CHAPTERI.GENERALPROVISIONS
Section1.ThisLawisformulatedinaccordancewiththeConstitutioninordertoprotectthelegitimaterightsandinterestsoflabourers,readjustlabourrelationship,establishandsafeguardalaboursystemsuitedtothesocialistmarketeconomy,andpromoteeconomicdevelopmentandsocialprogress.
Section2.ThisLawappliestoallenterprisesandindividualeconomicorganizations(hereafterreferredtoasemployingunits)withintheboundaryofthePeople'sRepublicofChina,andlabourerswhoformalabourrelationshiptherewith.
Stateorgans,institutionalorganizationsandsocietiesaswellaslabourerswhoformalabourcontractrelationshiptherewithshallfollowthisLaw.
Section3.Labourersshallhavetherighttobeemployedonanequalbasis,chooseoccupations,obtainremunerationfortheirlabour,takerest,haveholidaysandleaves,obtainprotectionofoccupationalsafetyandhealth,receivetraininginvocationalskills,enjoysocialinsuranceandwelfare,andsubmitapplicationsforsettlementoflabourdisputes,andotherrightsrelatingtolabourasstipulatedbylaw.
Labourersshallfulfiltheirlabourtasks,improvetheirvocationalskills,followrulesonoccupationalsafetyandhealth,andobservelabourdisciplineandprofessionalethics.
Section4.Theemployingunitsshallestablishandperfectrulesandregulationsinaccordancewiththelawsoastoensurethatlabourersenjoytherighttoworkandfulfilllabourobligations.
Section5.TheStateshalltakevariousmeasurestopromoteemployment,developvocationaleducation,laydownlabourstandards,regulatesocialincomes,perfectsocialinsurancesystem,coordinatelabourrelationship,andgraduallyraisethelivingstandardoflabourers.
Section6.TheStateshalladvocatetheparticipationoflabourersinsocialvoluntarylabourandthedevelopmentoftheirlabourcompetitionsandactivitiesofforwardingrationalproposals,encourageandprotectthescientificresearchandtechnicalrenovationengagedbylabourers,aswellastheirinventionsandcreations;andcommendandawardlabourmodelsandadvancedworkers.
Section7.Labourersshallhavetherighttoparticipateinandorganizetradeunionsinaccordancewiththelaw.
TradeUnionsshallrepresentandsafeguardthelegitimaterightsandinterestsoflabourers,andindependentlyconducttheiractivitiesinaccordancewiththelaw.
Section8.Labourersshall,throughtheassemblyofstaffandworkersortheircongress,orotherformsinaccordancewiththeprovisionsoflaws,rulesandregulations,takepartindemocraticmanagementorconsultwiththeemployingunitsonanequalfootingaboutprotectionofthelegitimaterightsandinterestsoflabourers.
Section9.ThelabouradministrativedepartmentoftheStateCouncilshallbeinchargeofthemanagementoflabourofthewholecountry.
Thelabouradministrativedepartmentsofthelocalpeople'sgovernmentsatorabovethecountylevelshallbeinchargeofthemanagementoflabourintheadministrativeareasundertheirrespectivejurisdiction.
CHAPTERII.PROMOTIONOFEMPLOYMENT
Section10.TheStateshallcreateconditionsforemploymentandincreaseopportunitiesforemploymentbymeansofthepromotionofeconomicandsocialdevelopment.
TheStateshallencourageenterprises,institutionalorganizations,andsocietiestoinitiateindustriesorexpandbusinessesfortheincreaseofemploymentwithinthescopeofthestipulationoflaws,andadministrativerulesandregulations.
TheStateshallsupportlabourerstogetjobsbyorganizingthemselvesonavoluntarybasisorbyengaginginindividualbusinesses.
Section11.Localpeople'sgovernmentsinvariouslevelsshalltakemeasurestodevelopvariouskindsofjob-introductionagenciesandprovideemploymentservices.
Section12.Labourersshallnotbediscriminatedagainstinemployment,regardlessoftheirethniccommunity,race,sex,orreligiousbelief.
Section13.Femalesshallenjoyequalrightsasmalesinemployment.Itshallnotbeallowed,intherecruitmentofstaffandworkers,tousesexasaprotextforexcludingfemalesfromemploymentortoraiserecruitmentstandardsforthefemales,exceptforthetypesofworkorpoststhatarenotsuitableforfemalesasstipulatedbytheState.
Section14.Wheretherearespecialstipulationsinlaws,rulesandregulationsontheemploymentofthedisabled,thepersonnelofnationalminorities,anddemobilizedarmymen,suchspecialstipulationsshallapply.
Section15.Noemployingunitsshallbeallowedtorecruitjuvenilesundertheageof16.
Unitsofliteratureandart,physicalcultureandsport,andspecialartsandcraftsthatneedtorecruitjuvenilesundertheageof16mustgothroughtheformalitiesofexaminationandapprovalaccordingtotherelevantprovisionsoftheStateandguaranteetheirrighttocompulsoryeducation.
CHAPTERIII.EMPLOYMENTCONTRACTSANDCOLLECTIVEAGREEMENTS
Section16.Alabourcontractistheagreementreachedbetweenalabourerandanemployingunitfortheestablishmentofthelabourrelationshipandthedefinitionoftherights,interestsandobligationsofeachparty.
Alabourcontractshallbeconcludedwherealabourrelationshipistobeestablished.
Section17.Conclusionandmodificationofalabourcontractshallfollowtheprinciplesofequality,voluntarinessandunanimitythroughconsultation,andshallnotruncountertothestipulationsoflaws,administrativerulesandregulations.
Alabourcontractonceconcludedinaccordancewiththelawshallpossesslegalbindingforce.Thepartiesinvolvedmustfulfiltheobligationsstipulatedinthelabourcontract.
Section18.Thefollowinglabourcontractsshallbeinvalid:
(1)labourcontractsconcludedinviolationoflaws,administrativerulesandregulations;and
(2)labourcontractsconcludedbyresortingtosuchmeasuresascheatingandintimidation.
Aninvalidlabourcontractshallhavenolegalbindingforcefromtheverybeginningofitsconclusion.Whereapartofalabourcontractisconfirmedasinvalidandwherethevalidityoftheremainingpartisnotaffected,theremainingparthallremainvalid.
Theinvalidityofalabourcontractshallbeconfirmedbyalabourdisputearbitrationcommitteeorapeople'scourt.
Section19.Alabourcontractshallbeconcludedinwrittenformandcontainthefollowingclauses:
(1)termoflabourcontract;
(2)contractsofwork;
(3)labourprotectionandworkingconditions;
(4)labourremuneration;
(5)labourdisciplines;
(6)conditionsfortheterminationofalabourcontract;and
(7)responsibilityfortheviolationofalabourcontract.
Apartfromtherequiredclausesspecifiedintheprecedingparagraph,othercontentsinalabourcontractmaybeagreeduponthroughconsultationbythepartiesinvolved.
Section20.Thetermofalabourcontractshallbedividedintofixedterm,flexibletermortakingthecompletionofaspecificamountofworkasaterm.
Incasealabourerhaskeptworkinginasameemployingunitfortenyearsormoreandthepartiesinvolvedagreetoextendthetermofthelabourcontract,alabourcontractwithaflexibletermshallbeconcludedbetweenthemifthelabourersorequested.
Section21.Aprobationperiodmaybeagreeduponinalabourcontract.Thelongestprobationperiodshallnotexceedsixmonths.
Section22.Thepartiesinvolvedinalabourcontractmayreachanagreementintheirlabourcontractonmattersconcerningkeepingthecommercialsecretsoftheemployingunit.
Section23.Alabourcontractshallterminateupontheexpirationofitstermortheemergenceoftheconditionsfortheterminationofthelabourcontractasagreeduponbythepartiesinvolved.
Section24.Alabourcontractmayberevokeduponagreementreachedbetweenthepartiesinvolvedthroughconsultation.
Section25.Theemployingunitmayrevokethelabourcontractwithalabourerinanyofthefollowingcircumstances:
(1)tobeprovednotuptotherequirementsforrecruitmentduringtheprobationperiod;
(2)toseriouslyviolatelabourdisciplinesortherulesandregulationsoftheemployingunit;
(3)tocausegreatlossestotheemployingunitduetoseriousderelictionofdutyorengagementinmalpracticeforselfishends;and
(4)tobeinvestigatedforcriminalresponsibilitiesinaccordancewiththelaw.
Section26.Inanyofthefollowingcircumstances,theemployingunitmayrevokealabourcontractbutawrittennotificationshallbegiventothelabourer30daysinadvance;
(1)wherealabourerisunabletotakeuphisoriginalworkoranynewworkarrangedbytheemployingunitafterthecompletionofhismedicaltreatmentforillnessorinjurynotsufferedatwork;
(2)whenalabourerisunqualifiedforhisworkandremainsunqualifiedevenafterreceivingatrainingoranadjustmenttoanyotherworkpost;and
(3)noagreementonmodificationofthelabourcontractcanbereachedthroughconsultationbythepartiesinvolvedwhentheobjectiveconditionst
