SubpartA-General

'11.1Purpose.

ThispartcontainsrulesandregulationsprovidingforanEmergencyAlertSystem（EAS）.TheEASprovidesthePresidentwiththecapabilitytoprovideimmediatecommunicationsandinformationtothegeneralpublicattheNational,StateandLocalArealevelsduringperiodsofnationalemergency.TherulesinthispartdescribetherequiredtechnicalstandardsandoperationalproceduresoftheEASforAM,FMandTVbroadcaststations,cablesystemsandotherparticipatingentities.TheEASmaybeusedtoprovidetheheadsofStateandlocalgovernment,ortheirdesignatedrepresentatives,withameansofemergencycommunicationwiththepublicintheirStateorLocalArea.

'11.11TheEmergencyAlertSystem（EAS）.

（a）TheEASiscomposedofbroadcastnetworks;cablenetworksandprogramsuppliers;AM,FMandTVbroadcaststations;LowPowerTV（LPTV）stations;cablesystems;wirelesscablesystemswhichmayconsistofMultipointDistributionService（MDS）,MultichannelMultipointDistributionService（MMDS）,orInstructionalTelevisionFixedService（ITFS）stations;andotherentitiesandindustriesoperatingonanorganizedbasisduringemergenciesattheNational,Stateandlocallevels.ItrequiresthatataminimumallparticipantsuseacommonEASprotocol,asdefinedin'11.31,tosendandreceiveemergencyalertsinaccordancewiththeeffectivedatesinthefollowingtables:

CABLESYSTEMS

A.Cablesystemsservingfewerthan5,000subscribersfromaheadendmusteitherprovidetheNationallevelEASmessageonallprogrammedchannels--includingtherequiredtesting--byOctober1,2002,orcomplywiththefollowingEASrequirements.AllothercablesystemsmustcomplywithB.

（c）ForpurposesoftheEAS,MultipointDistributionService（MDS）andMultichannelMultipointDistributionService（MMDS）stationsoperatedinaccordancewithSubpartKofPart21andInstructionalTelevisionFixedService（ITFS）stationsoperatedaspartofwirelesscablesystemsinaccordancewithSubpartIofPart74aredefinedasfollows:

（1）a"wirelesscablesystem"isacollectionofchannelsintheMDS,MMDS,orITFSusedtoprovidevideoprogrammingservicestosubscribers.Thechannelsmaybelicensedtoorleasedbythewirelesscablesystemoperator.

（2）a"wirelesscableoperator"istheentitythathasacquiredtherighttousethechannelsofawirelesscablesystemfortransmissionofprogrammingtosubscribers.

（d）LocalfranchiseauthoritiesandcabletelevisionsystemoperatorsmayenterintomutualagreementsthatrequiretheinstallationofEASequipmentbeforetherequireddateslistedabove.Additionally,localfranchiseauthoritiesmayuseanyEAScodesauthorizedbytheFCCinanyagreements.

（e）Organizationsusingothercommunicationssystemsortechnologiessuchas,DirectBroadcastSatellite（DBS）,lowearthorbitsatellitesystems,paging,computernetworks,etc.mayjointheEASonavoluntarybasisbycontactingtheFCC.Organizationsthatchoosetovoluntarilyparticipatemustcomplywiththerequirementsofthispart.

'11.12Two-toneAttentionSignalEncoderandDecoder.

Existingtwo-toneAttentionSignalEncoderandDecoderequipmenttypeacceptedforuseasEmergencyBroadcastSystemequipmentunderPart73maybeusedbybroadcaststationsuntilJanuary1,1998,providedthatsuchequipmentmeetstherequirementsof'11.32（a）（9）and11.33（b）.EffectiveJanuary1,1998,thetwo-toneAttentionSignalDecoderwillnolongerberequiredandthetwo-toneAttentionSignalwillbeusedtoprovideanaudioalert.

'11.13EmergencyActionNotification（EAN）andEmergencyActionTermination（EAT）.

（a）TheEmergencyActionNotification（EAN）isthenoticetoallbroadcaststations,cablesystemsandwirelesscablesystems,otherregulatedservicesoftheFCC,participatingindustryentities,andtothegeneralpublicthattheEAShasbeenactivatedforanationalemergency.

（b）TheEmergencyActionTermination（EAT）isthenoticetoallbroadcaststations,cablesystemsandwirelesscablesystems,otherregulatedservicesoftheFCC,participatingindustryentities,andtothegeneralpublicthattheEANhasterminated.

'11.14EANNetworkandPrimaryEntryPoint（PEP）System.
