第11章海上保险中英对照

Chapter11MarineInsuranceContract

OceanMarineCargoClauses（PICC）（AmendedJan，1，1981）

Ⅰ.Scopeofcover

ThisinsuranceisclassifiedintothefollowingthreeConditions-FreeFromParticularAverage（F.P.A.），WithAverage（W.A.）andAllRisks.Wherethegoodsinsuredhereundersustainlossordamage，theCompanyshallundertaketoindemnifythereforeaccordingtotheInsuredConditionspecifiedinthePolicyandtheProvisionsoftheseClauses.

1.FreeFromParticularAverage（F.P.A.）

Thisinsurancecovers：

1）TotalorConstructiveTotalLossofthewholeconsignmentherebyinsuredcausedinthecourseoftransitbynaturalcalamities–heavyweather，lightning，tsunami，earthquakeandflood，incaseofconstructivetotalslossisclaimedfor，theInsuredshallabandontotheCompanythedamagedgoodsandallhisrightsandtitlepertainingthereto.Thegoodseachlightertaketoorfromtheseagoingvesselshallbedeemedaseparaterisk.

“ConstructiveTotalLoss”referstothelosswhereanactualtotallossappearstobeunavoidableorthecosttobeincurredinrecoveringorreconditioningthegoodstogetherwiththeforwardingcosttothedestinationnamedinthePolicywouldexceedtheirvalueonarrival.

2）TotalorpartialLosscausedbyaccidents–thecarryingconveyancebeinggrounded，stranded，sunkorincollisionwithfloatingiceorotherobjectsasfireorexplosion.

3）Partiallossoftheinsuredgoodsattributabletoheavyweather，lightningand/ortsunami，wheretheconveyancehasbeengrounded，stranded，sunkorburnt，irrespectiveofwhethertheeventoreventstookplacebeforeoraftersuchaccidents.

4）Partialortotallossconsequentonfallingofentirepackagesintoseaduringloading，transshipmentordischarge.

5）ReasonablecostincurredbytheInsuredinsalvagingthegoodsoravertingorminimizingalossrecoverableunderthePolicy，providedthatsuchcostshallnotexceedthesumInsuredoftheconsignmentsosaved.

6）Lossesattributabletodischargeoftheinsuredgoodsataportofdistressfollowingaseaperilaswellasspecialchargesarisingfromloading，warehousingandforwardingofthegoodsatanintermediateportofcallorrefuge.

7）SacrificeinandContributiontoGeneralAverageandSalvageCharges.

8）SuchproportionoflossessustainedbytheshipownersasistobereimbursedbytheCargoOwnerundertheContractofAffreightment“BothtoBlameCollision”clause.

2.WithAverage（W.A.）

AsidefromtheriskscoveredunderF.P.A.conditionasabove，thisinsurancealsocoverspartiallossesoftheinsuredgoodscausedbyheavyweather，lightning，tsunami，earthquakeand/orflood.

3.AllRisks

AsidefromtheriskscoveredundertheF.P.A.andW.A.conditionsasabove，thisinsurancealsocoversallrisksoflossofordamagetotheinsuredgoodswhetherpartialortotal，arisingfromexternalcausesinthecourseoftransit.

Ⅱ.Exclusions

Thisinsurancedoesnotcover：

1.Lossordamagecausedbytheintentionalactorfaultoftheinsured.

2.Lossordamagefallingundertheliabilityoftheconsignor.

3.Lossordamagearisingfromtheinferiorqualityorshortageoftheinsuredgoodspriortotheattachmentofthisinsurance.

4.Lossordamagearisingfromnormalloss，inherentviceornatureoftheinsuredgoods，lossofmarketand/ordelayintransitandanyexpensesarisingtherefrom.

5.Risksandliabilitiescoveredandexcludedbytheoceanmarine（cargo）warrisksclausesandstrike，riotandcivilcommotionclausesofthisCompany.

Ⅲ.CommencementandTerminationofCover

1.WarehousetoWarehouseClause

ThisinsuranceattachesfromthetimethegoodsherebyinsuredleavethewarehouseorplaceofstoragenamedinthePolicyforthecommencementofthetransitandcontinuesinforceintheordinarycourseoftransitincludingsea，landandinlandwaterwaytransitsandtransitinlighteruntiltheinsuredgoodsaredeliveredtotheconsignee’sfinalwarehouseorplaceofstorageatthedestinationnamedinthePolicyortoanyotherplaceusedbytheInsuredforallocationordistributionofthegoodsorstorageotherthanintheordinarycourseoftransit.Thisinsuranceshall，however，belimitedtosixty（60）daysaftercompletionofdischargeoftheinsuredgoodsfromtheseagoingvesselatthefinalportofdischargebeforetheyreachtheabovementionedwarehouseorplaceofstorage.Ifpriortotheexpirytotheabovementionedsixty（60）days，theinsuredgoodsaretobeforwardedtoadestinationotherthanthatnamedinthePolicy，thisinsuranceshallterminateatthecommencementofsuchtransit.

2.Ifowingtodelay，deviation，forceddischarge，reshipmentortransshipmentbeyondthecontroloftheinsuredoranychangeorterminationofthevoyagearisingfromtheexerciseofalibertygrantedtotheshipownersunderthecontractofaffreightment，theinsuredgoodsarriveataportorplaceotherthanthatnamedinthePolicy，subjecttoimmediatenoticebeinggiventotheCompanybytheInsuredandanadditionalpremiumbeingpaid，ifrequired，thisinsuranceshallremaininforceandshallterminateashereunder：

1）IftheinsuredgoodsaresoldatportorplacenotnamedinthePolicy，thisinsuranceshallterminateondeliveryofthegoodssold，butinnoeventshallthisinsuranceextendbeyondsixty（60）daysaftercompletionofdischargeoftheinsuredgoodsfromthecarryingvesselatsuchportorplace.

2）Iftheinsuredgoodsaretobeforwardedtothefinaldestinationnamedinthepolicyoranyotherdestination，thisinsuranceshallterminateinaccordancewithSectionⅠabove.

Ⅳ.DutyoftheInsured

ItisthedutyoftheInsuredtoattendtoallmattersasspecifiedhereunder，failingwhichtheCompanyreservestherighttorejecthisclaimforanylossifandwhensuchfailureprejudicetherightsoftheCompany.

1.TheInsuredshalltakedeliveryoftheinsuredgoodsingoodtimeupontheirarrivalattheportofdestinationnamedinthePolicy.Intheeventofanydamagetothegoods，theInsuredshallimmediatelyapplyforsurveytotheSurveyand/orsettlingagentstipulatedinthePolicy.Iftheinsuredgoodsarefoundshortinentirepackagesortoshowapparenttracesofdamage，theInsuredshallobtainfromthecarrier，baileeorotherrelevantauthorities，（CustomsandPortAuthorities，etc.）certificateoflossordamageand/orshortlandedmemo.Shouldthecarrier，baileeortheotherrelevantauthoritiesberesponsibleforsuchshortageordamage，theInsuredshalllodgeaclaimwiththeminwritingand，ifnecessary，obtaintheirconfirmationofanextensionofthetimelimitofvalidityofsuchclaim.

2.TheInsuredshall，andtheCompanyalso，takereasonablemeasuresimmediatelyinsalvagingthegoodsorpreventingorminimizingalossordamagethereto.ThemeasuressotakenbytheInsuredorbytheCompanyshallnotbeconsideredrespectively，asawaiverofabandonmenthereunder，orasanacceptancethereof.

3.Inthecaseofachangeofvoyageoranyomissionorerrorinthedescriptionoftheinterest，thenameofthevesselorvoyage，thisinsuranceshallremaininforceonlyuponpromptnoticetothisCompanywhentheInsuredbecomesawareofthesameandpaymentofanadditionalpremiumifrequired.

4.ThefollowingdocumentsshouldaccompanyanyclaimhereundermadeagainstthisCompany：

OriginalPolicy，BillofLading，InvoicePackingList，TallySheet，WeightMemo，CertificateofLossorDamageand/orSurveyReport，StatementofClaim.

Ifanythirdpartyisinvolved，documentsrelativetopursuingofrecoveryfromsuchpartyshouldalsobeincluded.

5.ImmediatenoticeshouldbegiventotheCompanywhentheCargoOwner’sactualresponsibilityundertheContractofAffreightment“BothtoBlameCollision”Clausebecomesknown.

Ⅴ.TheTimeofValidityofAClaim

Thetimeofvalidityofaclaimunderthisinsuranceshallnotexceedaperiodoftwoyearscountingfromthetimeofcompletionofdischargeoftheinsuredgoodsfromtheseagoingvesselatthefinalportofdischarge.

HullInsuranceClauses（PICC）

Thesubjectmatterofthisinsuranceisthevessel，includingitshull，lifeboats，machinery，equipments，instruments，tackles，bunkersandstores.

ThisinsuranceisclassifiedintoTotalLossCoverandAllRiskCover.

ⅠScopeofCover

A.TotalLossCover

ThisinsurancecoverstotallossoftheInsuredvesselcausedby：

1.earthquake，volcaniceruption，lightningorothernaturalcalamities；

2.grounding，collision，contactwithanyobject，fixed，floatingorotherwise，orotherperilsofthesea；

3.fireorexplosions；

4.violenttheftbypersonsfromoutsidethevesselorpiracy；

5.jettison；

6.breakdownoforaccidenttonuclearinstallationsorreactors；

7.thisinsurancealsocoverstotallossoftheInsuredvesselcausedby：

1）accidentsinloading，dischargingorshiftingcargoorfuel；

2）anylatentdefectinamachineryorhullofthevessel；

3）wrongfulactswillfullycommittedbythemasterorcrewtotheprejudiceoftheInsuredinterest；

4）negligenceofthemaster，creworpilotsrepairersorcharterers；

5）actsofanygovernmentalauthoritytopreventorminimizeapollutionhazardresultingfromdamagetothevesselcausedbyrisksinsuredagainst，providedsuchlosshasnotresultedfromwantofduediligencebytheInsured，OwnersorManagers.

B.AllRisksCover

ThisinsurancecoverstotallossoforpartiallossofordamagetotheInsuredvesselarisingfromthecausesundertheTotalLossCoverandalsocoverstheunder-mentionedliabilityorexpense：

1.CollisionLiabilities

1）ThisinsurancecoverslegalliabilitiesoftheInsuredasaconsequenceoftheInsuredvesselcomingintocollisionorcontactwithanyothervessel，oranyobject，fixed，floatingorotherwise.However，thisclausedoesnotcoveranyliabilitiesinrespectof：
