第二条、租赁客体
Article2.ObjectoftheLease2.1房东出租其位于xxxx的公寓。
包括所有的附属装置、家具和电器（以下统称租赁业务房产）
TheLandlordleasesouttheapartmentlocatedatxxxxxIncludingallfixtures,furnitureandappliances（hereafterreferredtoastheleasedproperty）.
2.2该租赁房产的总面积为xxx平方米。
其中：
卧室x间，卫生间x，厨房x间，洗衣房间，地下室，车库;
花园面积平方米，（包括草坪、花草、树木、围栏等）

2.3承租人有权有权使用出租人供所有承租人使用的共用面积。

第三条、租期
Article3.LeaseTerm3.1租期为1年,自xxxx起,至xxxxx日止。

3.2合同期满后本合同终止，拆迁户若想延长租期，应在租期届满前在的至少1个月前书面通知出租人。

第四条、租金与支付条款
Article4.RentandTermsofPayment
4.1租金应为未税每季xxxxRMB，租金每半年支付那次。
每月房租包括:
发票税金xxx,物业管理费xxx元，有限（数字）电视的安装和承包费xxx元,宽带安装和使用费xx元，中介费用xx元，车位费xxx元，水电气费xxxx元，一年内超出限额部分的泉水、电、煤气费用由承租方支付。

第五条、运营管理服务与管理费
Article5.ManagementServicesandManagementFee
承租人展开应对该租赁房产进行维护。
管理费用包括，但不限于，建筑物内外的清扫公共设施用地的清扫、对指定的垃圾箱内垃圾的清除，该地区电线和管道设施电缆维护的费用。
TheLandlordshallconductmaintenanceontheleasedproperty.Themanagementfeeincludes,butisnotrestrictedto,thecleaningofareas,garbageremovalfromdesignateddustbins,maintenanceofelectricwiringandplumbingfacilitiesonthearea.
第六条、税费
Article6.TaxesandFees
出租人应支付政府部门向其征收除租房税金外的所有税费。
TheLandlordshallpayalltaxesandfeesleviedonhimbytheauthoritiesexcepttherenttax.
第七条、租赁房产的状况
Article7.StatusofLeasedProperty7.1出租人应不迟于租期的第1（大写：
壹）天将该租赁房产以清洁、良好的状态移交给债务人，并在移交的同时交钱
出与租赁房产的钥匙。
TheLandlordshalldelivertheleasedpropertytotheTenantinacleanandgoodconditionnolaterthanonthe1st（inwords:
first）dayoftheleaseterm.TheLandlordshallhandoverkeysoftheleasedpropertyatthetimeofdelivery.
7.2出租人在时长任何时间都应使该租赁房产保持良好的状态。
出租人应对房产的结构及各项设施和设备进行维护，
并在出现问题的情况下及时纠正或维护;如果出租人没有在合理时间内但不不怎么迟于接到通知后的一个星期内纠正该问题，则承租人无权请求赔偿和/或纠正该瑕疵，费用由出租人承担，承租人应向出租人提供所付费用的资料和收据。
30天内未能解决，承租人有权立即搬出去此房，并不应该承担任何赔偿。
TheLandlordshallatalltimeskeeptheleasedpropertyingoodcondition.TheLandlordshallprovidemaintenancetothepropertyandrepairdefectssuchas:
cracksonthewallinastructure;electricapplianceworksunproperly;constructionagainstthelocalorcompoundregulation.IftheLandlordfailstocorrectdefectswithinduetimebutnotlaterthan1weekafterbeingnotified,theTenantshallhavetherighttoclaimdamagesandorcorrectthedefectsattheexpenseoftheLandlord.TheTenantshallprovidetheLandlordwithdocumentationandreceiptsofcostsincurred.Thereshallbenopenaltyprovideditcannotbesolvedin30days,andTheTenanthastherighttocheckout.
7.3在非因承租人过错租赁房产出现问题的罪责情况下，比如，但不牵涉到空调故障，出租人应在收到承租人的登出通知后毫
不迟延地进行维修或纠正。
如果出租人未能及时解决问题，则承租人有权自行或单独聘第三方进行维修，维修产生的费用由出租人承担，应向出租人提供所付费用的资料和收据。
同时，出租人应向承租人赔偿维修费用以外的其他损失（若有）。
IncaseofanyproblemofthePremisesnotarisingfromtheTenantsfault,includingbutnotlimitedtoa
defectiveairconditioner,theLandlordshallcarryoutremedyorrepairwithoutdelayuponreceivinganoticefromtheTenant.IftheLandlordfailstoresolvesuchproblemswithinduetime（notlaterthan1weekafterbeingnotified）,theTenantshallhavetherighttohaveitrepairbyitselforanythirdpartyattheexpenseoftheLandlord.TheTenantshallprovidetheLandlordwithdocumentationandreceiptsofcostsincurred.
Meanwhile,theLandlordshallindemnifyfromtheTenantanyotherlossinadditiontotherepairfees,ifany.
第八条、使用规则
Article8.RulesofOccupancy
承租人须遵守下列使用规则：
TheTenantshallfollowtherulesofoccupancyasfollows:
8.1承租人只应将该租赁房产作为其住处。
TheTenantshallusetheleasedpropertyonlyforresidentialpurpose.
8.2承租人有义务杜绝在租赁房产内从事任何会对其他承租人或出租人造成不合理干扰的活动。
TheTenantshallnotallowanythingtobedoneontheleasedpropertythatwouldunreasonablydisturbothertenantsortheLandlord.
8.3在租赁期间，承租人应有义务使该租赁房产保持干净和良好的条件。
正常的损耗应指在承租人及其家人的正常和公平合理使用期间产生的损耗。
TheTenantshallhavethedutytokeeptheleasedpropertycleanandinagoodconditionforthedurationoftheleaseterm.FairwearandtearshallmeansuchwearinthehouseisexposedtoduringthenormalandreasonableusebyaTenantandTenantsfamily.
8.4承租人如果发现租赁中其房产之中的供电、煤气或供水设施、或管道已证明有危险或可能证明有危险，应毫不迟
延地书面通知出租人。
TheTenantshallgivewrittennoticetotheLandlordwithoutdelaywhentheTenantbecomesawareofanyelectrical,gasorwaterinstallation,wiringorpipingontheleasedpropertythatprovestobe,ormayprovetobe,adanger.
8.5承租人应当补偿出租人因更换或修理被承租人或承租人的人损坏或承租破坏的租赁房产中的任何用物而导致
出租人的所有直接费用。
出租人必须能够提供有关文件和正式发票以要求付款。
正常的损耗不应构成任何该损坏或破坏。
TheTenantshallcompensatetheLandlordforalldirectcostsincurredbytheLandlordinreplacementorrepairofanyitemontheleasedpropertydamagedordestroyedbytheTenantorapersonforwhichtheTenantisresponsible.TheLandlordmustbeabletoprovidedocumentationandofficialinvoicetoclaimpayment.Fairwearandtearshallnotconstituteanysuchdamageordestruction.
8.6承租人应采取安全措施一切合理的预防措施使租赁房产内部免受暴风雨和其他不利的雨雪的影响，并应在遇有该类天
气诡谲条件的凶险时采取适当措施，比如确保所有的外部门窗都安全已安全锁住或解封。
TheTenantshalltakeallreasonableprecautionstoprotecttheinterioroftheleasedpropertyagainst
damagesfromstormsandotheradverseweatherconditionsandshall,uponthreatofsuchweathercondition,takeappropriateaction,suchas,butnotrestrictedto,toensurethatallexteriordoorsandwindowsaresecurelylockedorclosed.
8.7承租人应遵守已公布的中国法律和法规，亦不得并且不得允许在租赁房产上从事任何非法活动。
TheTenantshallcomplywiththepublishedChineselawsandregulationsandnotpermitanyunlawfulactivitiesontheleasedproperty.
第九条、进入出租房产的权利
Article9.RighttoEntertheLeasedProperty9.1出租人进入租赁房屋内进行正常必要的维修保养工作，应当提前7天书面通知承租人，经承租人准许后方可进
入维修场所;若在紧急情况下无法提前通知承租人，且不紧急进入租赁或进行抢修房内抢救将会产生严重后果的，出租人有权在物业管理人员陪同下，公用立马进入租赁房屋内从事紧急维修、抢救工作。
UponwrittennoticetheLandlordshallhavetherighttoentertheleasedpropertytoperformnecessary
maintenancework.Inaneventofemergency,theLandlordshallhavetheimmediaterighttoentertheleasedpropertywithoutanypriornotice.
9.2租期届满前一（大写：
壹）个月之内，在发出通知后，出租人有权让将来可能的新租户参观该租赁房产,但需要
提前通知承租方的居住人。
Within1（inwords:
one）monthsoftheendoftheleasetermtheLandlordshallhavetherightuponwrittennoticetoshowtheleasedpropertytoprospectivenewtenants.
第十条、转租权
Article10.SublettingRights
经出租人同意，承租人有权以合理事先出租人书面通知全部或部分将租赁房产转租给其关联企业或将本合同概括转让给其关联企业。
TheLandlordagreesthattheTenantisentitledtoentirelyorpartiallysubleasethePremisesorassignthisContracttoanyofitsAffiliatesubjecttoareasonablyadvancenoticetotheLandlord.
第十一条、终止
Article11.Terminate
11.1租期满11个月之后,承租人在任何时候都可通过提前1（大写：
壹）个月书面通知终止本合同。
After11monthsofthisleasingterm,theTenantmayatanytimeterminatethisContractunderconditionofprovidingonemonthpriorwrittennoticetotheLandlord.
11.2如果租金的支付租金自到期之日起迟延30（大写：
叁拾）天以上并至少超过出租人发出直和书面通知后的30（大写：
叁拾）
天，出租人应有权终止本合同。
Intheeventthatpaymentofrentisdelayedformorethan30（inwords:
thirty）daysfromthedatedueandatleast30（inwords:
thirty）daysafterwrittennoticefromtheLandlordtotheTenantstatingthedelayisissuedtheLandlordshallhavetherighttoterminatethisContract.
11.3如果任何一方资不抵债，或者公司进入清算阶段，己方应有权终止本合同。
IntheeventthatanyofthepartiesbecomesbankruptorincaseacompanygoesintoliquidationtheotherpartyshallhavetherighttoterminatethisContract.
第十二条、违约
Article13.BreachofContract
12.1由于出租人违约，承租人有权不支付总价，且已支付雷米雷蒙县的当期租金需全额归还。
TheTenantshallhavetherighttowithholdrentpaymentsforLandlordsbreachofcontract
12.2由于承租人违约，出租人有权不退还承租方缴付已支付的租金。
Thelandlordshallhavetherightnottohandbackrentpaymentsfortenantsbreachofcontract.
12.3如果出租人拖延纠正租赁房产上的瑕疵，则承租人有权被执行人自行纠正瑕疵并从租金中扣除所支出的费用，条件是承
租人有详细的资料和收据证明其扣除额。
IntheeventthattheLandlordisindelaywithcorrectingdefectsontheleasedpropertytheTenantshallhavetherighttocorrectdefectshimselfanddeductthecostsfromtherentprovidedtheTenantsupportsthedeductionwithdetaileddocumentationandreceipts.
12.4提到除了本合同所提到的其他偿付，如果本合同的任何一方违反了本合同，受损方应有权就其巨大损失所应受的损失请求赔偿。
