物权法法律英语物权法法律英语OrderofthePresidentofthePeoplesRepublicofChinaNo.62TheRealRightLawofthePeoplesRepublicofChinahasbeenadoptedatthe5thsessionoftheTenthNationalPeoplesCongressonMarch16,2007.ItisherebypromulgatedandshallgointoeffectasofOctober1,2007.PresidentofthePeoplesRepublicofChinaHuJintaoMarch16,2007RealRightLawofthePeoplesRepublicofChina(Adoptedatthe5thsessionoftheTenthNationalPeoplesCongressonMarch16,2007)ContentsPartIGeneralRulesChapterIBasicPrinciplesChapterIICreation,Alternation,AlienationandTerminationofRealRightSection1RealityRegistrationSection2ChattelDeliverySection3OtherRulesChapterIIIProtectionofRealRightPartIIOwnershipChapterIVGeneralRulesChapterVStateOwnership,CollectiveOwnershipandPrivateOwnershipChapterVIOwnersPartitionedOwnershipofBuildingAreasChapterVIINeighboringRelationshipChapterVIIICommonOwnershipChapterIXSpecialRulesonAcquiringOwnershipPartIIIUsufructuaryRightsChapterXGeneralRulesChapterXIRighttotheContractedManagementofLandChapterXIIRighttoUseConstructionLandChapterXIIIRighttoUseHouseSitesChapterXIVEasementPartIVRealRightsforSecurityChapterXVGeneralRulesChapterXVIMortgageRightSection1GeneralMortgageRightSection2MortgageRightatMaximumAmountChapterXVIIPledgeRightSection1ChattelPledgeSection2RightPledgeChapterXVIIILienPartVPossessionChapterXIXPossessionSupplementaryRulesPartIGeneralRulesChapterIBasicPrinciplesArticle1InaccordancewiththeConstitutionLaw,thepresentLawisenactedwithaviewtomaintainingthebasiceconomicsystemofthestate,protectingthesocialistmarketeconomicorder,clearlydefiningtheattributionoftheres,bringingintoplaytheutilitiesoftheresandsafeguardingtherealrightoftherightholder.Article2ThecivilrelationshipsincurredfromtheattributionandutilizationoftheresshallbegovernedbythepresentLaw.ThetermresasmentionedinthepresentLawmeansrealtiesandchattels.Whereitisprescribedinanyprovisionthatcertainrightshallbetakenasanobjectofrealright,suchprovisionshallbeapplicable.ThetermrealrightasmentionedinthepresentLawmeanstheexclusiverightofdirectcontroloveraspecificresenjoyedbytheholderinaccordancewithlaw,includingownership,usufractuaryrightandrealrightsforsecurity.Article3Intheprimaryphaseofsocialism,thestateadherestothebasiceconomicsystemwiththepublicownershipplayingadominantroleanddiverseformsofownershipdevelopingsidebyside.Thepubliceconomyshallbeconsolidatedanddevelopedbythestate,andthedevelopmentofthenonpubliceconomyshallbeencouraged,supportedandguided.Thesocialistmarketeconomysystemshallbepracticedbythestateaswellastheequallegalstatusanddevelopmentrightsofallmarketsubjectsshallbeprotected.Article4Therealrightofthestate,collective,individualoranyotherrightholdershallbeprotectedbylaw,andmaynotbedamagedbyanyentityorindividual.Article5Thevarietiesandcontentsofrealrightsshallbeprescribedbylaw.Article6Thecreation,alteration,alienationorterminationoftherealrightofarealtyshallbesubjecttoregistrationinaccordancewithlaw.Thecreationoralienationoftherealrightofachattelshallbedeliveredinaccordancewithlaw.Article7Oneshall,whenacquiringorexercisingarealright,complywiththelaw,respectsocialmoralsandmaynotinfringeuponthepublicinterestsorthelawfulrightsandinterestsofanyotherperson.Article8Incasethereexistsanyotherspecialprovisioninrespectofrealrightinanyotherlaw,suchspecialprovisionshallprevail.ChapterIICreation,Alteration,AlienationandTerminationofRealRightSection1RealityRegistrationArticle9Untilitisregisteredinaccordancewithlaw,thecreation,alteration,alienationorterminationoftherealrightofarealtyshallcomeintoeffect;unlessitisotherwiseprescribedbyanylaw,itshallhavenoeffectifitisnotregisteredinaccordancewithlaw.Asregardstheownershipofthenaturalresourcesownedbythestateinaccordancewithlaw,theregistrationisnotrequired.Article10Theregistrationofarealtyshallbehandledbytheregistrationorganatthelocalityoftherealty.Auniformregistrationsystemoverrealtiesshallbepracticedbythestate.Thescope,organandmeasuresofuniformregistrationshallbespecifiedbytherelatedlawsandadministrativeregulations.Article11Inlightofthedifferentregistrationitems,anapplicantshall,whenapplyingfortheregistrationofarealty,providetheownershipcertificateoftherealtyandsuchnecessarymaterialsasthelocationandareaoftherealty.Article12Aregistrationorganshallperformthedutiesasfollows:
(1)toexaminetheownershipcertificateandothernecessarymaterialsasprovidedbytheapplicant;
(2)toinquiretheapplicantabouttheregistrationitemsconcerned;(3)toregistertherelateditemsinaccordancewiththefactsandinatimelymanner;and(4)otherdutiesasprovidedforinanylaworadministrativeregulation.Incasetherelatedsituationoftherealtyunderapplicationforregistrationneedsfurtherproving,theregistrationorganmayrequesttheapplicanttoprovidesupplementarymaterialsandconducton-the-spotinspectionwherenecessary.Article13Noregistrationorganmaycommitanyofthebehaviorsasfollows:
(1)toaskforanevaluationofarealty;
(2)torepeatedlyregisterregistrationinthenameofannualinspection;or(3)otherbehaviorsconductedbeyonditsscopeofregistrationduties.Article14Asregardsthecreation,alteration,alienationorterminationoftherealrightofarealty,itshallgointoeffectsincethedatewhenitisrecordedintherealtyregisterincasetheregistrationthereofisrequiredbylaw.Article15Asregardsacontractenteredintobytherelatedpartiesconcernedonthecreation,alteration,alienationorterminationoftherealrightofarealty,itshallgointoeffectupontheconclusionofthecontract,unlessitisotherwiseprescribedbyanylaw;andthevalidityofthecontractisnotaffected,whethertherealrighthasbeenregisteredornot.Article16Therealtyregistershallbethebasisfordecidingtheownershipandcontentsofarealtyandshallbeunderthemanagementoftheregistrationorgan.Article17Therealtyownershipcertificateshallbetheevidencefortheholdersownershipofarealty.Theitemsrecordedintherealtyownershipcertificateshallaccordwiththoserecordedintherealtyregister;unlessitisprovedthatthereisanythingwrongintherealtyregister,theonerecordedthereinshallprevailinthecaseofanyinconsistence.Article18Anyrightholderorinterestedpartymayfileanapplicationforconsultingorcopyingtheregistrationmaterials,andtheregistrationorganmaynotreject.Article19Incaseanyrightholderorinterestedpartyholdsthatthereisanythingwronginanyitemrecordedintherealtyregister,it/hemayapplyforacorrectionoftheregistration.Theregistrationorganshallrevisetheregistrationaccordingly,incasetheholderrecordedintherealtyregisteragreestorevisetheregistrationinwrittenformorthereisevidencetoprovethattheregistrationiswrong.Theinterestedpartymayapplyfordissidenceregistration,incasetheholderrecordedintherealtyregisterdoesnotagreetothealteration.Wheretheregistrationorgangrantsthedissidenceregistrationbuttheapplicantfailstolodgeanactionwithin15daysasofthedateofdissidenceregistration,thedissidenceregistrationshallloseitseffect.Incasethedissidenceregistrationisimproperandbringintodamagestotherightholder,theholdermayrequiretheapplicanttocompensatefordamages.Article20Incasetherelatedpartiesenteredintoapurchaseagreementonapremiseortherealrightofanyotherrealty,theymayapplyforadvancenoticeregistrationtotheregistrationorgansoastoensuretherealizationoftherealrightinthefuture.Withouttheconsentoftheholderintheadvancenoticeregistration,anydisposaloftherealty,aftertheadvancenoticeregistration,maynotproduceeffectofrealright.Incasetheobligeesrightisterminatedaftertheadvancenoticeregistrationismade,ortheapplicationfortheregistrationoftherealtyisnotfiledwithin3monthsasofthedatewhenitcanberegistered,theadvancenoticeregistrationshallloseitseffect.Article21Incaseanyrelatedpartyprovidesfalsematerialsforapplyingforregistrationandcausesdamagestoanyotherperson,it/heshallassumetheliabilityforcompensation.Incaseanyregistrationorgancausesdamagestoanyotherpersonbyvirtueofanymistakeinregistration,itshallassumetheliabilityforcompensation.Theregistrationorganmay,aftermakingthecompensation,recovertheamountfromthepersonwhocausestheregistrationmistake.Article22Realtyregistrationfeesshallbechargedoneachpiece,andmaynotbechargedonthebasisofthesize,volumeorcertainproportionoftherealtysvalue.TheconcretechargingratesshallbeformulatedbytherelateddepartmentsintheStateCouncilincollaborationwiththecompetentpricingdepartment.Section2ChattelDeliveryArticle23Unlessitisotherwiseprescribedbyanylaw,thecreationoralienationoftherealrightofachattelshallcomeintoeffectupondelivery.Article24Thecreation,alteration,alienationorterminationoftherealrightofanyvessel,aircraftormotorvehicleandsoonmaynotchallengeanybonafidethirdpartyifitisnotregistered.Article25Incasetherightholderhaslegallypossessedthechattelpriortotheestablishmentoralienationofachattelsrealright,therealrigh
