Inordertoobtainapatentright,youmustapplytotheJapanPatentOfficeandgothroughexaminationstodeterminewhethertheapplicationfulfillsallthenecessaryrequirements.

TheJPO,whichexaminesallapplicationsfromaroundtheworld,takesprecautionarymeasuresbeforeultimatelygrantinganypatentright.Theseinvolveexchangeofdocumentswiththeapplicanttodeterminewhichclaims,ifany,areentitledtobepatented.Thewholeprocedurefromfilingtoregistrationisshownintheflowchartbelow.

申请流程

（1）Application

Nomatterhowgoodaninventionmaybe,apatentrightnaturallycannotbeobtainedunlessitisappliedfor.AnapplicationrequiresthatonefillsouttheformsprescribedintherelevantordinancesandsubmitthemtotheJPO.

Japanhasadoptedthefirst-to-filesystem,i.e.theprinciplethatwheretwopartiesapplyforapatentforthesameinvention,thefirstpartytofilewillbegrantedthepatent.Accordingly,itisadvisabletofileassoonaspossibleaftertheinvention.Itisalsoadvisablenottomaketheinventionpublicbeforefilingapatentapplication.

（2）FormalityExamination

AnapplicationdocumentsubmittedtotheJPOwillbecheckedtoseewhetheritfulfillsthenecessaryproceduralandformalrequirements.Aninvitationtocorrectwillbemadewherenecessarydocumentsaremissingorrequiredsectionshavenotbeenfilledin.

（3）PublicationofUnexaminedApplication

TheJPOwillpublishthecontentofanapplicationintheOfficialGazetteafter18monthshaveelapsedfromthedateoffiling.

（4）RequestforExamination

Patentapplicationsarenotnecessarilyexamined.Anexaminationwillbecarriedoutonlyfortheapplicationforwhichtheapplicantorathirdpartyhasfiledarequestforexaminationandpaidtheexaminationfees.

（5）DeemedWithdrawal（NoRequestforExamination）

Anyapplicationforwhicharequestforexaminationhasnotbeenfiledwithinaperiodof*threeyearsfromfilingdatewillautomaticallyberegardedaswithdrawalandcannotbepatentedthereafter.

（6）SubstantiveExamination

AnexaminationwillbecarriedoutbyanexamineroftheJPO,whowilldecidewhetherornottheclaimedinventionshouldbepatented.Theexaminerfirstlycheckswhethertheapplicationfulfillsrequirementsprescribedbylaw,i.e.,whetherornotthereareanyreasonsforrefusal.Theserequirementsincludethefollowing:

1.Whethertheclaimedinventionisbasedonatechnicalideawhichutilizesalawofnature,

2.Whetherithasanyindustrialapplicability,

3.Whetherthetechnicalideaexistedbeforethefilingofthecurrentapplication,

4.Whethertheclaimedinventioncouldhavebeeneasilyinventedbyapersonskilledintheart,

5.Whethertheapplicationisthefirsttofile,

6.Whethertheclaimedinventionisliabletocontravenepublicorderandmorality,and

7.Whetherthedescriptionsinthespecificationconformexactlywiththerequirementsforpatentability.

（7）NotificationofReasonsforRefusal

Iftheexaminerfindsreasonsforrefusal,anotificationtothisresultwillbesenttotheapplicant.

（8）WrittenArgument/Amendment

Anapplicantwhohasreceivedthenotificationofreasonsforrefusalshallbegivenanopportunitytosubmiteitherawrittenargumentclaimingthattheinventiondiffersfromthepriorarttowhichthenotificationofreasonsforrefusalrefers,oranamendmentoftheclaimsinthecasethatthiswouldnullifythereasonsforrefusal.

（9）DecisiontoGrantaPatent

Asaresultoftheexamination,theexaminerwillmakeadecisiontograntapatentasthefinalassessmentoftheexaminationstageifnoreasonsforrefusalhavebeenfound.Theexaminerwillalsomakethesamedecisionifthereasonsforrefusalhavebeeneliminatedbyanargumentoramendment.

（10）DecisionofRefusal

Ontheotherhand,iftheexaminerjudgesthatthereasonsforrefusalhavenotbe
