Firesafetymanagementprescriptionforoffices,groupsandenterpriseshasbeenapprovedduringtheministers’conferenceofPublicSecurityDepartmentonOctober19,2001andbecomeseffectivefromMary1,2002.

Chapter1GeneralPrinciples

Article1Theprescriptionisstipulatedaimstostrengthenandstandardizethefiresafetymanagementofoffices,groupsandenterprises,preventfiredisasterandreducetheharmfulnessinlinewithfirepreventinglawofPeople’sRepublicofChina.

Article2Theprescriptionisapplicabletothefiresafetymanagementforoffices,groupsandenterprises（hereinafterrefertoorganizations）withinbordersofPeople’sRepublicofChina.

Exceptorganizationsspeciallyspecifiedbylawsandregulations.

Article3Organizationsshouldabidebyfirepreventinglaws,regulationsandrules（hereinafterrefertofirepreventinglaws）,implementworkingpolicyofpreventionthefirstaswellascombinationofpreventionandprotection,fulfillthefiresafetydutyandsafeguardfiresafety.

Article4Lawfulrepresentativesoflegal-personorganizationsormajorresponsiblepersonsofnon-legal-personorganizationsarefiresafetysuperintendentsandareresponsibleforfiresafetywork.

Article5Organizationsshouldimplementthesystemofjobresponsibilitygrade-by-gradeandposition-by-position,makeclearthefiresafetyresponsibilityanddeterminetheresponsibleperson.

Chapter2Firesafetyresponsibility

Article6Theresponsiblepersonsoftheorganizationshouldfulfillthefiresafetyresponsibilitieslistedbelow:

㈠Carryoutfirelaws,safeguardfiresafetyoforganizationsconformingtotheregulationandmasterthesituationoffiresafety.

㈡Overallarrangementofproduction,scientificresearch,operationandmanagementoftheorganizationaswellastheworkoffiresafety.Approveandimplementannualfirepreventingscheme.

㈢Essentialfundsandorganizationsafeguardshouldbeofferedtotheworkoffiresafety.

㈣Determinethefiresafetyresponsibilitygrade-by–grade.Approveandimplementthefiresafetysystemandsafeguardoperationrulesoffiresafety.

㈤Organizefirepreventingresearch,urgetoimplementtherectificationofhiddendangerandtimelydealwithbigproblemsinvolvedwithfiresafety.

㈥Establishprofessionalandvoluntaryfirebrigadesaccordingtofirelaws.

㈦Organizeformulatingschemesofputtingoutfireandemergencydispersingaccordingtothefactsoftheorganizationsandcarryoutpractice.

Article7Firesafetyadministratorsshouldbedeterminedaccordingtothedemand.Firesafetyadministratorsareresponsiblefortheresponsiblepersonoffiresafetyandimplementthemanagementoffiresafetyasfollows:

㈠Formulatetheannualfirepreventingscheme,organizeandimplementeverydayfiresafetymanagement.

㈡Organizeformulating,superviseandurgetoimplementthefiresafetysystemandoperationrulesthatsafeguardfiresafety.

㈢Formulatethefundsoffiresafetyworkandschemesoforganizationsafeguarding.

㈣Organizeimplementingfirepreventingresearchandrectificationofhiddendanger.

㈤Organizemaintainingthefirepreventingfacilities,fireextinguishersandsafetysignsoffirepreventing,guaranteethattheyareperfectandthesafetyexitanddispersingpassageareunblocked.

㈥Organizeandmanageprofessionalandvoluntaryfirebrigade.

㈦Developpropagandizingandtrainingaboutfirepreventingknowledgeandskillwithinstaff.Organizeimplementingandpracticingschemesofputtingoutfireandemergencydispersing.

㈧Otherfiresafetymanagementdelegatedbytheresponsiblepersonofthefiresafetyinorganizations.

Firesafetyadministratorshouldregularlyreportthesituationoffiresafetytotheresponsiblepersonandtimelyreportthebigprobleminvolvedwithfiresafety.Theresponsiblepersonoffiresafetyshouldbeinchargeoftheworkingoffiresafetymanagementintheorganizationthathasn’tfiresafetyadministrator.

Article8Organizationsthathavepropertyrightsshallofferbuildingsconformtotherequirementsoffiresafetywhencontracting,rentingordelegatingtomanageareimplemented.Makeclearthefiresafetyresponsibilitiesofallpartnersinthecontractaccordingtorelatedregulations.Fireenginepassage,dispersingfacilitiesinvolvedwithfiresafetyandotherfirepreventingfacilitiesofbuildingsshallbemanagedtogetherbyorganizationsthathavepropertyrightsororganizationsthataredelegatedtomanage.

Contractor,sub-contractorororganizationsthataredelegatedtomanageshouldabidebythisstipulationandfulfillthefiresafetyresponsibilityintherangeofmanagementandemployment.

Article9Makeclearthemanagementresponsibilityofpassage,dispersingfacilitiesinvolvedwithfiresafetyandotherfirepreventingfacilitiesofbuildingsinlightofthebuildingsthathavemorethantwoorganizationshavingpropertyrightsororganizationsforemployment.Thefacilitiesandpassagecanbedelegatedtomanagetogether.

Article10Organizationsofpropertymanagementinresidentialareashallfulfillfollowingfiresafetyresponsibilityintherangeofmanagement:

㈠Formulatefiresafetysystem,implementfiresafetyresponsibilityandcarryoutpropaganda.

㈡Carryoutfirepreventingresearchandeliminatehiddendanger.

㈢Ensurethatdispersingpassage,safetyexitandfireenginepassageareunblocked.

㈣Ensurethatpublicfacilitiesandequipmentsoffirepreventingandfiresafetysignsareperfectandeffective.

Otherorganizationsforpropertymanagementshallberesponsibleforpublicfiresafetymanagementintherangeofwhereisdelegatedtomanage.

Article11Sponsorandcontractoroflarge-scaleactivitiesthathavefiredangersuchasassembly,fireworkspartyandlanterngatheringshalldefinitethefiresafetyresponsibilitiesofallpartnersinthecontract.

Article12Unitsinchargeofconstructionareresponsibleforthefiresafetyonthesiteofconstruction.Sub-contractorshallberesponsibletothecontractorandbesubordinatedtothefiresafetymanagementofthecontractor.

Makeclearthefiresafetyresponsibilitiesbetweenorganizationstobeworkedonandunitsinchargeofconstructioninthecontractinlightoftheprojectofrebuilding,extendingandrenovatingthebuildings.

Chapter3Firesafetymanagement

Article13Followingunitswhicharekeyforfiresafetyshallbemanagedstrictlyaccordingtotherequirementsofthisstipulation:

㈠Publicassemblingplacessuchasdepartmentstores（markets）,hotels（restaurants）,stadium（gym）,hallsandpublicrecreationplaces（hereinafterrefertopublicassemblingplaces）;

㈡Hospitals,oldpeople’shomeandlodgingschools,nurseriesandkindergartens;

㈢Stateoffice;

㈣RadioandTVstation,centerofpostandtelecommunication;

㈤Stationandwharfforpassenger,civilairport;

㈥Publiclibrary,exhibitionhall,museum,archivesandculturalrelicconservationunitsthathavefiredanger;

㈦Powerplant（station）andenterprisesofelectrifiedwirenetting;

㈧Unitsforproducing,packing,storing,supplyingandsellingtheinflammableandexplosiblechemicalsubstances;

㈨Labor-concentratedenterprisesforproductionandprocessingofclothes,shoes,etc.;

㈩Significantscientificresearchorganizations;

（十一）Otherenterprisesthatprobablycatchfireandtheenterprisesmayresultinpersonaldeathandinjuryandthelossofpropertyoncehasafire.

High-levelpublicbuildingsincludinghigh-levelbusinessbuildingandapartmentbuilding,publicundergroundfacilitiessuchassubway,sightseeingtunnelandimportantundergroundtransportationtunnel,largescalewarehouseandstorageplaceforgrain,cotton,wood,generalmerchandise,etc.shallbemanagedstrictlyaccordingtotherequirementsofthestipulationforkeyunitsoffiresafetymanagement.

Article14Keyunitsforfiresafetyaswellasresponsiblepersonsandadministratorsoffiresafetyshallbereportedtoandregisteredinlocalpublicsecurityandfirepreventinginstitution.

Article15Keyunitsforfiresafetyshallsetupordeterminetheadministrationdepartmentoffiresafetyandprofessionalorvoluntaryfirepreventingmanagers.Otherunitsshalldeterminetheprofessionalandvoluntaryfirepreventingmanagersandcansetuptheadministrationdepartmentoffiresafety.Theadministrationdepartmentoffiresafetyandprofessionalorvoluntaryfirepreventingmanagersshalldevelopfire-preventingmanagementundertheleadershipoftheresponsiblepersonsoradministratorsoffiresafety.

Article16Publicassemblingplacesshallbereportedtoandresearchedbylocalpublicsecurityandfirepreventinginstitutionafterpossessingfollowingfiresafetyconditionsandcanbeputintouseafterpassingtheresearch.

㈠Handlepermittingprocedureoffirepreventingdesignforconstructionprojectbylawandpasstheacceptance.

㈡Establishandstrengthenthefiresafetyorganizationandmakecleartheresponsibility.

㈢Establishmanagementsystemoffiresafetyandsafeguardoperationrules.

㈣Employeeswhohaveundertakenfiresafetytraining.

㈤Firepreventingfacilitiesofconstructionarecomplete,perfectandeffective.

㈥Formulateschemesofputtingoutfireandemergencydispersing.

Article17Sponsorandcontractoroflarge-scaleactivitiesthathavefiredangersuchasassembly,fireworkspartyandlanterngatheringshallreporttopublicsecurityandfirepreventinginstitutiontoresearchtheactivitysite.Theseactivitiescan’tbehelduntilpassingtheresearch.
