根据《中华人民共和国合同法》、《上海市房屋租赁条例》(以下简称:
《条例》)的规定,甲、乙双方在平等、自愿、公平和诚实信用的基础上,经协商一致,就乙方承租甲方可依出租的商品房事宜,订立本合同。
InaccordancewiththeLawsofContractofthePeople’sRepublicofChinaandtheTenancyRegulationsoftheShanghaiMunicipality(hereinafterreferredtoas“theProvisions”),PartyAandPartyB,havingreachedanagreementbasedontheprinciplesofequality,willingnessandmutualbenefit,herebyenterintothisContractonmattersinrelationtotheLeaseofthePropertybyPartyAtoPartyB.
一、出租房屋情况
1.ConditionoftheLeaseorPre-LeaseProperty
1.甲方出租给乙方的房屋座落在上海市区路弄号幢2001单位(以下简称该房屋)。
建筑面积为平方米,房屋用途住宅,房屋结构为钢混。
甲方已向乙方出示:
PartyAshallleasePartyBthePropertysituatedatUnit2001,Block,Lane,Road,District(hereinafterreferredtoas“theProperty”).ThetotalgrossareaoftheLeasePropertyshallbe_squaremeters,thepurposeoftheLandshallbeforConsolidatedPurpose,thetypeofPropertyshallbeResidentialBuilding,thestructureshallbesteelandcement.ThefloorplanofthePropertyseeAppendix1ofthisContract.PartyAhasalreadypresentedtoPartyB:

3.甲方作为该房屋的房地产权利人与乙方建立租赁关系。
签订本合同前,甲方已告知乙方该房屋未设定抵押。
PartyAbeingtheOwnerofthePropertyandPartyBhavedevelopedalessor/lesseerelationship.BeforethesigningofthisContract,PartyAhasalreadyinformedPartyBthatthePropertynosubjecttoamortgage.
4.该房屋的公用或合用部位的使用范围、条件和要求;现有装修、附属设施、设备状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由甲、乙双方分别在本合同附件
(二)、(三)中加以列明。
甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。
TheareaandtheuseofthepublicorcommonpartoftheProperty;theexistingfixtures,facilities,conditionofequipmentandthecontents,standardandotherrelevantmatterstobeascertainedinrelationtothefixturesandthefacilitiesaddedbyPartyBwiththeconsentofPartyAshallbespecifiedinAppendix2,3ofthisContract.PartyAandPartyBhaveagreedthesaidAppendixshallrepresenttheconditionofthePropertyatthetimeofhandoverofthePropertybyPartyAtoPartyBandwhenPartyBdeliverupthePropertytoPartyAattheexpiryofthisContract.
二、租赁用途
2.PurposeoftheProperty
2-1乙方向甲方承诺,租赁该房屋作为住宅使用,并遵守国家和本市有关房屋使用和物业管理的规定。
PartyBwarrantstoPartyAthatthePropertyshallbeusedforResidentialpurposeandfollowstheregulationsoftheStateandthisMunicipalityinrelationtotheuseandmanagementofProperty.
2-2乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批核准前,不擅自改变上款约定的使用用途。
PartyBguaranteethatduringtheleaseterm,itshallnotalterthepurposeofthePropertywithoutPartyA‘spriorwrittenconsentaswellastheapprovalfromtherelevantgovernmentaldepartment.
三、交付日期和租赁期限
3.DeliveryDateandLeaseTerm
3-1甲乙双方约定,甲方于2009年8月28日向乙方交付该房屋。
2009年8月28日至8月31日为免租期,在此期间,乙方无须支付房屋租金,但乙方同意支付此段期间所产生的水电煤等公共事业费。

房屋租赁期为12个月,自2009年9月1日起至2010年8月31日止。
TheleasetermofthePropertyshallbefromSep1,2009toAug.31,2010.
3-2租赁期满,甲方有权收回该房屋,乙方应如期返还。
乙方需继续承租房屋的,
则应于租赁期届满前壹个月,向甲方提出续租书面要求,经甲方同意后重新签订租赁合同。
Uponexpiryoftheleaseterm,PartyAshallhavetherighttorepossessthePropertyinitsentiretyandPartyBshallreturnitaccordingly.IfPartyBwishtorenewthelease,PartyBshallsubmitsuchintentioninwrittentoPartyAonemonthspriortotheexpiryoftheleaseandsignanewleasecontractwiththeconsentofPartyA.
四、租金、支付方式和期限
4.Rent,MethodofPaymentandTerm
4-1甲、乙双方约定,月租金人民币(大写:
人民币元整)。
PartyAandPartyBhaveagreedthat,thetotalmonthlyrentalamountshallbeRMB(ChinaReminbiYuanOnly).
4-2乙方应于每三个月的1日前向甲方支付租金。
逾期支付的,每逾期一日,则乙方需按日租金的3%支付违约金。
PartyBshallpaytherentbythe1ofeverythreemonths.LatepaymentbyPartyBshallbesubjecttoapenaltyof3%ofthemonthlyrentalperday.
4-3乙方支付租金给甲方的指定帐户如下:

五、保证金和其他费用
5.DepositandOtherFeesandCharges
5-1甲、乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁保证金,保证金为贰个月的租金,即人民币(大写:
人民币元整)。
甲方收取保证金后应在十个工作日内向乙方开具收款凭证。
押金在乙方结清最后一个月水、电、煤气等其它公共事业费后并双方房屋验收后,甲方应于七个工作日内无息归还乙方,若逾期不还,甲方将承担滞纳金,须按逾期天数加付相当于租金0.2%的滞纳金。
Uponsigningthecontractbybothparties,PartyBshallpaytoPartyArentalsecuritydepositoftheProperty,thedepositshallbetwomonthsequivalenttotherental,thatisRMB(ChinaRenminbiYuanOnly).PartyAshallissueareceipttoPartyBafterreceivingpaymentofdepositwithin10workingdays.Duringtheterminationoftheleasecontract,thesecuritydepositoftheleaseforthePropertyobtainedbyPartyAshallberefundedtoPartyBaftersettingoffanyfeesorexpenseswhichisbornebyPartyBundertheContractwithoutinterestwithinsevenworkingdays.IfPartyAfailstopunctuallyrefundthedeposit,itshallpaythelatefeeattherateof0.2%ofthemonthlyrentforeachdayofdelay.
5-2租赁期间,使用该房屋每月所产生的水、电、煤气、通讯费用、ADSL月租费由乙方承担。
其他物业管理费、租赁发票费、本小区会所的双人会员卡、每周一次房屋清洁,ADSL安装费、有线电视安装费及使用费由甲方承担。
Duringtheleaseterm,theutilityusagechargessuchaswater,electricity,gas,communication,ADSLmonthlysubscriptionfeeofthePropertyshallbebornebyPartyB.Managementfee,rentaltaxinvoicefee,complexclubmembershipcardsfortwoperson,oncetimehousekeepingperweek,ADSLinstallationfee,localTVinstallationfeeandservicefeeshallbebornebyPartyA.
5-3乙方所承担的上述费用,计算或分摊办法、支付方式和时间:
根据上述企事业单位列出的帐单凭证支付,如不按期付款,滞纳金由乙方承担。
PartyBshallberesponsibletopaytheabovementionedfeesandcharges,thecomputationoramortization,methodandtimeofpayment:
Accordingtothedemandnotes,ifdelayingpayment,PartyBshouldberesponsibleforthepenalty.
六、房屋使用要求和维修责任
6.StandardRequiredforUseofPropertyandResponsibilityofPropertyMaintenanceandRepair
6-1租赁期间,乙方发现该房屋及其附属设施有损坏或故障时,应及时通知甲方修复;甲方应在接到乙方通知后的叁日内进行维修。
逾期不维修的,乙方可代为维修,费用由甲方承担。
Duringtheleaseterm,ifPartyBdiscoversanydamagesordefectsofthePropertyandfacilitiesattached,PartyBshallnotifyPartyAimmediatelyforrepair.PartyAshallcarryouttherepairwithin3daysafterreceivingnotificationfromPartyB.PartyBmayrepaironbehalfofPartyAifanydelayandtherepairexpensesshallbebornebyPartyA.
6-2租赁期间,乙方应合理使用并爱护该房屋其附属设施。
因乙方使用不当或不合理使用,致使该房屋及其附属设施损坏或发生故障的,乙方应负责维修。
乙方拒不维修,甲方可代为维修,费用由乙方承担。
Duringtheleaseterm,PartyBshallreasonablytakegoodcareofthePropertyandthefurnishedfacilitiesattached.PartyBshallberesponsibletorepairimmediatelythedamagescausedtothePropertyand/orfacilitiesduetoimproperandunreasonableusebyPartyB.IfPartyBrefusestorepair,PartyAmayrepaironPartyB’sbehalfandtheexpensesshallbebornebyPartyB.
6-3租赁期间,甲方保证该房屋及其附属设施处于正常的可使用和安全的状态。
甲方对该房屋进行检查、养护,应提前叁日通知乙方。
检查养护时,乙方应予以配合。
甲方应减少对乙方使用该房屋的影响。
Duringtheleaseterm,PartyAshallguaranteethenormalusableandsafeconditionofthePropertyandfacilitiesattached.PartyAshallnotifyPartyBin3daysadvancebeforecarryingoutexaminationandmaintenanceworks.PartyBshallrendercooperationduringtheexaminationandmaintenance.PartyAshallreducetheeffectcausedtoPartyBinusingtheProperty.
6-4乙方需装修或者增设附属设施和设备的,应事先征得甲方的书面同意,按规定须向有关部门审批的,则还应由甲方报请有关部门批准后,方可进行。
乙方增设的附属设施的设备归属及其维修责任由甲、乙双方另行书面约定。
ExceptforAppendix3ofthisContract,beforecarryingoutanyextrarenovationoradditionoffacilitiesattachedandequipment,PartyBshallobtainthewrittenconsentofPartyAandsubmitthesametotherelevantauthorityforexaminationandapprovalinaccordancewiththeregulations.TheworkscouldonlybecarriedoutuponcompletionoftheprocedureofapprovalwiththerelevantauthoritybyPartyA.TheresponsibilityofthemaintenanceoftheaddedfacilitiesbyPartyBshallbeagreedbyPartyAandPartyBinseparatewrittenagreement.
七、房屋返还时的状态
7.ConditionofPropertyuponReturning
7-1除甲方同意乙方续租外,乙方应在本合同的租期届满后的当日内返还该房屋,未经甲方同意逾期返还房屋的,每逾期一日,乙方应按0.5%支付该房屋占用期间的使用费。
ExceptfortherenewalofleaseagreedbyPartyA,PartyBshallreturnthePropertywithin/onthesamedayaftertheexpirationofleasetermoftheContract.LatereturnofthePropertywithouttheconsentofPartyAshallbesubjecttoachargeforadversepossessionofthePropertyat0.5%timesofrentalperday.
7-2乙方返还该房屋应当符合正常使用后的状态。
返还时,应经甲方验收认可,并相互结清各自应当承担的费用。
ThePropertyatthetimeofreturningbyPartyBshallbegoodconditionafternormaluse.DuringthereturnofthePropertyshallbeexaminedandauthorizedbyPartyA,anyfeesandchargeswhichisresponsiblebyeitherpartyshallbeclearedatthetimeofreturningoftheProperty.
八、转租、转让和交换
8.Sublease,AssignmentandExchange
8-1除甲方已在本合同补充条款中同意乙方转租外,乙方在租赁期内,需事先征得甲方的书面同意,方同将该房屋部分或全部转租给他人。
但同一间居住房屋,不得分割转租。
UnlessanyagreementinthesupplementaryclausesoftheContract,PartyBshallobtainthewrittenapprovalfromPartyAbeforeitcouldsubleasepartorallofthePropertytoathirdpartyduringtheleaseterm.PartyBshallnotsubleasepartofthePropertyorsubleasetotwolesseesormorethantwolesseesatthe
