AccordingtoTheContractLawofP.R.CandTheRegulationOnPremiseLeasingofBeijing（hereinafterreferredastotheRegulation）,PartyAandPartyB,oftheirownvolition,uponfriendlynegotiation,herebyagreetosignthiscontractforthedealthatPartyAletsthepremiseswhichislegallyownedbyPartyAtoPartyBandPartyBleasefromPartyAthesaidpremises.

根据《中华人民共和国合同法》、《北京市房屋租赁条例》（以下简称：

《条例》）的规定，甲、乙双方在平等、自愿、公平和诚实信用的基础上，经协商一致，就乙方承租甲方可依法出租的房屋事宜，订立本合同。

Article1GeneralConditionofthepremisestobelet出租或预租房屋情况

1-1PartyAwillletthepremiseslocatedat（hereinafterreferredastothePremises）inBeijingtoPartyB.ThegrossareaofthePremisesisequaltosquaremeters.ThepurposeofthePremisesisforresidence.AnnexIistheplanefigureofthePremises.PartyAhasshowntheplanefigureandtheTitle-deedofthePremises（Number:

）toPartyB.

甲方出租给乙方的房屋座落在本市（部位）。

（以下简称该房屋）。

该房屋出租建筑面积为平方米，房屋用途为居住。

该房屋的平面图见本合同附件

（一）。

甲方已向乙方出示该平面图及该房屋产权证（产证编号：

）：

1-2AstheownerofthePremises,PartyAestablishestheleaserelationwithPartyB.Priortosigningthiscontract,PartyA（“has”or“hasnot”）informedPartyBofthemortgageonthePremises.

甲方作为该房屋的（房地产权利人/代管人/法律规定的其他权利人）与乙方建立租赁关系。

签订本合同前，甲方已告知乙方该房屋（已/未）设定抵押。

1-3Range,ConditionandRequirementof/forthepartincommonuseofthePremisesandtheconditionsoftheexistingdecorationandfacilitiesareillustratedintheAnnexIIandIIIherein.Unlessotherwisespecified,theAnnexwillberegardedasaninspectionlisttobecheckedandfollowedwhenPartyAhandsoverthePremisestoPartyBorPartyBreturnsthePremisestoPartyAwhentheleasetermisdue.

该房屋的公用或合用部位的使用范围、条件和要求及现有装修、附属设施、设备状况有关事宜，由甲、乙双方分别在本合同附件

（二）、（三）中加以列明。

甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。

Article2OccupationPurpose租赁用途

2-1PartyBguaranteedthatthePremiseswillonlybeoccupiedforpurpose,andhewillbeabidenbytheregulationsonhouseusingandmanaginginBeijing.

乙方向甲方承诺，租赁该房屋作为________使用，并遵守国家和本市有关房屋使用和物业管理的规定.

2-2Duringtheleaseterm,PartyBshallnotaltertheuseofthePremisesunlessPartyBhasobtainedthewrittenapprovalfromPartyAandcompletedtherelevantregistrationformsatcorrespondinggovernmentoffices.

乙方保证，在租赁期内未征得甲方书面同意以及按规定须经有关部门审批核准前，不擅自改变上款约定的使用用途。

Article3DeliveriesDateandLeaseTerms交付日期和租赁期限

3-1PartyAshalldeliverthePremisestoPartyBonDateMonthYear.TheleasetermofthePremisesismonthsthatcommenceonDateMonthYearandwillexpireonDateMonthYear.

甲乙双方约定，甲方于________年________月________日前向乙方交付该房屋。

【出租】房屋租赁期自________年________月________日起至________年________月________日止。

3-2Upontheexpirationofthelease,PartyAisentitledtowithdrawtherentedpremises,andPartyBwillvacateitintime.IntheeventPartyBwouldliketoextendthelease,heshallconsultwithPartyAonrelevantissuewithamustofmonths’priornoticetoPartyA.

租赁期满，甲方有权收回该房屋，乙方应如期返还。

乙方需要继续承租该房屋的，则应于租赁期届满前个月，向甲方提出续租书面要求，经甲方同意后重新签订租赁合同。

Article4RentandTermsofPayment租金、支付方式和期限

4-1ThemonthlyrentisRMB（orUSD）ofgrossarea.

Thisrentshallbefixedforyear（s）/month（s）andfromtheyear/month,itmayadjustedbybothpartieshereinthroughnegotiation,whichisstipulatedintheSupplementaryProvisions.

甲、乙双方约定，该房屋每月租金为（币）_________元。

乙方应于每月日前向甲方支付租金。

逾期支付的，则乙方需按月租金的％支付违约金。

Article5DepositandMiscellaneousCharges保证金和其他费用

5-1ItisagreedthatPartyBshallpayRMB（USD）,whichisequaltotherentformonth（s）,asadeposittoPartyAbeforethedateof.

PartyAshallmakeoutareceiptinwrittenafterreceivingtheforesaidamount.

Upontheexpirationofthislease,afterdeductingthefees,whichshallbeundertakenbyPartyB,fromthedeposit,PartyAshallreturntheresttoPartyBwithoutanyinterests.

甲、乙双方约定，甲方交付该房屋时，乙方应向甲方支付房屋租赁保证金，保证金为个月的租金，即（币）元。

甲方收取保证金后应向乙方开具收款凭证。

租赁关系终止时，甲方收取的房屋租赁保证金除用以抵充合同约定由乙方承担的费用外，剩余部分无息归还乙方。

5-2Duringtheperiodofthelease,allchargesforuseofwater,electricity,gas,telecommunication,equipments,propertymanagementandshallbepaidbyParty.Partyshallpayotherchargesexcepttheabove-mentionedcharges.

租赁期间，使用该房屋所发生的水、电、煤气、通讯、设备等费用由（甲方/乙方）承担。

其他有关费用，均由（甲方/乙方）承担。

5-3ThechargesundertakenbyPartyshallbepaidinfollowingmanners:

Article6RequirementforUsethePremiseandMaintenanceofthePremise房屋使用要求和维修责任

6-1Intheeventofanydamageorfaultoftherentedpremises,PartyBshallinformPartyAofitintime.Themaintenance,shallbecarriedbyPartyAwithindaysafterreceivingthepromptlynoticefromPartyBonsuchdamageorfault..

租赁期间，乙方发现该房屋及其附属设施有损坏或故障时，应及时通知甲方修复；甲方应在接到乙方通知后的日内进行维修。

6-2Duringthelease,PartyBshallproperlyoccupythePremisesandtakegoodcareofthefacilities.AnyconsequencesduetoPartyB’simproperoperationorneglectshallbeundertakenbyPartyB.IfPartyBrefusestodoit,PartyAmaydothemaintainsforit.TheexpensesarisingfromsuchmaintainsshallbepaidbyPartyB.

租赁期间，乙方应合理使用并爱护该房屋及其附属设施。

因乙方使用不当或不合理使用，致使该房屋及其附属设施损坏或发生故障的，乙方应负责维修。

乙方拒不维修，甲方可代为维修，费用由乙方承担。

6-3Duringthelease,PartyAshallguaranteethesafetyinuseofthePremises.IntheeventPartyAintendstoinspectandmaintainthePremises,heshallnotifyPartyBdaysaheadoftime.PartyBshallcooperateandassistasbestaspossiblewhilePartyAismaintainingthePremises.Meanwhile,PartyAshallreducetheeffectonusingthePremisesofPartyB.

租赁期间，甲方保证该房屋及其附属设施处于正常的可使用和安全的状态。

甲方对该房屋进行检查、养护，应提前日通知乙方。

检查养护时，乙方应予以配合。

甲方应减少对乙方使用该房屋的影响。

6-4ExceptforthestipulationinAnnexIII,IfPartyBintendstoredecoratethePremisesorreplacestheexistingfacilities;awrittenapprovalshallbeobtainedinadvancefromPartyA.Ifrequiredbyapplicablebylaworregulations,PartyAshall（or:

PartyAshallentrustPartyBto）alsocompletecertainregistrationprocedureatrelevantgovernmentofficesbeforetheconstructionstarts.

除本合同附件（三）外，乙方另需装修或者增设附属设施和设备的，应事先征得甲方的书面同意，按规定向有关部门审批的，则还由（甲方/甲方委托乙方）报有关部门批准后，方可进行。

乙方增设的附属设施和设备及其维修责任于甲、乙双方另行书面约定。

Article7ConditionWhenthePremiseReturned房屋返还时的状态

7-1ExceptPartyAapprovetheapplicationforextendingtheleasefromPartyB,PartyBshallreturnthePremiseswithindaysaftertheexpirationofthislease.AnydelayofthedeliveryofthePremisesmadebyPartyBshallbechargedRMB（USD）perdayasaHouseOccupationFeetoPartyA.

除甲方同意乙方续租外，乙方应在本合同的租期届满后的_________日内返还该房屋，未经甲方同意逾期返还房屋的，每逾期一日，乙方应按元/（人民/美金币）向甲方支付该房屋占用期间的使用费。

7-2TheconditionofthePremiseswhenPartyBreturnsittoPartyAshallaccordwiththeonethatisafternormalusing.ThereturnofthePremisesshallbeexaminedandconfirmedbyPartyA.Meanwhile,bothpartiesshallsquareupthechargeswitheachother.

乙方返还该房屋应当符合正常使用后的状态。

返还时，应经甲方验收认可，并相互结清各自应当承担的费用。

Article8Sublet,LeaseTransfer,andExchange转租、转让和交换

8-1UnlessotherwisestatedinSupplementaryProvisions,PartyBmayonlytransferpartorallofthePremisestoathirdpartyduringtheleaseuponthewrittenapprovalofPartyA.However,PartyBshallnotsubletpartoftheroomofthePremisestoathirdpartyorsublettheroomtotwoormorethantwolesseesatthesametimeforresidentialpurpose.

除甲方已在本合同补充条款中同意乙方转租外，乙方在租赁期内，需事先征得甲方的书面同意，方可将该房屋部分或全部转租给他人。

但同一间居住房屋，不得分割转租。

8-2IncasethatPartyBsubletsthePremises,theSubletContractshallbeconcludedwiththesub-lesseeandberegisteredintheRealEstateTransanctionCenterofthedistrictwherethePremisesislocated.

乙方转租该房屋，应按规定与受租方订立书面的转租合同。

并按规定向该房屋所在区、县房地产交易中心或农场系统受理处办理登记备案。

8-3Duringtheleaseterm,PartyBmay,throughalegalcontractonsubjectalteration,transferthisleasetoathirdpartyorexchangethePremiseswithathirdpartywhoisthelesseeofanotherpremisesuponthewrittenapprovalofPartyA.

在租赁期内，乙方将该房屋转让给他人承租或与他人承租的房屋进行交换，必须事先征得甲方书面同意。

转让或交换后，该房屋承租权的受让人或交换人应与甲方签订租赁主体变更合同并继续履行本合同。

8-4Duringtheleaseterm,wherePartyAintendstoofferforsalethePremises,heshallinformPartyBofitwithapriornoticeofthreemonths,andPartyBhasapriorityrighttopurchasethePremisesonequalterms.

在租赁期内，甲方如需出售该房屋，应提前三个月通知乙方。

乙方在同等条件下有优先购买权。

Article9Dissolution合同的解除

9-1Duringthelease,thiscontractmaybeterminatedunderthefollowingcondition,andbothpartiesshallbeexcusedfromliability:

1）ForceMajeure;

2）ThePremisesisdamaged,lostandappraisedtobethedangeroushouse;

3）ThePremisesonwhichPartyAcreatedamortgageisbeinghandled

甲、乙双方同意在租赁期内，有下列情形之一的，本合同终止，双方互不承担责任：

（一）因不可抗力致使合同无法履行的；

（二）该房屋毁损、灭失或者被鉴定为危险房屋的；

（三）甲方已告知乙方该房屋出租前已设定抵押，现被处分的。

9-2Underthefollowingconditions,onepartyshallnotifytheotherpartytodissolvethiscontractinwritingform.Thebreachingpartyshallpayapenaltyat________ofthemonthlyrenthereintotheotherparty.IfthepenaltyisinsufficienttocoverthelosssufferedbyPartyB,PartyAshallpaythedifference:

（1）PartyAdelaysthedeliveryofthePremises,andafterbeingcalledontoperformstheobligation,failstodosowithindaysbyPartyB;

（2）TheobjectivesofthiscontractcannotberealizedduetotheconditionofthePremises

deliveredbyPartyAdoesnotaccordwiththestipulationfthiscontract.

（3）ThePremisesisdamagedbecausePartyBalterstheuseof
