ELECTRONICINDUSTRYCODEOFCONDUCT

TheElectronicIndustryCodeofConductoutlinesstandardstoensurethatworking

conditionsintheelectronicsindustrysupplychainaresafe,thatworkersaretreatedwith

respectanddignity,andthatmanufacturingprocessesareenvironmentallyresponsible.

ConsideredaspartoftheelectronicsindustryforpurposesofthisCodeareOriginal

EquipmentManufacturers(OEMs),ElectronicManufacturingServices(EMS)firmsand

OriginalDesignManufacturers(ODMs)includingcontractedlaborthatmaydesign,

market,manufactureand/orprovidegoodsandservicesthatareusedtoproduce

electronicgoods.TheCodemaybevoluntarilyadoptedbyanybusinessinthe

electronicssectorandsubsequentlyappliedbythatbusinesstoitssupplychainand

subcontractors.

ToadopttheCodeandbecomeaparticipant(“Participant”),abusinessshalldeclareits

supportfortheCodeandseektoconformtotheCodeanditsstandardsinaccordance

withamanagementsystemassetforthintheCode.

FortheCodetobesuccessful,itisacknowledgedthatParticipantsshouldregardthe

codeasatotalsupplychaininitiative.Ataminimum,participantsshallrequireitsnext

tiersupplierstoacknowledgeandimplementtheCode.

FundamentaltoadoptingtheCodeistheunderstandingthatabusiness,inallofits

activities,mustoperateinfullcompliancewiththelaws,rulesandregulationsofthe

1countriesinwhichitoperates.TheCodeencouragesParticipantstogobeyondlegal

compliance,drawinguponinternationallyrecognizedstandards,inordertoadvance

socialandenvironmentalresponsibility.

TheElectronicIndustryCodeParticipantsarecommittedtoobtainingregularinputfrom

stakeholdersinthecontinueddevelopmentandimplementationoftheElectronic

IndustryCodeofConduct(EICC).

TheCodeismadeupoffivesections.SectionsA,B,andCoutlinestandardsforLabor,

HealthandSafety,andtheEnvironment,respectively.SectionDoutlinestheelements

ofanacceptablesystemtomanageconformitytothisCode.SectionEaddsstandards

relatingtobusinessethics.

A.LABOR

Participantsarecommittedtoupholdthehumanrightsofworkers,andtotreatthemwith

dignityandrespectasunderstoodbytheinternationalcommunity.

RecognizedstandardssuchastheUniversalDeclarationofHumanRights(UDHR),

SocialAccountabilityInternational(SAI)andtheEthicalTradingInitiative(ETI)were

usedasreferencesinpreparingtheCodeandmaybeausefulsourceofadditional

information.

Thelaborstandardsare:

1)FreelyChosenEmployment

Forced,bondedorindenturedlabororinvoluntaryprisonlaborisnottobeused.

Allworkwillbevoluntary,andworkersshouldbefreetoleaveuponreasonable

notice.Workersshallnotberequiredtohandovergovernment-issued

identification,passportsorworkpermitsasaconditionofemployment.

2)ChildLaborAvoidance

Childlaborisnottobeusedinanystageofmanufacturing.Theterm“child”refers

toanypersonemployedundertheageof15(or14wherethelawofthecountry

permits),orundertheageforcompletingcompulsoryeducation,orunderthe

minimumageforemploymentinthecountry,whicheverisgreatest.Theuseof

legitimateworkplaceapprenticeshipprograms,whichcomplywithalllawsand

regulations,issupported.Workersundertheageof18shouldnotperform

hazardousworkandmayberestrictedfromnightworkwithconsiderationgivento

educationalneeds.

3)WorkingHours

Studiesofbusinesspracticesclearlylinkworkerstraintoreducedproductivity,

increasedturnoverandincreasedinjuryandillness.Workweeksarenottoexceed

themaximumsetbylocallaw.Further,aworkweekshouldnotbemorethan60

hoursperweek,includingovertime,exceptinemergencyorunusualsituations.

Workersshallbeallowedatleastonedayoffperseven-dayweek.

4)WagesandBenefits

Compensationpaidtoworkersshallcomplywithallapplicablewagelaws,

includingthoserelatingtominimumwages,overtimehoursandlegallymandated

benefits.Incompliancewithlocallaws,workersshallbecompensatedfor

overtimeatpayratesgreaterthanregularhourlyrates.Deductionsfromwagesas

adisciplinarymeasureshallnotbepermitted.Thebasisonwhichworkersare

beingpaidistobeprovidedinatimelymannerviapaystuborsimilar

documentation.

5)HumaneTreatment

Thereistobenoharshandinhumanetreatment,includinganysexualharassment,

sexualabuse,corporalpunishment,mentalorphysicalcoercionorverbalabuseof

workers:

noristheretobethethreatofanysuchtreatment.

6)Non-Discrimination

Participantsshouldbecommittedtoaworkforcefreeofharassmentandunlawful

discrimination.Companiesshallnotengageindiscriminationbasedonrace,color,

age,gender,sexualorientation,ethnicity,disability,pregnancy,religion,political

affiliation,unionmembershipormaritalstatusinhiringandemploymentpractices

suchaspromotions,rewards,andaccesstotraining.Inaddition,workersor

potentialworkersshouldnotbesubjectedtomedicalteststhatcouldbeusedina

discriminatoryway.

7)FreedomofAssociation

Opencommunicationanddirectengagementbetweenworkersandmanagement

arethemosteffectivewaystoresolveworkplaceandcompensationissues.

Participantsaretorespecttherightsofworkerstoassociatefreely,joinornotjoin

laborunions,seekrepresentation,joinworkers’councilsinaccordancewithlocal

laws.Workersshallbeabletocommunicateopenlywithmanagementregarding

workingconditionswithoutfearofreprisal,intimidationorharassment.

B.HEALTHandSAFETY

Participantsrecognizethatthequalityofproductsandservices,consistencyof

production,andworkers’morale,areenhancedbyasafeandhealthyworkenvironment.

Participantsalsorecognizethatongoingworkerinputandeducationiskeytoidentifying

andsolvinghealthandsafetyissuesintheworkplace.

RecognizedmanagementsystemssuchasOHSAS18001andILOGuidelineson

OccupationalSafetyandHealthwereusedasreferencesinpreparingtheCodeand

maybeausefulsourceofadditionalinformation.

Thehealthandsafetystandardsare:

1)OccupationalSafety

Workerexposuretopotentialsafetyhazards(e.g.,electricalandotherenergy

sources,fire,vehicle,andfallhazards)aretobecontrolledthroughproperdesign,

engineeringandadministrativecontrols,preventativemaintenanceandsafework

procedures(includinglockout/tagout).Wherehazardscannotbeadequately

controlledbythesemeans,workersaretobeprovidedwithappropriatepersonal

protectiveequipment.Workersshallnotbedisciplinedforraisingsafetyconcerns.

2)EmergencyPreparedness

Emergencysituationsandeventsaretobeidentifiedandassessed,andtheir

impactminimizedbyimplementingemergencyplansandresponseprocedures,

including:

emergencyreporting,employeenotificationandevacuationprocedures,

workertraininganddrills,appropriatefiredetectionandsuppressionequipment,

adequateexitfacilitiesandrecoveryplans.

3)OccupationalInjuryandIllness

Proceduresandsystemsaretobeinplacetomanage,trackandreport

occupationalinjuryandillness,includingprovisionsto:

a)encourageworker

reporting;b)classifyandrecordinjuryandillnesscases;c)providenecessary

medicaltreatment;d)investigatecasesandimplementcorrectiveactionsto

eliminatetheircauses;andd)facilitatereturnofworkerstowork.

4)IndustrialHygiene

Workerexposuretochemical,biologicalandphysicalagentsistobeidentified,

evaluated,andcontrolled.Whenhazardscannotbeadequatelycontrolledby

engineeringandadministrativemeans,workersaretobeprovidedwithappropriate

personalprotectiveequipment.

5)PhysicallyDemandingWork

Workerexposuretophysicallydemandingtasks,includingmanualmaterial

handlingandheavylifting,prolongedstandingandhighlyrepetitiveorforceful

assemblytasksistobeidentified,evaluatedandcontrolled.

6)MachineSafeguarding

Physicalguards,interlocksandbarriersaretobeprovidedandproperlymaintained

formachineryusedbyworkers.

7)DormitoryandCanteen

Workersaretobeprovidedwithcleantoiletfacilities,accesstopotablewaterand

sanitaryfoodpreparationandstoragefacilities.Workerdormitoriesprovidedbythe

Participantoralaboragentaretobeclean,safe,andprovideemergencyegress,

adequateheatandventilationandreasonablepersonalspace.

C.ENVIRONMENTAL

Participantsrecognizethatenvironmentalresponsibilityisintegraltoproducingworld-

classproducts.Inmanufacturingoperations,adverseeffectsonthecommunity,

environmentandnaturalresourcesaretobeminimizedwhilesafeguardingthehealth

andsafetyofthepublic.

RecognizedmanagementsystemssuchasISO14001andtheEcoManagementand

AuditSystem(EMAS)wereusedasreferencesinpreparingtheCodeandmaybea

usefulsourceofadditionalinformation.

Theenvironmentalstandardsare:

1)EnvironmentalPermitsandReporting

Allrequiredenvironmentalpermits(e.g.dischargemonitoring)andregistrations

aretobeobtained,maintainedandkeptcurrentandtheiroperationalandreporting

requirementsaretobefollowed.

2)PollutionPreventionandResourceReduction

Wasteofalltypes,includingwaterandenergy,aretobereducedoreliminat
