Rule49Appeals

SUPREMECOURTAPPEALS

Registrystaffaretrainedtoreceiveandissuecourtdocuments;theyarenotlegallytrainedandcannotprovideindividualswithlegaladvice.

SupremeCourtCivilRule18-3andSupremeCourtFamilyRule18-3dealwithanappealtotheSupremeCourtfromaprovincialcourtoranotherstatutorybody.

Anappealfromamaster,registrarorspecialrefereeisnotsubjecttothoserulesandprocedures.ThosetypesofappealsarefiledwithintheSupremeCourtactionwheretheorderbeingappealedwasmade.SupremeCourtCivil23-6andSupremeCourtFamilyRule22-7applytoappealsfromamaster,registrarorspecialreferee.

AppealsfromadecisionofaProvincialCourtJudgeinaSmallClaimsorFamilyCourtproceedingarecoveredinCivilPracticeDirection21（StandardDirectionsforAppealsfromProvincialCourt–SmallClaimsAct）andFamilyPracticeDirection7（StandardDirectionsforAppealsfromProvincialCourt–FamilyRelationsAct）.

VariousotherprovincialenactmentsallowanappealtotheSupremeCourt.Wheretherearenoprescribedstandarddirections,ahearingisscheduledfortheconductoftheappeal.CivilForm73orFamilyFormF79isusedwhenanapplicationfordirectionsisrequired.

Thefeeforfilingtheappealis$200.00andthereisafurtherfilingfeeof$80.00atthetimeyoufilethenoticeofhearingofappeal.

Appeals

Application

（1）Ifanappealoranapplicationinthenatureofanappealfromadecision,directionororderofanypersonorbody,includingtheProvincialCourt,isauthorizedbyanenactmenttobemadetothecourtortoajudge,theappealisgovernedbythisruletotheextentthatthisruleisnotinconsistentwithanyprocedureprovidedforintheenactment.

（2）AnappealistobestartedbyfilinginaregistryanoticeofappealinForm73or74.

Directions

（3）Anoticeofappealmustinclude

（a）thestandardsetofdirections,intheformdirectedbytheChiefJustice,governingtheconductoftheappeal,or

（b）anapplicationfordirectionsastotheconductoftheappeal.

Conductofappeal

（4）Ifthenoticeofappealincludesastandardsetofdirectionsundersubrule（3）（a）,theappealmustbeconductedinaccordancewiththosedirectionsunlessthecourtotherwiseorders.

Applicationsfordirections

（5）Unlessthecourtotherwiseorders,anapplicationfordirectionsundersubrule（3）（b）mustbesetforhearingonadatethatisatleast7daysafterthedateonwhichthenoticeofappealisservedinaccordancewithsubrule（6）.

（7）Thecourtmaygivedirectionsfortheproperhearinganddeterminationofanappealand,withoutlimitingthis,maymakeanorder

（a）thatdocuments,transcriptsorminutesbeproduced,

（b）thatevidencebetenderedbywayofaffidavit,orthatitbegivenorally,

（c）thattheappealbedeterminedbywayofstatedcaseorargumentonapointoflaw,

（d）prescribingtimelimitsfortakingstepsinandforthehearingoftheappeal,or

（e）thattheappealbedisposedofsummarily,

andmayexerciseanyofthepowersofthecourtexercisableinapetitionproceeding.

（a）within7daysaftertheserviceofthenoticeofappeal,fileanoteofinterestinForm70,and
