ChapterIGeneralRules

（Purpose）

Article1ThepurposeofthisActistoprovideforthequalificationsofcertifiedsocialworkersandcertifiedcareworkersandtopromotetheappropriatenessoftheirservices,therebycontributingtotheenhancementofsocialwelfare.

（Definition）

Article2

（1）Theterm"certifiedsocialworker"asusedinthisActmeansapersonwithexpertknowledgeandskillswhohasreceivedtheregistrationprovidedinArticle28andusestheappellation"certifiedsocialworker"toprovideadvice,guidance,orwelfareservicesinconsultationsaboutthewelfareofpersonswithphysicaldisabilitiesormentaldisorderandintellectualdisabilitiesorpersonsfacingdifficultyinleadinganormallifeduetoenvironmentalfactors,andapersonengagedinthebusinessofcommunicatingandcoordinatingwithandprovidingotherassistance（referredtoas"consultationandassistance"inArticle7andArticle47-2）todoctors,otherhealthandmedicalserviceproviders,andotherrelatedparties（referredtoas"personsconcernedwithwelfareservices,etc."inArticle47）.

（2）Theterm"certifiedcareworker"asusedinthisActmeansapersonwithexpertskillsandknowledgewhohasreceivedtheregistrationprovidedinparagraph

（1）,Article42,andusestheappellation"certifiedcareworker"toengageinthebusinessofprovidingcareforapersonwithphysicaldisabilitiesormentaldisorderandintellectualdisabilitiesthatmakeitdifficulttoleadanormallife（includingmucusaspiration,andotherconductthatisnecessaryfortheeverydaylifeoftheperson,exercisedunderthedirectionofamedicaldoctor（limitedtotheservicesprovidedforinOrdinanceoftheMinistryofHealth,LabourandWelfare;hereafterreferredtoas"mucusaspiration,etc."）,andprovidinginstructionsoncaregiving（hereafterreferredtoas"caregiving,etc."）tothepersonandtheperson'scaregiver.

（Disqualification）

Article3Apersonwhofallsunderanyofthefollowingitemscannotbequalifiedtobeacertifiedsocialworkeroracertifiedcareworker:

（i）anadultwardorapersonsubjecttoaconservatorshiporcuratorship;

（ii）apersonwhohasbeensentencedtoimprisonmentwithoutworkoraheavierpunishment,andforwhomtwoyearshavenotyetpassedsincethedateonwhichthepersonfinishedservingthesentenceortobesubjecttoitsenforcement;

（iii）apersonwhoissentencedtoafinepursuanttotheprovisionsofthisActorotherprovisionsofactsconcerningsocialwelfareorhealthandmedicalcareandprovidedforbyaCabinetOrder,andtowhomtwoyearshavenotyetpassedsincethedateonwhichthepersonfinishedservingthesentenceortobesubjecttoitsenforcement;

（iv）apersonwhoseregistrationhasbeencancelledpursuanttotheprovisionofitem（ii）,paragraph

（1）,orparagraph

（2）,Article32（includingcasesinwhichtheseprovisionsapplymutatismutandispursuanttoparagraph

（2）,Article42）,andtowhomtwoyearshavenotyetpassedsincethedateofthecancellation.

ChapterIICertifiedSocialWorker

（QualificationofCertifiedSocialWorker）

Article4Apersonwhohaspassedthecertifiedsocialworkerexaminationisqualifiedtobeacertifiedsocialworker.

（CertifiedSocialWorkerExamination）

Article5Thecertifiedsocialworkerexaminationisimplementedontheknowledgeandskillsthatarerequiredofacertifiedsocialworker.

（ImplementationofCertifiedCareWorkerExamination）

Article6TheMinisterofHealth,LabourandWelfareholdsthecertifiedsocialworkerexaminationatleastonceayear.

（QualificationofCandidateforExamination）

Article7Onlyapersonwhofallsunderanyofthefollowingitemscanbequalifiedtoapplyforthecertifiedsocialworkerexamination:

（i）apersonwhohasgraduateduponcompletingstudyofthesubjectsconcerningsocialwelfareprovidedforinOrdinanceoftheMinistryofEducation,Culture,Sports,ScienceandTechnologyandOrdinanceoftheMinistryofHealth,LabourandWelfare（hereafterreferredtoasthe"coresubjects"inthisArticle）atauniversity（excludingajuniorcollege;thesameapplieshereafterinthisArticle）basedontheSchoolEducationAct（ActNo.26of1947）,orapersonwhoisprovidedforinOrdinanceoftheMinistryofHealth,LabourandWelfareasequivalentthereto;

（ii）apersonwhohasgraduateduponcompletingthebasicsubjectsconcerningsocialwelfareprovidedforinOrdinanceoftheMinistryofEducation,Culture,Sports,ScienceandTechnologyandOrdinanceoftheMinistryofHealth,LabourandWelfare（hereafterreferredtoasthe"basicsubjects"inthisArticle）atauniversitybasedontheSchoolEducationAct,orapersonwhoisprovidedforinOrdinanceoftheMinistryofHealth,LabourandWelfareasequivalenttheretoandhasacquiredtheknowledgeandskillsrequiredofacertifiedsocialworkerataschooldesignatedbytheMinisterofEducation,Culture,Sports,ScienceandTechnologyandtheMinisterofHealth,LabourandWelfareoratrainingfacilitydesignatedbyaprefecturalgovernor（hereafterreferredtoasa"certifiedsocialworkershort-termtrainingfacility,etc."）duringaperiodofsixmonthsorlonger;

（iii）apersonwhohasgraduatedfromauniversitybasedontheSchoolEducationAct,andapersonwhoisprovidedforinOrdinanceoftheMinistryofHealth,LabourandWelfareasequivalenttheretoandhasacquiredtheknowledgeandskillsrequiredofacertifiedsocialworkerataschooldesignatedbytheMinisterofEducation,Culture,Sports,ScienceandTechnologyandtheMinisterofHealth,LabourandWelfareoratrainingfacilitydesignatedbyaprefecturalgovernor（hereafterreferredtoasa"certifiedsocialworkergeneraltrainingfacility,etc."）duringaperiodofoneyearorlonger;

（iv）apersonwhohasgraduateduponcompletingthecoresubjectsatajuniorcollegebasedontheSchoolEducationAct（limitedtoonehavingathree-yeartermofstudy）（excludingapersonwhohasgraduatedfromanight-classcourseoracorrespondencecourse）,orapersonwhoisprovidedforinOrdinanceoftheMinistryofHealth,LabourandWelfareasequivalenttheretoandhasbeenengagedintheservicesofconsultationandassistanceatafacilitydesignatedbyOrdinanceoftheMinistryofHealth,LabourandWelfare（hereafterreferredtoasa"designatedfacility"inthisArticle）foroneyearorlonger;

（v）apersonwhohasgraduateduponcompletingthebasicsubjectsatajuniorcollegebasedontheSchoolEducationAct（limitedtoonehavingathree-yeartermofstudy）（excludingapersonwhohasgraduatedfromanight-classcourseoracorrespondencecourse）,orapersonwhoisprovidedforinOrdinanceoftheMinistryofHealth,LabourandWelfareasequivalenttheretoand,afterengagingintheservicesofconsultationandassistanceforoneyearorlonger,hasacquiredtheknowledgeandskillsrequiredofacertifiedsocialworkeratasocialwelfareshort-termtrainingfacility,etc.asacertifiedsocialworkerduringaperiodofsixmonthsorlonger;

（vi）apersonwhohasgraduateduponcompletingthedesignatedsubjectsatajuniorcollegebasedontheSchoolEducationAct（limitedtoonehavingathree-yeartermofstudy）（excludingapersonwhohasgraduatedfromanight-classcourseoracorrespondencecourse）,orapersonwhoisprovidedforinOrdinanceoftheMinistryofHealth,LabourandWelfareasequivalenttheretoand,afterengagingintheservicesofconsultationandassistanceforoneyearorlonger,hasacquiredtheknowledgeandskillsrequiredofacertifiedsocialworkeratasocialwelfaregeneraltrainingfacility,etc.asacertifiedsocialworkerduringaperiodofoneyearorlonger;

（vii）apersonwhohasgraduateduponcompletingthecoresubjectsatajuniorcollegebasedontheSchoolEducationActorapersonwhoisprovidedforinOrdinanceoftheMinistryofHealth,LabourandWelfareasequivalenttheretoandhasbeenengagedintheservicesofconsultationandassistanceatadesignatedfacilityfortwoyearsorlonger;

（viii）apersonwhohasgraduateduponcompletingthebasicsubjectsatajuniorcollegebasedontheSchoolEducationAct,orapersonwhoisprovidedforinOrdinanceoftheMinistryofHealth,LabourandWelfareasequivalenttheretoand,afterengagingintheservicesofconsultationandassistanceatadesignatedfacilityfortwoyearsorlonger,hasacquiredtheknowledgeandskillsrequiredofacertifiedsocialworkeratasocialwelfareshort-termtrainingfacility,etc.duringaperiodofsixmonthsorlonger;

（ix）apersonwhohascompletedacourseatatraininginstitutionprovidedforinitem（ii）,paragraph

（1）,Article19oftheSocialWelfareAct（ActNo.45of1951）and,afterengagingintheservicesofconsultationandassistanceatadesignatedfacilityfortwoyearsorlonger,hasacquiredtheknowledgeandskillsrequiredofacertifiedsocialworkeratasocialwelfareshort-termtrainingfacility,etc.duringaperiodofsixmonthsorlonger;

（x）apersonwhohasgraduatedfromajuniorcollegeoratechnicalcollegebasedontheSchoolEducationAct,orapersonwhoisprovidedforinOrdinanceoftheMinistryofHealth,LabourandWelfareasequivalenttheretoand,afterengagingintheservicesofconsultationandassistancefortwoyearsorlonger,hasacquiredthekno
