Article1:
ThisLawispromulgatedpursuanttotheConstitutionforthepurposesofsafeguardingthebasiceconomicsystemoftheStateandtheorderofthesocialistmarketeconomy,clarifyingpropertyownership,optimizingpropertyfunctionandprotectingthepropertyrightsofrightsholders.
Article2:
ThisLawshallapplytocivilrelationshiparisingfromtheownershipandusageofproperties.
PropertiesreferredtointhisLawshallincludeimmovablepropertyandmovableproperty.Wherethelawprovidesfortheobjectofpropertyrights,suchprovisionsshallprevail.
PropertyrightsreferredtointhisLawshallmeantherightstodirectcontrolandexclusivityforspecificpropertiesenjoyedbyarightsholderpursuanttothelawandshallincludeownership,usufructandcollateralrights.
Article3:
TheStateupholdsthebasiceconomicsystemcomprisingthepublicownershipsystemasthemainentityandcommoneconomicdevelopmentofmultipleownershipsystemsinthepreliminaryphaseofsocialism.
TheStatebuildsonanddevelopspublicownershipeconomy;encourages,supportsandguidesthedevelopmentofnon-publicownershipeconomy.
TheStatepracticessocialistmarketeconomyandprotectsequallegalstatusanddevelopmentrightsofallmarketentities.
Article4:
ThepropertyrightsoftheState,collectivepartiesandprivateindividualsaswellaspropertyrightsofotherrightsholdersshallbeprotectedbythelawandshallnotbeinfringedbyanyunitorindividual.
Article5:
Typesandcontentsofpropertyrightsshallbestipulatedbythelaw.
Article6:
Thecreation,variation,transferandextinguishmentofpropertyrightsofimmovablepropertyshallberegisteredpursuanttotheprovisionsofthelaw.Thecreationandtransferofpropertyrightsofmovablepropertyshallbedeliveredpursuanttotheprovisionsofthelaw.
Article7:
Theobtainingandexerciseofpropertyrightsshallcomplywiththelaw,respectsocialmoralsandshallnotharmpublicinterestorthelegitimateinterestsofothers.
Article8:
Whereotherrelevantlawscontainspecialprovisionsonpropertyrights,suchprovisionsshallprevail.
CHAPTERTWO:
CREATION,VARIATION,TRANSFERANDEXTINGUISHMENTOFPROPERTYRIGHTS
SECTIONONE:
REGISTRATIONOFIMMOVABLEPROPERTY
Article9:
Creation,variation,transferandextinguishmentofpropertyrightsofimmovablepropertyregisteredpursuanttothelawshallbevalid;unlessotherwiseprovidedbythelaw,suchcreation,variation,transferandextinguishmentshallbeinvalidwithoutregistration.
RegistrationisnotrequiredforownershipofnaturalresourceswhichbelongtotheStatepursuanttothelaw.
Article10:
Registrationofimmovablepropertyshallbehandledbytheregistrationauthorityatthelocationoftheimmovableproperty.
TheStateimplementsaunifiedregistrationsystemforimmovableproperty.Thescopeofunifiedregistration,registrationauthorityandregistrationmethodsshallbestipulatedbythelawsandadministrativeregulations.
Article11:
Partiesconcernedinanapplicationforregistrationshallprovidetheproofoftitleandrequisitematerialssuchasinformationonboundariesandareaofimmovablepropertyaccordingtotherespectiveregistrationmatters.
Article12:
Theregistrationauthorityshallperformthefollowingduties:
1.inspecttheproofoftitleandotherrequisitematerialsprovidedbytheapplicant;
2.inquirewiththeapplicantinrespectofregistrationmatters;
3.registertherelevantmattersfactuallyandpromptly;and
4.otherdutiesstipulatedbythelawsandadministrativeregulations.
Wherefurtherproofisrequiredfortheimmovablepropertyunderanapplicationforregistration,theregistrationauthoritymayrequiretheapplicanttoprovidesupplementarymaterialsandmayconductanonsiteinspectionwherenecessary.
Article13:
Theregistrationauthorityshallnothavethefollowingbehaviour:
1.requireavaluationoftheimmovableproperty;
2.conductrepeatedregistrationinthenameofannualinspectionetc;or
3.commitanyotheractbeyondthescopeofregistrationduties.
Article14:
Wherethecreation,variation,transferandextinguishmentofpropertyrightsofimmovablepropertyrequiresregistrationpursuanttotheprovisionsofthelaw,suchcreation,variation,transferandextinguishmentofpropertyrightsshalltakeeffectonthedatestatedintheregisterofimmovableproperty.
Article15:
Unlessotherwisestipulatedbythelawsorcontractualprovisions,acontractenteredintobetweenthepartiesconcernedonthecreation,variation,transferorextinguishmentofpropertyrightsofimmovablepropertyshalltakeeffectuponconclusionofthecontract;thefailuretocompleteregistrationofpropertyrightsshallnotaffectthevalidityofthecontract.
Article16:
Theregisterofimmovablepropertyisthebasisofownershipandcontentsofpropertyrights.Theregisterofimmovablepropertyshallbemanagedbytheregistrationauthority.
Article17:
Thetitledeedoftheimmovablepropertyistheproofofrightsholder’sentitlementtothepropertyrightsoftheimmovableproperty.Themattersrecordedinthetitledeedoftheimmovablepropertyshallbeconsistentwiththoserecordedintheregisterofimmovableproperty;unlessthereisevidencetoprovethatthereisanerrorintheregisterofimmovableproperty,theinformationintheregisterofimmovablepropertyshallprevailintheeventofanyinconsistency.
Article18:
Rightsholdersandinterestedpartiesmayapplytoinspectandmakecopiesofregistrationinformationandtheregistrationauthorityshallfacilitate.
Article19:
Arightsholderoraninterestedpartythatisoftheviewthattheinformationrecordedintheregisterofimmovablepropertycontainsanerrormayapplyforcorrectionoftherelevantregistrationinformation.Whererightsholderrecordedintheregisterofimmovablepropertyhasissuedawrittenconsentforcorrectionorthereisevidencetoprovethattheregistrationinformationcontainsanerror,theregistrationauthorityshallmaketheduecorrection.
Wheretherightsholderrecordedintheregisterofimmovablepropertydoesnotconsenttocorrection,theinterestedpartymayapplyforregistrationofanobjection.Wheretheregistrationauthoritygrantstheregistrationofobjectionbuttheapplicantdoesnotfilealawsuitwithin15daysfromtheregistrationofobjection,theregistrationofobjectionshallbecomevoid.Whereaninappropriateregistrationofobjectioncausestherightsholdertosufferdamages,therightsholdermayseekcompensationfordamagesfromtheapplicant.
Article20:
Apartyconcernedwhohasenteredintoanagreementonsaleandpurchaseofhousingpropertyorotherpropertyrightsofimmovablepropertymay,forthepurposeofensuringfuturerealizationofpropertyrights,applytotheregistrationauthorityforpre-registrationpursuanttotheagreement.Where,followingthepre-registration,theimmovablepropertyisdisposedofwithouttheconsentoftherightsholderinthepre-registration,thepropertyrightsshallbeinvalid.
Where,followingthepre-registration,thecreditor’srightshaveextinguishedornoregistrationismadewithinthreemonthsfromthedateofregistrationofimmovableproperty,thepre-registrationshallbecomevoid.
Article21:
Apartyconcernedwhoprovidesfalsematerialstoapplyforregistrationandcausesotherstosufferdamagesshallbearcompensationliability.
Whereanerrorinregistrationcausesotherstosufferdamages,theregistrationauthorityshallbearcompensationliability.Uponmakingcompensation,theregistrationauthoritymayseekrecourseagainstthepartywhichcausestheerrorinregistration.
Article22:
Registrationfeesforimmovablepropertyshallbecollectedonaperitembasisandshallnotbebasedonthearea,sizeorapercentageofthepriceoftheimmovableproperty.SpecificfeeratesshallbestipulatedbytherelevantStateCouncildepartmentjointlywiththepricingauthority.

Unlessotherwisestipulatedbythelaw,thecreationandtransferofproperty
