TenderingProcedures

OVERVIEW

1.Purpose

TheseProceduresareasupplementtotheUniversity’sProcurementPolicyandapplytotenderingfortheacquisitionofgoodsandservicesfromsuppliersexternaltotheUniversity,valuedat$200,000andabove.Theacquisitionofgoodsincludespurchasingandleasingofgoods.Theacquisitionofservicesincludescontractorandconsultantservices,butexcludesservicesprovidedbystaffemployedthroughtheUniversitypayroll,andanyservicesprovidedtoInvestmentandCapitalManagementinconnectionwiththeUniversity’sinvestmentportfolio.

2.Coverage

TheseProceduresapplytoallUniversityactivitiesincludingactivitiesundertakenbyFoundations,Centers,ControlledEntitiesandanyotherentitywhichhasenteredintoanagreementwiththeUniversity,andsuchagreementincludesatermwhichrequiresittocomplywiththeUniversity’spurchasingpolicyandassociatedprocedures.

KEYASPECTSOFTHETENDERINGPROCESS

3.Opentendering

Universitytendersshouldbeopentothepublicsothatthemarketisassessedforthegoodsorservicesrequired.Therearetwowaysthismaybedone,eitherbyfullyOpenTenderoramulti-stagetenderwhichinitiallyinvolvesthecallingofanExpressionofInterest,followedbyaSelectiveTender.TheProcurementServicesDepartmentmustapproveallOpenTenderproposalsandtheChiefProcurementOfficermustapproveallEOIproposals.

4.Invitedtendering

InvitedTenderingmaybeusedinsteadofOpenTenderingincertaincircumstances.InvitedTenderingoccurswhenspecificsuppliersareinvitedtotenderforgoodsorservicesratherthanthetenderbeingopentoanysuppliers.TheChiefProcurementOfficermustapproveallInvitedTenderproposals,withtheexceptionofusingapprovedpre-qualifiedsupplierpanels.

5.Documentation

Accountabilityrequirescomprehensivedocumentationforalltenders.Detailedjustificationofallkeydecisionsmade,especiallytheselectionofthetenderer,mustberecordedonanofficialRecordsManagementfilefromthetimethatadecisionismadetotenderuntilthefinalisationofthecontract.Documentationmustbeavailabletoshowthatthetenderingprocessisnotonlyfairbutalsothatitisseentobefair.Allcommunicationswithtenderersmustbedocumented.

6.Confidentiality

Alltendererinformationandtenderdocumentsreceivedaretobetreatedasconfidential.Theconfidentialityandanonymityoftenderersmustbemaintainedthroughoutthetenderprocess.

PROCEDURES

7.Strategicplanning

Itisimportantthataproperstrategybeplanned.Staffinvolvedmustensurethattheobjectivesoftheprojectbeingtenderedareclarifiedandthatclearspecificationsaredevelopedandfundingidentified.

8.TypesofTenders

Therearethreetypesoftenderingfortheacquisitionofgoodsorservices:

•OpenTender

•Multi-StageTender

•InvitedTendering

8.1OpenTender

OpenTenderingteststhemarketinatransparentmanner.Tendersareadvertisedpubliclyandnorestrictionisplacedonthenumberoftenderers.Allprospectivebiddersaregiventhesametenderdocumentation.TheProcurementServicesDepartmentmustbeconsultedonallOpenTenderproposals.

8.2Multi-StageTender

Multi-stagetenderingmaybeusedtocullalargenumberofrespondentsandidentifythebestserviceprovidersinaparticularwell-suppliedmarketthatareinterestedinprovidingtherelevantgoodsorservices.Italsolimitsthenumberoftendererstothoseabletodemonstratetherequisitecapabilityinthefirststage.Multi-stagetendersmaybeused:

•toestablishapanelofsuitablesuppliersforaspecificcategoryofgoodsorservices;

•toidentifysupplierswithsuitableproposalsforcomplexprocurements.

Thefirststageinmulti-stagetenderingisanExpressionofInterestorRequestforProposaltoinviteinterestedsupplierstoregistertheirinterestagainsttherequirementslistedintheEOIdocument.Thesecondstageinmulti-stagetenderingisaSelectiveRequestforTendertoinvitesuppliersshortlistedinthefirststagetoasubmitproposalsinresponsetospecificcriteriaoutlinedintheRequestforTenderdocument.

8.2.1ExpressionofInterest

TheEOIdocumentmuststatewhatfurtherprocessesareexpectedbeyondthefirststageofthetenderprocess.

TheUniversitywouldthenshort-listinterestedsupplierswiththeabilitytoundertaketheparticularproductsupplyorservicesrequired.Theseprequalifiedtendererswouldbeaskedtoindicatetheiravailabilitytotenderinthesecondstage,aSelectiveRequestforTender.

TheChiefProcurementOfficermustbeconsultedonallEOIproposals.

8.2.2SelectiveTender

InthiscasetendersarecalledforaspecificcontractinasecondstagefromshortlistedserviceprovidersidentifiedintheEOIstage.

TenderersarerequiredtosubmittenderstorespondtospecificationsidentifiedintheRequestforTenderdocument,suchasprice,capacity,expertiseandexperience.

TheChiefProcurementOfficermustapproveallselectivetenderproposals,withtheexceptionofusingapprovedpre-qualifiedsupplierpanels.

8.3InvitedTendering

InvitedTenderingmaybeused:

inemergencysituations;forspecialistwork;inspecialcircumstanceswhereonlyoneoralimitednumberofsuppliersareknowntobeabletocarryoutthework;forlowvalue,lowriskactivities.

InvitedTenderinginvolvesissuingRFTdocumentstoknownavailablesuppliersassessedasthemostcapableofdeliveringthegoodsorservicesrequired.TheChiefProcurementOfficermustapproveallproposalsforinvitedtendering.

9.TenderWaivers

Theneedtorunatendermaybewaivedinexceptionalcircumstances.Refertosection8intheProcurementPolicy.

10.TendersrequiringaNon-DisclosureAgreement

Incertaincircumstances,theProcurementServicesDepartmentmayrequireaninterestedtenderertoacceptandsignaNon-DisclosureAgreementbeforereceivingthetenderdocumentation.

11.TenderEvaluationTeam

AlltendersmusthaveaTenderEvaluationTeamtoensuretheprobityofthetenderprocess.TheTenderEvaluationTeammustconsistofatleastthreemembers,includingarepresentativefromtheProcurementServicesDepartmentaswellasotherpeoplewhohavetherelevanttechnicalknowledgeofthegoodsorservicesrequired.ForCampusInfrastructureandServicesmanagedtenders,theProcurementServicesDepartmentrepresentativemaybereplacedwithaCISrepresentativewhohasbeentrainedandapprovedbyProcurementServicesDepartment.

•OnememberoftheevaluationteamistobeexternaltothearearequestingthetenderandmaycomefromoutsidetheUniversity.

•TherepresentativefromtheProcurementServicesDepartment(orCISforCISmanagedtenders)willbetheTeamLeaderwhowillbethetendercontactandtheonlymemberoftheTeampermittedtocommunicatewithtenderers.

•TendersrelatingtoinformationandcommunicationstechnologymustalsohavearepresentativefromInformationCommunicationTechnology.

•EvaluationTeamsforapprovedCapitalWorksprogramsorapprovedRepairsandMaintenanceProgramsmusthavearepresentativefromCampusInfrastructureandServices.

TenderEvaluationTeammembersmustnothaveavestedorperceivedinterestintheoutcome.AConflictofInterestdeclarationwillbedistributedtotheEvaluationTeammemberspriortothecommencementofevaluationsbytheTeamLeaderandanyonewithaconflictofinterestmustdeclarethisconflictanddisqualifythemselvesfromthetender.RefertotheUniversity’sCodeofConductandCorruptionPreventionStrategyfordetails.

TenderEvaluationTeammemberscanseekexternalassistanceandadviceonspecificaspectsofhetender.Thisassistancemustbeco-ordinatedthroughtheTenderEvaluationTeamLeader.

12.AdvertisingTenders

ThecallforOpenTendersandExpressionsofInterestwillbeadvertisedintheSydneyMorningHeraldeveryfortnight.Other,additionalmethodsofadvertisementmayalsobeutilizedfromtimetotime.TheProcurementServicesDepartmentmustapprovealltenderadvertisements,withtheexceptionofCISmanagedtenders.

Publicadvertisementsmustinclude:

•anadequatedescriptionofthetendertoallowprospectivetendererstodecidewhethertheywishtoprepareatender,oralinktothelocationwherethisinformationisavailable;

•thelocationwherethetenderdocumentsmaybeobtained,includingthename,telephonenumberandemailofthecontactofficer;

•atenderreferencenumber;

•wheretendersaretobelodgedandtheclosingdateandtime;

•anyotherimportantdatesanddeadlines.

TheUniversitywillendeavortoensurethatthetimegivenbetweenthereleaseandtheclosingdateofthetenderissufficienttoallowatenderertostudythetenderspecificationandprepareabid;howeverthefinaldurationwillbedeterminedbytheProcurementServicesDepartment.

13.ReceiptandRegistrationofTenders

AlltendersaretobelodgedintheUniversity’seTenderBoxatthetenderweblodgmentaddress.TheeTenderboxwillbeopenedafterthetenderclosingdateandtime.DetailsofthetendersreceivedareregisteredbytheeTinderboxonaschedule/registerwhichincludes:

tenderdetails;tenderreferencenumberandtendername;tenderclosingdateandtime;dateandtimethetenderboxwasopened;suppliername,timesubmittedandauniqueidentifierforeachfile.

Alltendersreceivedmustbekeptinasecurelocation.

TenderswillonlybeacceptedintheUniversity’seTenderBox.Tenderssubmittedbyfacsimile,email,handdelivery,postoranymethodotherthanviatheeTenderBoxwillnotbeaccepted,exceptinexceptionalcircumstanceswithexpressap
