertoadopteffectivesafetymeasures.
Article18Ifthecompetentauthoritybelievesthatavesselpresentsamenacetothesafetyofaharbour,itshallhavetherighttoforbidthevesselfromenteringtheharbourortoorderittoleavetheharbour.
Article19Thecompetentauthorityshallhavetherighttoforbidavesseloraninstallationfromleavingtheharbourororderittosuspenditsvoyage,changeitsrouteorceaseitsoperationsunderanyoneofthefollowingcircumstances:
(1)ifitviolatesanylaw,administrativestatuteorotherruleorregulationofthePeople'sRepublicofChina;
(2)ifitisinaconditionunsuitablefornavigationortowing;
(3)ifitisinvolvedinatrafficaccidentandhasnotcompletedthenecessaryformalities;
(4)ifithasnotpaidthefeesthataredueorfurnishedappropriatesecuritytothecompetentauthorityorthedepartmentconcerned;or
(5)ifthecompetentauthorityconsidersthatthereareothercircumstancesthatwilljeopardizeormightjeopardizemaritimetrafficsafety.
ChapterV
SafetyProtection
Article20Constructionoperationstobecarriedoutonthesurfaceorunderwaterincoastalwatersandthedemarcationofcorrespondingsafeoperationzonesmustbereportedtothecompetentauthorityforexaminationandapprovalandmustbepubliclyannounced.Vesselsnotinvolvedintheconstructionprojectmaynotenterthesafeoperationzones.Theconstructionunitmaynotenlargesuchzoneswithoutauthorization.
Whenshorelinesaretobeusedinharbourareasorwhenconstructionwork,includingoverheadoperations,istobecarriedoutontheseasurfaceorunderwaterinsuchareas,theplanandadrawingthereofmustbesubmittedtothecompetentauthorityforexaminationandapproval.
Article21ThedesignationofrestrictednavigationzonesincoastalwatersmustbeapprovedbytheStateCouncilorthecompetentauthority.However,thedesignationofrestrictednavigationzonesformilitarypurposesshallbeapprovedbythecompetentdepartmentofthestateinchargeofmilitaryaffairs.
Therestrictednavigationzonesshallbeannouncedbythecompetentauthority.
Article22Withouttheapprovalofthecompetentauthority,noinstallationsmaybeestablishedorconstructed,normayanyactivitiesthathindernavigationalsafetybecarriedoutinharbourareas,anchorages,navigationlanes,orcrowdednavigableareas,aswellasinnavigationroutesannouncedbythecompetentauthority.
Withrespecttoanyinstallationswhichhavebeenestablishedorconstructedintheabove-mentionedareaswithoutauthorization,thecompetentauthorityshallhavetherighttoordertheirownerstoremoveordismantletheinstallationswithinagivenperiod.
Article23Itshallbeforbiddentodamagenavigationaidsornavigationalfacilities.Whoeverhasdamagednavigationaidsornavigationalfacilitiesshallimmediatelyreportthedamagetothecompetentauthorityandbeliableforcompensation.
Article24Vesselsandinstallationsshallpromptlymakeareporttothecompetentauthorityiftheydiscoveranyofthefollowingsituations:
(1)ifnavigationaidsornavigationalfacilitiesmalfunctionorbecomeabnormal;
(2)ifanobstacleordriftingobjectjeopardizingthesafetyofnavigationisdiscovered;or
(3)ifthereareotherabnormalsituationsjeopardizingthesafetyofnavigation.
Article25Noobstacleaffectingtheefficacyofnavigationaidsmaybeerectedorinstalledinareassurroundingtheaids.Anylightsinthevicinityofthenavigationaidsornavigationallanesthatjeopardizenavigationsafetyshallbeproperlyscreened.
Article26Whenremovingordismantlinginstallations,salvagingorremovingsunkenshipsorobjects,andhandlingthefinishingoperationsofunderwaterprojects,nohiddendangersshallbelefttomenacenavigationaloroperationalsafety.Beforetheaforesaidoperationshavebeenproperlycompleted,theirownersormanagersmustberesponsibleforerectingmarkersasrequiredandmakinganaccuratereporttothecompetentauthorityonthetype,shape,sizeandlocationoftheobstacleandthedepthofwateroverit.
Article27Safetyadministrationmustbestrengthenedwithrespecttoharbourwharves,mooringpointsandloadingspotsoutsideofharbourareasaswellasshiplocks,sothattheyarealwayskeptingoodcondition.
Article28Tomeettherequirementsofmaritimetrafficsafety,thecompetentauthorityshallfixandadjusttrafficcontrolareasandharbouranchorag
