工伤保险条例（英文版）

RegulationonWork-RelatedInjuryInsurances

（DecreeNo.375oftheStateCouncilofthePeople'sRepublicofChina）

The"RegulationonWork-RelatedInjuryInsurances",whichwasdeliberatedandadoptedatthe5thexecutivemeetingoftheStateCouncilonApril16,2003,isherebypromulgated,andshallcomeintoforceonJanuary1,2004.

PARTONE　GENERALPROVISIONS

Article1　TheseRegulationsareformulatedinordertoguaranteeavailabilityofmedicaltreatmentandeconomiccompensationtostaffandworkersthatsufferfromwork-relatedaccidentalinjury or occupationaldisease，topromotepreventionofwork-relatedinjuryandvocationalrehabilitation，andtodistributework-relatedinjuryrisksofemployers.

Article2　Alltypesofenterprisesandsoletradersthathireworkers（Employer（s））shallparticipateinwork-relatedinjuryinsuranceandpaywork-relatedinjuryinsurancepremiumsforallofthestaffandworkers or hiredworkersintheirworkunit（Employee（s））inaccordancewiththeprovisionshereof.

TheEmployeesofalltypesofenterprisesandthehiredworkersofsoletradersinthePeople'sRepublicofChinashallhavetherighttoenjoythebenefitsofwork-relatedinjuryinsuranceinaccordancewiththeprovisionshereof.

Thespecificstepsandimplementingproceduresforparticipationofsoletradersthathireworkersinwork-relatedinjuryinsuranceshallbestipulatedbythepeople'sgovernmentsofprovinces，autonomousregionsandmunicipalitiesdirectlyunderthecentralgovernment.

Article3　Collectionandpaymentofwork-relatedinjuryinsurancepremiumsshallbecarriedoutinaccordancewiththeprovisionsintheCollectionandPaymentofSocialInsurancePremiumsTentativeRegulationsregardingcollectionandpaymentofbasicoldageinsurancepremiums，basicmedicalinsurancepremiumsandunemploymentinsurancepremiums.

Article4　AnEmployershallannouncewithintheworkunittherelevantdetailsofitsparticipationinwork-relatedinjuryinsurance.

AnEmployeranditsEmployeesshallabidebythelawsandregulationsregardingsafeproductionandpreventionandtreatmentofoccupationaldiseases，implementsafetyandhealthregulationsandstandards，preventoccurrenceofwork-relatedinjuryaccidentsandavoidandmitigatetheharmsofoccupationaldiseases.

IfanEmployeesuffersfromwork-relatedinjury，theEmployershalladoptmeasurestoensurethatsuchEmployeereceivestimelyrescueandtreatment.

Article5　TheadministrativedepartmentoflaboursecurityoftheStateCouncilshallbeinchargeoftheworkofwork-relatedinjuryinsurancethroughoutthecountry.

Theadministrativedepartmentsoflaboursecurityofalllevelsoflocalpeople'sgovernmentsatthecountylevelandaboveshallbeinchargeofwork-relatedinjuryinsuranceworkwithintheirrespectiveadministrativeareas.

ThesocialinsuranceagenciesestablishedbytheadministrativedepartmentsoflaboursecurityinaccordancewithrelevantprovisionsoftheStateCouncil（Agency/Agencies）shallundertakethepracticalaffairsofwork-relatedinjuryinsurance.

Article6　AdministrativedepartmentsoflaboursecurityandotherdepartmentsshallseektheopinionoftradeunionsandrepresentativesofEmployerswhenformulatingpoliciesandstandardsforwork-relatedinjuryinsurance.

PARTTWO　WORK-RELATEDINJURYINSURANCEFUNDS

Article7　Work-relatedinjuryinsurancefundsshallbecomposedofwork-relatedinjuryinsurancepremiumspaidbyEmployers，interestonwork-relatedinjuryinsurancefundsandotherfundspaidintothework-relatedinjuryinsurancefundsinaccordancewithlaw.

Article8　Thepremiumrateforwork-relatedinjuryinsuranceshallbedeterminedontheprinciplesthatreceiptbedeterminedonthebasisofpaymentandthatreceiptandpaymentbebalanced.

TheStateshalldeterminepremiumratedifferentialsbetweenindustriesaccordingtothedegreeofrisksofwork-relatedinjuriesindifferentindustries，andshalldetermineseveraltiersofpremiumrateswithineachindustryaccordingtocircumstancessuchastheuseofwork-relatedinjuryinsurancepremiumsandthefrequencyofoccurrenceofwork-relatedinjuries.Inter-industrypremiumratedifferentialsandintra-industrypremiumratetiersshallbeformulatedbytheadministrativedepartmentoflaboursecurityoftheStateCouncilinconjunctionwiththefinancedepartment，healthadministrativedepartmentandsafeproductionregulatorydepartmentoftheStateCouncil，andshallbepromulgatedandimplementeduponapprovalbytheStateCouncil.

TheAgencyforapoolingregionshalldeterminetheworkunitpayablepremiumrateforanEmployeronthebasisofsuchcircumstancessuchasuseofwork-relatedinjuryinsurancepremiumsandfrequencyofoccurrenceofwork-relatedinjuriesoftheEmployer，andthecorrespondingpremiumratetierapplicabletotheindustrytowhichtheEmployerbelongs.

Article9　TheadministrativedepartmentoflaboursecurityoftheStateCouncilshallperiodicallyobtainthedetailsofreceiptandpaymentofwork-relatedinjuryinsurancefundsofallpoolingregionsthroughoutthecountry，andshallproposeadjustmenttotheinter-industrypremiumratedifferentialsandtheintra-industrypremiumratetiersinatimelymannerandinconjunctionwiththefinancedepartment，healthadministrativedepartmentandsafeproductionregulatorydepartmentoftheStateCouncil.SuchadjustmentshallbepromulgatedandimplementeduponapprovalbytheStateCouncil.

Article10　Employersshallpaywork-relatedinjuryinsurancepremiumsontime.Employeesshallnotpaywork-relatedinjuryinsurancepremiumsthemselves.

Theamountofwork-relatedinjuryinsurancepremiumpayablebyanEmployershallbetheproductofthetotalpayrolloftheEmployeesoftheworkunitandtheworkunitpayablepremiumrate.

Article11　Work-relatedinjuryinsurancefundsinmunicipalitiesdirectlyunderthecentralgovernmentandmunicipalitieshavingdistrictsshallbepooledonamunicipality-widebasis.Thelevelofpoolinginotherregionsshallbedeterminedbythepeople'sgovernmentoftheprovince or autonomousregion.

Aninter-regionindustry or anindustrywitharelativelyhighlevelofproductionmobilitymayparticipatefromanotherregioninwork-relatedinjuryinsuranceinapoolingregionbyadoptingamethodofrelativeconcentration.ThespecificproceduresshallbeformulatedbytheadministrativedepartmentoflaboursecurityoftheStateCouncilinconjunctionwiththedepartmentinchargeoftherelevantindustry.

Article12　Work-relatedinjuryinsurancefundsshallbedepositedintoadedicatedfinanceaccountforsocialsecurityfundsforbenefitsofwork-relatedinjuryinsurance，assessmentofworkcapabilityandpaymentofotherexpensesforwork-relatedinjuryinsurancestipulatedherein.Noworkunit or individualmayusethework-relatedinjuryinsurancefundsforinvestmentandoperation，construction or renovationofofficesite，distributionofbonuses， or divertsuchfundstootheruses.

Article13　Acertainratioofwork-relatedinjuryinsurancefundsshallbemaintainedasreservesforpaymentofwork-relatedinjuryinsurancebenefitsintheeventofmajoraccidentsinthepoolingregion.Incaseofashortageofreserves，thepeople'sgovernmentofthepoolingregionshalladvancethepayment.Thespecificratioofreservestothetotalamountoffundsandtheproceduresfortheuseofreservesshallbestipulatedbythepeople'sgovernmentsofprovinces，autonomousregions or municipalitiesdirectlyunderthecentralgovernment.

PARTTHREE　DETERMINATIONOFWORK-RELATEDINJURY

Article14　AnEmployeeshallbedeterminedashavingawork-relatedinjuryif：

1.heisinjuredinanaccidentatworkduringworkinghoursintheworkplace；

2.heisinjuredinanaccidentwhileengaginginpreparatory or finishing-upworkrelatedtoworkbefore or afterworkinghoursintheworkplace；

3.heisinjuredbyviolence or inotheraccidentinhisperformanceofjobdutiesduringworkinghoursintheworkplace；

4.hesuffersfromanoccupationaldisease；

5.heisinjuredatwork or hiswhereaboutsbecameunknowninanaccident，duringwork-relatedtravel；

6.heisinjuredinamotorvehicleaccidentwhilegoingto or returningfromwork；or

7.heisinothercircumstancesthatshallbedeterminedaswork-relatedinjuryaccordingtotheprovisionsoflawsandadministrativeregulations.

Article15　AnEmployeeshallbedeemedashavingawork-relatedinjuryif：

1.hediesimmediately or within48hoursafteremergencytreatmentforadiseasesuddenlyarisingduringworkinghoursintheworkplace；

2.heisinjuredinanacttoprotectnationalinterests or publicinterestssuchasemergencyrescueanddisasterrelief；or

3.heisinjuredanddisabledinwar or ondutywhileinmilitaryserviceandhasobtainedarevolutionaryinjuredanddisabledsoldiercertificate，andsuffersfromarelapseoftheoldinjurywhilebeingemployedbytheEmployer.

WhereanEmployeeisinthecircumstanceofItem

（1） or 

（2）oftheprecedingparagraph，heshallbeentitledtowork-relatedinjuryinsurancebenefitsinaccordancewiththerelevantprovisionshereof.WhereanEmployeeisinthecircumstanceofItem（3）oftheprecedingparagraph，heshallbeentitledtowork-relatedinjuryinsurancebenefitsotherthanthelumpsumdisabilityallowanceinaccordancewiththerelevantprovisionshereof.

Article16　AnEmployeeshallnotbedetermined or deemedashavingwork-relatedinjuryif：

1.heisinjured or hediesasaresultofcommissionofcrime or violationofpublicsecurityadministration；

2.heisinjured or hediesasaresultofintoxication；or

3.heinflictsharmonhimself or commitssuicide.
