InSeptember2015,however,PeoplefortheEthicalTreatmentofAnimals(PETA)consideredthemonkeycalledNarutoasthecopyrightownerofthephotos.Throughhis“friends”atPETA,Narutowassuing(控诉)thephotographerandthepublishingcompanyBlurbforcopyright:

“ThephotosresultedfromthepurposefulactionsofNarutoandwerenothelpedbySlater,resultinginworksofauthorship...byNaruto.”

“IfahumanhadtakenaphotowithSlater’scamera,thatpersonwouldownthecopyrightofthephoto,”saysJeffKerrofPETA.“Narutoshouldbetreatednodifferently.”

ThelawyerforSlaterandBlurb,AndrewDhuey,requiredthatthecasebedismissed(驳回)inNovember2015.Dhueymentioneda2004caseinwhichthecourthadtodecidewhetherwhalescouldsuetheUSNavyforthedangerthey’dreceivedfrommachinesusedbytheNavy.Thecourtruledthattheycouldnot.

InJanuary,thecourtruledinfavorofdismissingthecase.PETAlawyerJeffKerrobjected,“WebelieveithasbeenstatedclearlyintheCopyrightAct.TheActallowscourtstofillindecisionslikethisone.”
