TheMedGrowcampussitsacrossthestreetfromaKFCinSouthfield,arelativelyprosperoussuburbofDetroit.Nearlyone-fifthofits90orsostudentsareformerauto-industryworkers.Theserecentenrollees—andthemorethan1,000peoplewhohavecompletedcoursesatMedGrowsinceitopenedinSeptember—arebettingthatstudyingsuchtopicsasbloomcyclesandadvancedpruningtechniqueswillhelpthemsucceedinwhatmaybeoneofthefewgrowthindustriesinMichigan,homeofthenation'shighestunemploymentrate:

14%.Withmedicalmarijuanafetchingasmuchas$500for1oz.(28g),providingittoamerefivepatientscouldgenerate$10,000amonthinsales.

Six-weekcoursesatMedGrowcost$475,andtheschoolisplanningtoopencampusesinColoradoandNewJerseywithinroughlythenextyear.Meanwhile,thenation'sfirstmarijuanaschool,thethree-year-oldOaksterdamUniversity,hasexpandedfromOakland,Calif.,tolocationsinLosAngelesandoneinFlint,Mich.,andmayopenmore.

ButasMedGrowfounderNickTennantcanattest,it'snoteasybeingaleaderofanemergingindustry.Tennant,averylean,veryblond24-year-old,grewupintheDetroitsuburbofWarrenandwatchedtheauto-detailingbusinesshestartedafterhighschoolfounderalongwiththeregion'seconomy.Then,in2008,asurprisingmajorityofMichiganvotersapprovedameasuretoallowpeoplewithcancer,Crohn'sdisease,AIDSandotherailmentstoapplyforstate-issuedcardstogroworobtainmarijuana.Herecallsthinking,"Youcouldsitthereandwatchtheindustryevolveorstepintothegame."

Sohewroteupabusinessplanforamarijuana-growersschoolandapproachedhiscar-detailingclientsaspotentialinvestors.Manythoughtitwasajoke,butenoughtookhimseriously.Hedeclinestosayhowmuchmoneyheraised.

Thenextstepwasfindingalandlord.Onetoldhimflatly,"Idon'twanttotakeontherisk."TowhichTennantreplied,"Ifyouwanttoletyourbuildingsitvacant,goforit."Heeventuallysettledon5,000sq.ft.(465sqm)inanofficebuildinginSouthfield,ahalfhour'sdrivenorthofdowntownDetroit.

ThefirstthingyounoticewhenyouwalkintoMedGrowisthepungentsmellofmarijuana.Oneoftheschool'stwogrowroomsshowcasesasinglemassivemarijuanaplantthat,intermsofheightandcanopy,isaboutthesizeofakitchentable.

 

MakingWaves:

TheLegalFightoverBeachAccess

Whentheweathergetshot,ordinaryfolksgotothebeach—andwell-heeledcoastal-propertyownerstrytokeepthemaway.Summerishighseasonforfightsoverbeachaccess,andtheSupremeCourtventuredintothosechoppywatersearlierthisweekwithamajorrulinginaFloridabeachcase.Itdidtherightthing,buttherulingisnotgoingtostopthefighting.

Thecaseinvolvedararesituation:

newlycreatedbeachfrontproperty.Torepairdamagedonebyhurricanes,twoFloridacitiesplantoaddsandtorebuildpartsoftheshorelinethatarebadlyeroded.Understatelaw,thenewlandwouldbepublicproperty.

Nearbybeachfront-propertyownersmighthaveshownsomegratitude,sincetherestorationwould,theoreticallyatleast,protectthemfromthenexthurricane.Instead,theysued.Ifthenewlandwasadded,theirpropertywouldnolongertouchthewater—therewouldbeastripoflandseparatingtheirpropertyfromtheocean—anditwouldopenthewayforunpropertiedhordestodescendwithbeachtowelsandstartfrolicking.Theownersclaimedtheadditionswouldbea"taking"oftheirproperty,inviolationoftheFifthAmendment.

TheSupremeCourtrejectedthesuitbyan8-0vote.Therewasnotaking,itheld,becausetheownerswouldstillownthesamepropertytheyalwayshadandtheywouldstillhaveaccesstothebeach.Thereisnoright,thecourtsaid,tohaveyourpropertycontinuetotouchthewater.(OutgoingJusticeJohnPaulStevens,whoownsabeachfrontcondoinFlorida,didnotparticipate.)

Thedecisionwasavictoryforpublicbeachaccessbutanarrowone.UnliketheFloridacase,whichhadafederal-constitutionalissue,property-rightsdisputesaregenerallydecidedunderstatelaw,sobeachbattlesarebeingwagedstatebystate.Thereisalong-standingrecognitioninmanystatesthatthebeachesbelongtoeveryone—andthateveryoneshouldhavearighttogettothemandenjoythem.Inpractice,however,exercisingthisrightisnotalwayseasy.

InHawaii,thestate'spristinebeachesareapublictrust,butbeachgoerscomplainthataccessisoftenrestrictedbynearbypropertyowners.Therehavebeenfightsovergatesbeingputupand,mostrecently,strategicplantingofvegetation.Thismonth,GovernorLindaLinglesignedalawmakingitillegalforpropertyownerstoplantvegetationtokeeppeopleawayfromthebeach.Thestateiscommittedtokeepingcleara"lateralbeachtransitcorridor"—inotherwords,apathforthepublictogettothebeach.

NewJerseyhasatraditionofbeachaccessdatingbacktocolonialtimes.Itscourtshavelongrecognizeda"publictrustdoctrine"underwhichthepublichasabroadrightofreasonableaccesstothesea.Itincludesarighttowalkalongthebeachandswiminthewater—and,undersomecircumstances,towalkovernearbyprivatelandtogettothewater.

Butthestate'sbeachtownshavebeenresourceful,theAssociatedPressrecentlyreported,infindingwaysofkeepingpeopleaway.Onetownbuiltastoneseawalltokeepthepublicout.Othersrelyonamoretime-honoredmeansofexclusion:

keepingparkingforoutsidersextremelylimited.

NewJersey'sDepartmentofEnvironmentalProtectionthismonthproposedscrappingbeach-accessrulesthatthecoastaltownsconsidertooonerouslikerequirementstomakeparkingandrestroomsavailable.Inkeepingwiththederegulatoryemphasisofthestate'snewlyelectedRepublicangovernorChrisChristie,theagencywouldsubstitutemore"reasonable"requirements.Manypropertyownersarepleased,butsomebeachgoersworrythenewruleswillmakeiteasiertodenynonresidentsaccess.

OntheWestCoast,theCaliforniaCoastalCommissionhasforyearshaditshandsfulltryingtostoplocalitiesalongthePacificfromputtingupfences,misleadingsignsandvegetationtokeeppeoplefromaccessingthebeach.InMay,DanaPoint,anOrangeCountycoastalcity,suedthecommissioninafightovergatesthatcutoffaccesstothecity'sbeaches.Thismonth,anenvironmentalgroupsuedDanaPointtogetthegatestakendown.

Popularsupportfortherightofbeachaccessseemstobestrong.InTexaslastfall,areferendumtoputbeach-accessrightsinthestateconstitutionpassedwithmorethan75%ofthevote.Butthereisonenotableconstituencythattakesamuchlessfavorableviewoftheissue:

coastal-propertyowners.Andthatvirtuallyguaranteesthatthefightsoveraccesswillbearoundformanysummerstocome.

 

ObamaTriestoShiftFocusfromMcChrystaltotheWarEffort

WhenPresidentObamafirstreadthenewRollingStonearticle,hedidnotbothertoplayitcool.Init,Obamafoundtheerstwhilebibleofrock-'n'-rollattitudehadchronicledhisAfghanistancommander,GeneralStanleyMcChrystal,openlymockingtheAdministrationinconversationswithaides,cavortinginaParispubandgenerallyactinglesslikeaGeneralthanlikeajock."Hewasangry,"saidWhiteHousepresssecretaryRobertGibbsofthePresident'sreactiontothearticlehewasshownonMondaynight."Youwouldknowitifyousawit."

ByTuesdayafternoon,however,ashegatheredhisseniorstaffintheCabinetRoom,itappearedthatthePresident'smoodhadchanged.AtoneendofthetablesatNationalSecurityAdviserJimJones,whohadbeencalleda"clown"byaMcChrystalaidequotedinRollingStone.AcrossfromObamasatVicePresidentJoeBiden,whohadbeencalled"BiteMe"byoneoftheGeneral'sadvisers.TherewasnoonepresenttorepresenttheFrenchministerwhosedinneraMcChrystalaidehadcalled"f___inggay."

Ratherthanlashoutinresponse,however,ObamaprojectedaZen-likecalm.HecalledMcChrystal'sactions"poorjudgment,"andsaidhewouldnotdecideabouttheGeneral'sfateuntilafterthetwomenmeetonWednesday.Thenhetriedtomaketheburgeoningscandalateachablemoment."WhateverdecisionthatImakewithrespecttoGeneralMcChrystaloranyotheraspectofAfghanpolicy,"Obamasaid,"isdeterminedentirelyonhowIcanmakesurethatwehaveastrategythatjustifiestheenormouscourageandsacrificethatthosemenandwomenaremakingoverthereandthatultimatelymakesthiscountrysafer."
