　　第一章总则

ChapterIGeneralProvisions

　　第一条为推进商标战略的实施，规范驰名商标的认定工作，促进驰名商标认定工作进一步制度化、规范化、程序化、法治化，切实维护商标权人的合法权益，健全知识产权保护体系，优化创新环境，促进经济社会又好又快发展，根据《中华人民共和国商标法》、《中华人民共和国商标法实施条例》、《驰名商标认定和保护规定》和《国家工商行政管理总局主要职责内设机构和人员编制规定》，制定本细则。

Article1Forthepurposesofboostingtheimplementationoftrademarkstrategies,regulatingtherecognitionofwell-knowntrademarks,promotingamoresystematic,standardized,proceduralizedandlegallyrobustprocessfortherecognitionofwell-knowntrademarks,protectingtrademarkholders'legitimaterightsandinterests,improvingintellectualpropertyprotection,creatinganinnovativeenvironmentandpromotingtherapidandbeneficialdevelopmentoftheeconomyandsociety,theseDetailedRulesontheRecognitionofWell-knownTrademarks（the"DetailedRules"）havebeenformulatedinaccordancewiththeTrademarkLawofthePeople'sRepublicofChina,theTrademarkLawImplementingRegulationsofthePeople'sRepublicofChina,theProvisionsontheRecognitionandProtectionofWell-knownTrademarks,andtheProvisionsoftheStateAdministrationofIndustryandCommerceonMainFunctions,InternalDecision-makingBodiesandStaffArrangements.

　　第二条本细则中的驰名商标认定是指商标局、商标评审委员会依照《商标法》、《商标法实施条例》、《驰名商标认定和保护规定》、《商标评审规则》以及国家工商行政管理总局《各司（厅、局、室）主要职责内设机构和人员编制规定》的有关规定认定驰名商标。

Article2ForthepurposeoftheseDetailedRules,"recognitionofwell-knowntrademarks"shallrefertotherecognitionoftrademarksbytheTrademarkOfficeandtheTrademarkReviewandAdjudicationBoardinaccordancewiththerelevantprovisionsoftheTrademarkLaw,theTrademarkLawImplementingRegulations,theProvisionsontheRecognitionandProtectionofWell-knownTrademarks,theRulesonTrademarkReviews,andtheProvisionsoftheStateAdministrationofIndustryandCommerceontheMainFunctions,InternalDecision-makingBodiesandStaffArrangementsforEachDepartment（Office,Bureau,Section）.

　　第三条驰名商标认定工作的目的是加大商标权保护力度，引导企业实施商标战略，使用自主商标，丰富商标内涵，重视商标知识产权创新和保护，提高商标知名度，形成一批拥有自主知识产权和知名品牌、国际竞争力较强的优势企业，促进企业和经济社会发展，推动创新型国家建设。

Article3Theaimoftrademarkrecognitionistostrengthentheprotectionoftrademarkrights,guideenterprisestoimplementtrademarkstrategies,usetheirowntrademarks,enrichtheconnotationsoftrademarks,emphasizetrademarkinnovationandprotection,enhancetheawarenessoftrademarks,establishagroupofdominantenterpriseswiththeirownintellectualproperty,well-knownbrandsandahighdegreeofinternationalcompetitiveness,boostthedevelopmentofenterprises,theeconomyandsociety,andpromotetheestablishmentofaninnovativenation.

　　第四条商标局、商标评审委员会应严格、准确、依法开展驰名商标认定工作，正确引导舆论宣传，促进驰名商标认定和保护制度的健康发展，支持帮助企业合理实施商标战略。

　　商标局应指导各地工商行政管理部门在驰名商标认定申请工作中严格把关，确保申请材料内容真实、准确。

Article4TheTrademarkOfficeandtheTrademarkReviewandAdjudicationBoardshallrecognizetrademarksstrictlyandaccuratelyaccordingtolaw,guidepublicopinionandpublicityasappropriate,promotethehealthydevelopmentofthewell-knowntrademarkrecognitionandprotectionsystem,andsupportandassistenterprisesinimplementingtheirtrademarkstrategiesinareasonablemanner.

TheTrademarkOfficeshallberesponsibleforleadingalllocaladministrativeauthoritiesofindustryandcommerceincheckingapplicationsfortrademarkrecognitionstrictlyinordertoensuretheirauthenticityandaccuracy.

　　第五条商标局、商标评审委员会成立驰名商标认定委员会，其成员包括商标局、商标评审委员会的局长、主任、副局长、副主任、巡视员、副巡视员，局长、主任为主任委员。

Article5TheTrademarkOfficeandtheTrademarkReviewandAdjudicationBoardshallsetupaWell-knownTrademarkRecognitionCommitteewhosemembersshallincludedirectors,deputydirectors,monitorsanddeputymonitorsoftheTrademarkOfficeandtheTrademarkReviewandAdjudicationBoard.Adirectorshallbethechairpersonofthecommittee.

　　第六条商标局、商标评审委员会承办处依本细则进行驰名商标认定申请材料的受理、整理和审查工作；商标局局长办公会、商标评审委员会委务会依本细则进行驰名商标认定中的审定工作；驰名商标认定委员会依本细则进行驰名商标认定中的复审工作；国家工商行政管理总局局长办公会对驰名商标认定委员会拟认定的驰名商标予以核审。

Article6TheTrademarkOfficeandthecasehandlingdivisionoftheTrademarkReviewandAdjudicationBoardshallberesponsibleforaccepting,managingandexaminingapplicationmaterialsforwell-knowntrademarkrecognitionaccordingtotheseDetailedRules;theexecutivedirectorsmeetingoftheTrademarkOfficeandtheexecutivemeetingoftheTrademarkReviewandAdjudicationBoardshallberesponsiblefortheapprovalofwell-knowntrademarkrecognitionapplicationsaccordingtotheseDetailedRules;theWell-knownTrademarkRecognitionCommitteeshallberesponsibleforthereviewofwell-knowntrademarkrecognitionapplicationsaccordingtotheseDetailedRules;theexecutivedirectorsmeetingoftheStateAdministrationofIndustryandCommerceshallberesponsiblefortheverificationofwell-knowntrademarkstheWell-knownTrademarkRecognitionCommitteeproposesforrecognition.

　　第二章驰名商标认定申请的审查、审定

ChapterIIExaminationandApprovalofWell-knownTrademarkRecognitionApplications

　　第一节驰名商标认定应考虑的因素、证据材料

Section1FactorstoBeConsideredinandEvidentialMaterialsfortheRecognitionofWell-knownTrademarks

　　第七条认定驰名商标应当根据《商标法》第十四条的规定，考虑下列各项因素，但并不以该商标必须满足下列全部因素为前提：

（一）相关公众对该商标的知晓程度；

（二）该商标使用的持续时间；

　　（三）该商标的任何宣传工作的持续时间、程度和地理范围；

　　（四）该商标作为驰名商标受保护的记录；

　　（五）该商标驰名的其他因素。

Article7InaccordancewiththeprovisionsofArticle14oftheTrademarkLaw,thefollowingfactorsshallbetakeninconsiderationinassessinganapplicationforwell-knowntrademarkrecognition,notallofwhichmustbesatisfiedbythetrademarkinquestion:

（1）Theextenttowhichtherelevantsectionofthepublicisawareofthetrademark;

（2）Theperiodforwhichithasbeenused;

（3）Theperiodforwhich,extentof,andgeographicalscopeofthepromotionalactivitiescarriedoutforthetrademarkinquestion;

（4）Recordsshowingthatithasbeenprotectedasawell-knowntrademark;or

（5）Anyotherfactorindicatingitisawell-knowntrademark.

　　第八条认定驰名商标应当根据《驰名商标认定和保护规定》第三条的规定，审查下列证明商标驰名的证据材料：

（一）证明相关公众对该商标知晓程度的有关材料；

（二）证明该商标使用持续时间的有关材料，包括该商标使用、注册的历史和范围的有关材料；

　　（三）证明该商标的任何宣传工作的持续时间、程度和地理范围的有关材料，包括广告宣传和促销活动的方式、地域范围、宣传媒体的种类以及广告投放量等有关材料；

　　（四）证明该商标作为驰名商标受保护记录的有关材料，包括该商标曾在中国或者其他国家和地区作为驰名商标受保护的有关材料；

　　（五）证明该商标驰名的其他证据材料，包括使用该商标的主要商品近三年的产量、销售量、销售收入、利税、销售区域等有关材料。

Article8InaccordancewiththeprovisionsofArticle3oftheProvisionsontheRecognitionandProtectionofWell-knownTrademarks,thefollowingevidentialmaterialsprovingthatatrademarkiswell-knownshallbeexaminedinconsideringtherecognitionofawell-knowntrademark:

（1）Materialsprovingtheextenttowhichtherelevantsectionofthepublicisawareofthetrademark;

（2）Materialsprovingtheperiodforwhichithasbeenused,includingmaterialsprovingitsuse,history,andscopeofregistration;

（3）Materialsprovingtheperiodforwhich,extentof,andgeographicalscopeofthepromotionalactivitiescarriedoutforthetrademarkinquestion,includingmaterialsonthemeansbywhichandgeographicalscopeofadvertising,publicityandpromotionalactivitiescarriedout,alongwiththetypesofmediaandadvertisementexpenditure,etc.;

（4）Materialsprovingthatithasbeenprotectedasawell-knowntrademark,includingmaterialsprovingthatithasbeenprotectedasawell-knowntrademarkinChinaorinothercountriesorregions;and

（5）Otherevidentialmaterialsprovingitisawell-knowntrademark,includingmaterialsontheproductionvolume,salesvolume,salesincome,profitsandtaxes,salesregions,etc.,ofthemajorproductsthathaveusedthetrademarkinthepastthreeyears.

　　第二节商标管理程序中的审查

Section2ExaminationintheCourseofTrademarkAdministration

　　第九条对经省级工商行政管理机关依《驰名商标认定和保护规定》上报的驰名商标认定申请的案件材料及证明商标驰名的证据材料，商标局实行收文和办文分开制度，由商标局综合处负责收文，有关承办处负责材料整理，建立登记簿登记。

　　对在商标管理中提出的驰名商标认定申请，申请人提交补充证据材料的，有关承办处在相关申请提交商标局局长办公会之前可将补充材料内容纳入申请材料予以整理。

Article9TheTrademarkOfficeshallreceiveanddealseparatelywithallapplicationmaterialsforwell-knowntrademarkrecognitionandevidentialmaterialsprovingthetrademarkiswell-knownsubmittedbytheadministrativeauthoritiesofindustryandcommerceattheprovinciallevelaccordingtotheProvisionsontheRecognitionandProtectionofWell-knownTrademarks.ThegeneralofficeoftheTrademarkOfficeshallberesponsibleforreceivingsuchmaterialsandthecompetenthandlingdivisionshallberesponsibleformanagingsuchmaterialsandregisteringthesame.

Wheretheapplicantinanapplicationforwell-knowntrademarkrecognitionfiledinthecourseoftrademarkadministrationprovidessupplementaryevidentialmaterials,thecompetentofficemay,beforetheapplicationissubmittedtotheexecutivedirectorsmeetingoftheTrademarkOffice,includethesupplementarymaterialsintheapplicationmaterials.

　　第十条承办处可以就商标的显著性和驰名程度等技术性问题征求有关处室或有关部门的意见。

　　承办处认为确有必要时，可以向地方工商行政管理部门了解有关情况。

Article10Thehandlingdivisionmayseekopinionsfromrelevantoffices,sections,ordepartmentsinrespectoftechnicalquestionssuchasprominenceofatrademarkandtheextenttowhichitiswell-known.

Wherethehandlingdivisiondeemsitnecessary,itmayseekrelevantinformationfromthelocaladministrativeauthorityofindustryandcommerce.
