依据国家相关法律、法规和本市相关要求,甲、乙双方在平等自愿基础上,经友好协商,就甲方将其正当拥有房屋出租给乙方使用,乙方承租使用甲方房屋事宜,签订本协议。

1、房屋地址locationofthepremises

甲方将其全部位于房屋及其隶属设施在良好状态下出租给乙方作_______使用。

4、租金rental

1）、金额:

5、押金deposit

2）、除协议另有约定外,甲方应于租赁关系解除或者在协议解除日且乙方点清并付清全部应付费用后搬出当日将押金全额无息退还乙方。

3）、因乙方违反本协议要求而产生违约金、损坏赔偿金和其它相关费用,甲方可在押金中抵扣,不足部分乙方必需在接到甲方付款通知后十日内补足。

4）、因甲方原因造成乙方无法在租赁期内正常租用该物业,甲方应立刻全额无息退还押金给乙方,且乙方有权追究甲方违约责任。

而且甲方需要合适支付乙方必需损失。

ifpartybcan’tnormallyusetheapartmentbecauseofpartya,partyashouldreturnthedeposittopartybatonce.and,partyashouldpaythereasonablecompensationrequiredbypartyb.

6、甲方义务obligationsofpartya

.1）、甲方须按时将房屋及隶属设施（详见附件）交付乙方使用。

partyawillprovidethepremisesandattachedfacilities（seetheappendixoffurniturelistfordetail）onscheduletopartybforusing.

2）、房屋设施如因质量原因、自然损耗、不可抗力或意外事件而受到损坏,甲方有修缮并负担相关费用责任。

如甲方未在两周内修复该损坏物,以致乙方无法正常使用房屋设施,乙方有权终止该合约,并要求退还押金。

incasethepremiseandattachedfacilitiesaredamagedbyqualityproblems,naturaldamagesoraccidents,partyawillberesponsibletorepairandpaytherelevantexpenses.ifpartyacan’trepairthedamagedfacilitiesintwoweekssothatpartybcan’tusethefacilitiesnormally,partybhastherighttoterminatethecontractandpartyamustreturnthedeposit.

3）、甲方应确保出租房屋享受出租权利,如租赁期内该房屋发生全部权全部或部分转移、设定她项物权或其她影响乙方权益事件,甲方应确保全部权人、她项权利人或其她影响乙方权益第三者能继续遵守本协议全部条款,反之如乙方权益所以遭受损害,甲方应负赔偿责任。

partyawillguaranteetheleaserightofthepremises.incaseofoccurrenceofownershiptransferinwholeorinpartandotheraccidentsaffectingtherightofleasebypartyb,partyashallguaranteethatthenewownerandotherassociated,thirdpartiesshallbeboundbythetermsofthis

contract.otherwise,partyawillberesponsibletocompensatepartyb’slosses.

7、乙方义务obligationsofpartyb

1）、乙方应按协议要求按时支付租金及押金。

partybwillpaytherentalandthedepositontime.

2）、乙方经甲方同意,可在房屋内添置设备。

租赁期满后,乙方将添置设备搬走,并确保不影响房屋完好及正常使用。

partybmayaddnewfacilitieswithpartya’sapproval.whenthiscontractexpires,partybmaytakeawaytheaddedfacilitieswithoutchangingthegoodconditionsofthepremisesfornormaluse.

3）、未经甲方同意,乙方不得将承租房屋转租或分租。

partybwillnottransfertheleaseofthepremisesorsubwithoutpartya’sapproval.

4）、乙方应按本协议要求正当使用该房屋,不得私自改变使用性质。

乙方不得在该房屋内存放危险物品。

不然,如该房屋及隶属设施所以受损,乙方应负担全部责任。

partybwillusethepremiseslawfullyaccordingtothiscontractwithoutchangingthenatureofthepremisesandstoringhazardousmaterialsinit.otherwise,partybwillberesponsibleforthedamagescausedbyit.

5）、乙方应负担租赁期内水、电、煤气、电话费、宽带费、物业管理费和电视费等一切因实际使用而产生费用,并按单准期缴纳。

partybwillbearthecostofutilitiessuchastelephonecommunications,water,electricity,gas,managementfees,internetandcabletelevisionontimeduringtheleaseterm.

6）、乙方应珍惜租用房屋及其设备,严格按专门使用要求使用,如因乙方人为使用不妥而造成损坏,乙方负责赔偿及修复费用,乙方必需做到:

partybmusttakecareofthepropertyanditscontents,andusethemexactlyaccordingtothespecificinstructions;otherwisepartybshouldpayforthecompensationandrepairingfeestopartyaforitsimproperuseoftheproperty.partybmustdoasfollows:

6.1足够常常清洁房屋,复合地板、木地板、地毯、瓷砖地面要按不一样要求清洁;

doregularlycleanthehouse.cleanthelaminatefloor,theparquetfloor,thecarpet,andthetilecorrectlyaccordingtothespecificinstructions.

6.2足够常常通风、开足空调（尤其是在雨季、冬天）以避免冷凝水损坏房屋,造成霉变;doregularlyopenthewindowandventilatewiththeairconditioner（especiallyinrainyseasonandwinter）inthehouse,inordertopreventthecondensationwaterfromdamagingthehouseandgoingmouldy.

6.3足够常常清洁厨房、炉灶等电器;

keepthekitchenclean,suchaselectricapparatuses.

6.4浴缸、冲淋房、洗菜盆排水口必需使用专门滤网阻止头发、硬物等进入排污管,抽水马桶内不能倒其它杂物进入,疏通下水道费用由乙方负担。

6.5日常损耗物品及维修由乙方负担更换费用（比如挂取窗帘、疏通下水道、换灯泡等）thenormalwear＆tearfeesofthepropertyshallbebornebypartyb（suchashangingandfetchingcurtains,unchokingthesewer,changingthebulbetc）.

7）、乙方如长久或常常不在,乙方必需安排人员看管房屋,刮风下雨时关好门窗,常常通风、开足空调,还必需确保甲方及代理人能立刻实施紧急和必需维修修复工作,不然,造成损失由乙方负责。

ifpartybisoutregularlyorforalongtime,partybmustarrangesomeonetolookaftertheleasedproperty.makesurethedoorsandthewindowsareclosedwhenblowingandraining,oftenventilatethehouse,runtheairconditioner,andguaranteeforpartyaandtheagenttomakeimplementurgentandessentialmaintenance.otherwise,thelossescausedshouldbebornebypartyb.

8.中介方义务:

obligationsofintermediary

1）督促双方提供必需证实文件,对出租方而言,需提供房产证（或者相关证实性文件）及身份证复印件;对承租方而言,需提供身份证复印件或企业营业执照复印件。

supervisionbothsidesprovidetheessentialproofdocument,speakingofhirestheside,mustprovidetherealestatepropertycard（orcorrelationcertificatedocument）andthestatuscardduplicatepresswork;speakingofrentstheside,mustprovidethestatuscardduplicatepressworkorthecompanydoesbusinessthelicenseduplicatepresswork.

9.协议终止及解除要求terminationanddissolutionoftheindenture

1）、乙方在租赁期满后如需续租,应提前一个月通知甲方,由双方另行协商续租事宜。

在相同条件下乙方享受优先续租权。

在协议期内,甲乙双方均不得私自解除协议,如一方因故需解除合约,需提前一个月向另一方以书面形式提出终止请求,并赔偿另一方相当于一个月租金违约金。

如甲方提出终止请求,应退回剩下房屋租金给乙方。

withinonemonthbeforethecontractexpires,partybwillnotifypartyaifitintendstoextendthelease.inthissituation,twopartieswilldiscussmattersovertheextension.underthesametermspartybhastheprioritytoleasethepremises.incontractperiod,bothpartyaandpatybcannotreliefthiscontractwithoutauthorization,ifanyonepartyneedstocancelthiscontract,thispartymustnotifyanotherpartybywritingatleastonemonthbeforetheintendedtermination,andthispartymustpayonemonthsrenttoanotherpartyascompensation.ifpartyaneedscancelthiscontract,partyamustreturnsurplusrentwhichpartyawasreceivedtopartyb.

2）、本协议一经双方签字后立刻生效;未经双方同意,不得任意终止,如有未尽事宜,甲、乙双方可另行协商。

thiscontractwillbeeffectiveafterbeingsignedbybothparties.anypartyhasnorighttoterminatethiscontractwithoutbothparty’sagreement.anythingnotcoveredinthiscontractwill

bediscussedseparatelybybothparties.

10、违约及处理breachofthecontract

1）、甲、乙双方任何一方在未取得对方谅解情况下,不推行本协议要求条款,造成本协议中途终止,则视为该方违约,双方同意违约金为元整,若违约金不足填补无过失方之损失,则违约方还需就不足部分支付赔偿金。

duringtheleaseterm,anypartywhofailstofulfillanyarticleofthiscontractwithouttheotherparty’sunderstandingwillbedeemedtobreachthecontract.bothpartiesagreethatthedefaultfinewillbe.incasethedefaultfineisnotsufficienttocoverthelosssufferedbythefaultlessparty,thepartyinbreachshouldpayadditionalcompensationtotheotherparty.

2）、若双方在实施本协议或与本协议相关事宜发生争议,应首先友好协商;协商不成,可向有管辖权人民法院提起诉讼。

bothpartieswillsolvethedisputesarisingfromexecutionofthecontractorinconnectionwiththecontractthroughfriendlyconsultation.incasetheagreementcannotbereached,anypartymaysubmitthedisputetothecourtthathasthejurisdictionoverthematter.

11、其她miscellaneous

1）协议签定之日,甲方按本协议月租金100%,一次性向丙方支付中介信息服务费,即元,大写.

3）、本协议附件是本协议有效组成部分,与本协议含有相同法律效力。

4）、本协议壹式叁份,甲、乙双方及中介方各执一份。
