依据《中国协议法》、《上海市房屋租赁条例》(以下简称:
《条例》)要求,甲、乙双方在平等、自愿、公平和老实信用基础上,经协商一致,就乙方承租甲方可依出租(出租)商品房(房屋/商品房)事宜,签订本协议。
InaccordancewiththeLawsofContractofthePeople’sRepublicofChinaandtheTenancyRegulationsoftheShanghaiMunicipality(hereinafterreferredtoas“theProvisions”),PartyAandPartyB,havingreachedanagreementbasedontheprinciplesofequality,willingnessandmutualbenefit,herebyenterintothisContractonmattersinrelationtotheLeaseofthePropertybyPartyAtoPartyB.
一、出租房屋情况
ConditionoftheLeaseorPre-LeaseProperty

1-2甲方作为该房屋房地产权利人(房地产权利人/代管人/法律要求其她权利人)与乙方建立租赁关系。
签署本协议前,甲方已通知乙方该房屋(已/未)设定抵押。

1-3该房屋公用或适用部位使用范围、条件和要求;现有装修、隶属设施、设备情况和甲方同意乙方自行装修和增设隶属设施内容、标准及需约定相关事宜,由甲、乙双方分别在本协议附件
(二)、(三)中加以列明。
甲、乙双方同意该附件作为甲方向乙方交付该房屋和本协议终止时乙方向甲方返还该房屋验收依据。

二、租赁用途
PurposeoftheProperty
2-1乙方向甲方承诺,租赁该房屋作为住宅使用,并遵守国家和本市相关房屋使用和物业管理要求。
PartyBwarrantstoPartyAthatthePropertyshallbeusedforResidentialpurposeandfollowstheregulationsoftheStateandthisMunicipalityinrelationtotheuseandmanagementofProperty.
2-2乙方确保,在租赁期内未取得甲方书面同意以及按要求须经相关部门审批核准前,不私自改变上款约定使用用途。
PartyBguaranteethatduringtheleaseterm,itshallnotalterthepurposeofthePropertywithoutPartyA‘spriorwrittenconsentaswellastheapprovalfromtherelevantgovernmentaldepartment.
三、交付日期和租赁期限
DeliveryDateandLeaseTerm
3-1甲乙双方约定,甲方于年月日向乙方交付该房屋。

3-2租赁期满,甲方有权收回该房屋,乙方应准期返还。
乙方需继续承租房屋,则应于租赁期届满前2个月,向甲方提出续租书面要求,经甲方同意后重新签署租赁协议。
Uponexpiryoftheleaseterm,PartyAshallhavetherighttorepossessthePropertyinitsentiretyandPartyBshalldeliveritupaccordingly.IfPartyBwishestorenewthelease,itshallsubmitsuchintentinwritingtoPartyAtwomonthspriortotheexpiryoftheleaseandsignanewleasecontractwiththeconsentofPartyA.
四、租金、支付方法和期限
Rent,MethodofPaymentandTerm
4-1甲、乙双方约定,【出租】月租金人民币()(大写:

自第(年)起,双方可协商对租金进行调整。
相关调整事宜由甲、乙双方在补充条款中约定。

逾期支付,每逾期一日,则乙方需按日租金%支付违约金。

五、确保金和其她费用
DepositandOtherFeesandCharges
5-1甲、乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁确保金,确保金为贰个月租金,即(人民币贰万贰仟元整)。
甲方收取确保金后应向乙方开具收款凭证。
租赁关系终止时,甲方收取房屋租赁确保金除用以抵充协议约定由乙方负担费用外,剩下部分一周内无息归还乙方。
PartyAandPartyBhaveagreedthatatthetimeofthehandoverofthePropertybyPartyA,PartyBshallpaytoPartyAarentaldepositoftheProperty,thedepositshallbeTwomonthsofrent,thatis(RMBCurrencyTwenty-twothousandyuan.
PartyAshallissueareceipttoPartyBafterreceivingpaymentofdeposit.
Attheterminationofthelessor/lesseerelationship,theremainingdepositoftheleaseofthePropertyobtainedbyPartyAshallberefundedtoPartyBaftersettingoffthefeesandexpensesbornebyPartyBundertheContractwithoutinterestwithinoneweek.
5-2租赁期间,使用该房屋所发生水、电、煤气、通讯费用及ADSL安装费由乙方(甲方/乙方)负担。
其她物业管理费、卫星电视收视费和现场家庭会所卡两人,均由甲方(甲方/乙方)负担。
Duringtheleaseterm,thewater,electricity,gas,communicationoftheProperty,ADSLusagefeeandotherfeesresultedfromtheuseofthePropertyshallbebornebyPartyB.Allothermanagementfee,satelliteTVinstallation,onsiteclubmembershipcardshallbebornebyPartyA.
5-3乙方(甲方/乙方)负担上述费用,计算或分摊措施、支付方法和时间:
依据上述企事业单位列出帐单凭证支付,如不按期付款,滞纳金由乙方负担。
PartyBshallberesponsibletopaytheabovefeesandcharges,thecomputationoramortization,methodandtimeofpayment:
Accordingtothedemandnotes,ifdelayingpayment,PartyBshouldberesponsibleforthepenalty.
六、房屋使用要求和维修责任
StandardRequiredforUseofPropertyandResponsibilityofPropertyMaintenanceandRepair
6-1租赁期间,乙方发觉该房屋及其隶属设施有损坏或故障时,应立刻通知甲方修复;甲方应在接到乙方通知后日内进行维修。
逾期不维修,乙方可代为维修,费用由甲方负担。
Duringtheleaseterm,ifPartyBdiscoversanydamagesordefectsofthePropertyandfacilitiesattached,itshallnotifyPartyAimmediatelyforrepair.PartyAshallcarryouttherepairwithindaysafterreceivingnotificationfromPartyB.AnydelayinrepairmayberepairedbyPartyBonPartyA’sbehalfandtheexpensesincurredshallbebornebyPartyA.
6-2租赁期间,乙方应合理使用并珍惜该房屋其隶属设施。
因乙方使用不妥或不合理使用,致使该房屋及其隶属设施损坏或发生故障,乙方应负责维修。
乙方拒不维修,甲方可代为维修,费用由乙方负担。
Duringtheleaseterm,PartyBshallreasonablyuseandtakegoodcareofthePropertyandthefacilitiesattached.PartyBshallberesponsibletorepairimmediatelythedamagescausedtothePropertyand/orfacilitiesduetoimproperandunreasonableusebyPartyB.IfPartyBrefusestorepair,PartyAmayrepaironitsbehalfandtheexpensesincurredshallbebornebyPartyB.
6-3租赁期间,甲方确保该房屋及其隶属设施处于正常可使用和安全状态。
甲方对该房屋进行检验、养护,应提前日通知乙方。
检验养护时,乙方应给予配合。
甲方应降低对乙方使用该房屋影响。
Duringtheleaseterm,PartyAshallguaranteethenormalusableandsafeconditionofthePropertyandfacilitiesattached.PartyAshallnotifyPartyBdaysinadvancebeforecarryingoutexaminationandmaintenanceworks.PartyBshallrendercooperationduringtheexaminationandmaintenance.PartyAshallreducetheeffectcausedtoPartyBinusingtheProperty.
6-4乙方需装修或者增设隶属设施和设备,应事先取得甲方书面同意,按要求须向相关部门审批,则还应由甲方(甲方/甲方委托乙方)报请相关部门同意后,方可进行。
乙方增设隶属设施设备归属及其维修责任由甲、乙双方另行书面约定。
ExceptforAppendix3ofthisContract,beforecarryingoutanyextrarenovationoradditionoffacilitiesattachedandequipment,PartyBshallobtainthewrittenconsentofPartyAandsubmitthesametotherelevantauthorityforexaminationandapprovalinaccordancewiththeregulations.TheworkscouldonlybecarriedoutuponcompletionoftheprocedureofapprovalwiththerelevantauthoritybyPartyA.TheresponsibilityofthemaintenanceoftheaddedfacilitiesbyPartyBshallbeagreedbyPartyAandPartyBinseparatewrittenagreement.
七、房屋返还时状态
ConditionofPropertyatDeliveryBack
7-1除甲方同意乙方续租外,乙方应在本协议租期届满后日内返还该房屋,未经甲方同意逾期返还房屋,每逾期一日,乙方应按向甲方支付该房屋占用期间使用费。
ExceptfortherenewalofleaseagreedbyPartyA,PartyBshalldeliverupthePropertywithinaftertheexpirationofleasetermofthisContract.LatedeliveryofthePropertywithouttheconsentofPartyAshallbesubjecttoachargeforadversepossessionofthePropertyattimeofrentperday.
7-2乙方返还该房屋应该符合正常使用后状态。
返还时,应经甲方验收认可,并相互结清各自应该负担费用。
ThePropertyatthetimeofdeliveryupbyPartyBshallbeofaconditionafternormaluse.ThedeliveryupshallbeexaminedandauthorizedbyPartyAandthefeeandchargesresponsiblebythepartiesshallbeclearedatthetimeofdeliveryup.
八、转租、转让和交换
Sublease,AssignmentandExchange
8-1除甲方已在本协议补充条款中同意乙方转租外,乙方在租赁期内,需事先取得甲方书面同意,方同将该房屋部分或全部转租给她人。
但同一间居住房屋,不得分割转租。
UnlessotherwiseagreedinthesupplementaryclausesofthisContract,PartyBshallobtainthewrittenapprovalfromPartyAbeforeitcouldsubleasepartorallofthePropertytoathirdpartyduringtheleaseterm.PartyBshallnotsubleasepartofthePropertyorsubleasetotwolesseesormorethantwolesseesatthesametime.
8-2乙方转租该房屋,应按要求与接收转租方签订书面转租协议。
并按要求向该房屋所在区、县房地产交易中心或农场系统受理处办理登记立案。
WhenPartyBsubleasestheProperty,itshallenterintoasubleasecontractwiththelesseeinwritinginaccordancewiththeregulations.Thesubleasecontractshallberegisteredand
