　　a.ifpartybsatisfiesthecriteriaofgettingthemortgageloanthroughtheexaminationofthelendingbank,the

　　lendingbankshallremittheloaninlumpsumtothespecialsettlementaccountopenedbypartyaatthebankin

　　accordancewiththeentrustedpaymentauthorization.

　　b.incasepartybdoesnotsatisfythecriteriaofgettingtheloanthroughtheexaminationofthelendingbank,party

　　bwillchoosethefollowingmethodsasthesolution:

　　3.taxesandfees

　　a.partyaandpartybshallpayallthetaxesandfeesrespectivelyinaccordancewithrelevantregulationsofthestateand

　　localgovernments.shallassistpartyaandpartybtocalculaterelevanttaxesandfees.throughnegotiation,partyaandpartybagreetobearthetaxesandfeesasfollows:

　　foranytaxesorfeesunspecified,unclear,orchangedwiththepolicy,partyaandpartybshallreachaconsensusdaysbeforethetitletransfer,orpartyaandpartybshallmakethepaymentinaccordancewiththegovernmentregulation.

　　feesincludingbutnotlimitedtopropertymanagementfee,utilityfeesforwater,electricity,gas,telephoneandothersbeforethehandoverofthepropertyisconcludedshallbebornbypartya.andthefeesaftershallbebornbypartyb.b.partyaandpartybmayentrusttopaytheaforesaidtaxesandfeesandshalltransferthepaymentproof,receiptsandinvoicesissuedbyrelevantgovernmenttothepartiesthatmakethepayment.

　　withindaysafterthebankdecidesnottoprovidetheloan,partybshallraisetheremainingpaymentbyhimselfandpayincashtopartya.partybshallbearalltheexpensesoccurredduringthisperiod;terminatethisagreement,andpartyaandpartybshallrefundthemoneywhichhavebeenpaidtoeachother.partybshallbearalltheexpensesoccurredduringthisperiod.

　　iv.titletransferagencyservices

　　partyaandpartybshallpreparethecertificatesandmaterialsfortitletransfer

　　andshallprovidechargeabletitletransferservicesforpartyaandpartybwithfees.

　　v.handoveroftheproperty

　　1.partyaandpartybagreethatpartyashallvacatethepropertdaysbeforethetitletransfer.shallassistpartyaandpartyb

　　coveredbyappendixioftheagreementfromthesigningoftheagreementtothehandoverofthepropertyinaccordancewiththeevaluationofthedamagedordismantleddecorationsandaccessories.

　　3.partyashallbearthepropertymanagementfeeandotherrelevantfeesbeforethehandoverofthepropertyandthe

　　aforesaidfeesshallbepaidbypartybafterthehandoveroftheproperty.

　　4.partyaandpartybagreetoconductthetitletransferdaysaftersigningofthisagreementtakingtitlecertificateandrelevantmaterial.willinformthespecificdate.partyshallpaythetaxesandfeesfortitletransferinaccordancewiththegovernmentregulations.

　　vi.rightsandobligationsofpartya

　　1.rightsofpartya

　　a.partyashallhavetherighttocheckpartyb’sidentification.

　　b.partyashallhavetherighttogetdepositandpropertysalespriceasstipulatedintheagreement.

　　c.partyashallhavetherightoflawsuituponpartyb’sbreachtothisagreement.

　　2.dutiesofpartya

　　b.partyashalldisclosetopartybtherealfactsabouttheproperty,includingbutnotlimitedtotherental,collateral,

　　leakageandotherdefectoftheproperty;

　　c.partyashallchangeitsresidenceaddressatthepropertydaysaftertitletransfer;

　　d.partyashallcooperatewithpartybfortitletransferinatimelymanner;e.partyashallguaranteeallthefacilitiesandaccessoriesofthepropertydescribedinappendixiareingood

　　conditionuponthehandoveroftheproperty;

　　ashallpayoffallthefeesrelatedwiththepropertybeforethehandoveroftheproperty.

　　vii.rightsandobligationsofpartyb

　　1.rightsofpartyb

　　a.partybshallhavetherighttocheckallthematerial,contractsandcertificateabouttheproperty;

　　b.partybshallhavetherighttoinspecttheproperty;

　　c.partybshallhavetherighttobeinformedofthefactsabouttheproperty;d.partybshallhavetherightoflawsuituponpartya’sbreachtothisagreement.

　　2.obligationsofpartyb

　　a.partybshallpaythedepositandsalespriceinaccordancewiththestipulationofthisagreement;

　　b.partybshallcooperatewithpartyafortitletransferinatimelymanner;

　　viii.rightsandobligationsofpartyc

　　1.partycshallprovideagencyservicesforpartyaandpartybforsigningthisagreement,providingthesigningplace,and

　　bearingtestimonyofsigningthisagreement;

　　2.partycshallprovidepartyaandpartybrelatedmaterial,updatethemthetransactionprocessandassistthem

　　withpropertyhandover.

　　ix.breachoftheagreementbypartya1.partyashallrefunddoubleddeposittopartybincasethetitleofthepropertyfailstobetransferredorthepropertyfailsto

　　2.incasepartyafailstohandovertheaforesaidpropertytopartybwithintheperiodstipulatedintheagreement,partya

　　andpartybagreetoadoptofthefollowingsolutions:

　　a.partyashallpaypartyofthecollectedpaymentpardayasthedefaultfineandtheagreementshallcontinueto

　　beeffective.

　　b.incasethelengthofoverdueperiodexceedsdaysandpartyahasnothandedoverthepropertyortransferthe

　　propertytitletopartyb,partybshallsendawrittennoticetopartya,andpartybshallhavetherightto

　　terminatetheagreementwhenpartyastillfailstohandoverthepropertyortransferthetitledaysafterpartyb

　　sendsoutthewrittennoticetopartya.inthiscase,partyashallreturndoublethedeposittopartyband

　　3.incasethereoccursanydamageonpartybastheresultthatpartyafailstodisclosetopartybtherealfactsabouttheproperty,includingbutnotlimitedtotherental,collateral,leakageandotherdefectoftheproperty,partyaandpartybagreetoadoptthefollowingsolutions:

　　a.partyashallpaypartyofthepropertysalespricepardayasthedefaultfineandtheagreementshallcontinueto

　　beeffective.

　　b.partyapromisestorecoverthepropertytotheconditionsatisfiedbypartybwithindays,andtheagreement

　　shallcontinuetobeeffective.otherwise,partybreservestherighttoterminatethisagreementandinthiscase,

　　4.partyashallchangetheresidenceaddresswithindaysandshallpaytopartybasthedefaultfine.

　　x.breachoftheagreementbypartyb

　　2.incasepartybfailstomakethepaymentorconducttitletransferprocessfollowingthetimingasstipulatedinthisagreement,partyaandpartybagreetoadoptasthesolution:

　　a.partybshallpaypartyofthedefaultpaymentpardayasthedefaultfineandtheagreementshallcontinuetobe

　　effective.

　　b.incasetheoverdue,partyashallsendawrittennoticetopartyb,andpartyashallhavetherighttotermin
