解读实施经评审的最低投标价法的可行性

近年来，随着招标招标活动的不时开展和完善，作为评标办法之一的经评审的最低招标价法越来越多地在各类工程建立项目中得到了应用。
由于这种办法与以往普遍运用的限制报价的办法存在明显的差别，对人们长期以来构成的招标招标的思想方式和运作形式产生了一定的抵触，遭到了社会各界的普遍关注。
为此，需求对这种办法能否能够施行、能否应当推行、在什么范围内推行、如何停止行政监管等问题，停止客观、认真的剖析和评价，这不只是推进建筑市场安康、有序开展的需求，也是每一个从事该行业工作的人无法逃避的一个严重问题。
Inrecentyears,alongwiththetenderandbiddingactivitiesfromtimetotimetocarryoutandperfect,asoneoftheevaluationmethodoftheevaluationofthelowestbiddingpricemethodincreasinglyhavebeenappliedinvariousengineeringbuildingproject.Asaresultofthelimitationofthismethodandwidelyusedwaytoquotethereisobviousdifference,forwhathaslongbeenatenderbiddingforgenerationwayofthinkingandoperationform,hasbeenwidespreadconcernfromallwalksoflife.Therefore,demandforthiskindofmethodcouldbeimplemented,whethershouldbecarriedout,inwhatwithinthescopeofimplementation,howtostoptheproblemsuchasadministrativeregulation,stoptheobjective,theearnestanalysisandevaluation,notonlypromotetheconstructionmarkethealthyandorderlyconductofdemand,isalsoeachpersonengagedintheworkoftheindustrycannotescapeaseriousproblem.
在工程建立项目的招标招标中采用经评审的最低招标价法，有以下几个方面的理由。

理由之一：

《招标招标法》第四十一条规则的中标条件之一是招标人的招标“可以满足招标文件的本质性请求，并且经评审的招标价钱最低；但是招标价钱低于本钱的除外。
”该条款不只是对中标条件的规则，同时也肯定了经评审的最低招标价法是招标招标中能够采用的一种评标的办法。
尔后，建立部第８９号令、国度七部委第１２号令、国务院其他部门及各地域都在有关招标招标的部门规章、中央法规和政府规章中，先后对这一规则的详细运用作了进一步的明白。
固然经评审的最低招标价法遵照的是低价优先的准绳，但并不是能够不计本钱，片面追求低价。

《招标招标法》对采用这种办法肯定的中标人的招标还规则了以下三个限制条件：

可以满足招标文件的本质性请求；
Cansatisfytheessentialrequestofthebiddingdocuments;
经过评标委员会的评审；
Afterareviewoftheevaluationcommittee;
招标价钱不低于本钱。
Atenderpriceisnotlowerthancapital.
上述规则，一方面明白了必要的评标程序，以保证评标结果的合理、科学，另一方面也是为了避免招标人以牺牲工程质量为代价，自觉地以非理性的低价获取中标。
同时，作为一种评标的办法，经评审的最低招标价法又是一个完好有机的整体，应当全面、完好天文解和运用。

《招标招标法》所肯定的招标招标的根本程序，既是对国际工程建立招标招标先进经历的自创，也是对国内工程建立招标招标二十多年来理论经历的总结，是招标招标当事人依法展开招标招标活动，行政监视部门依法施行行政监视的根本法律根据。
招标人依据工程建立项目的实践状况和本身请求，选择采用经评审的最低招标价法，是法律赋予招标人的一项根本权益。
依照依法行政的准绳，行政部门是无权制止招标人行使这项权益的。
"TenderZhaoBiaoFa"mustbetherootofthetenderandbiddingprocedures,isestablishedintheinternationalprojecttenderbiddingandadvancedexperienceofhisown,wasfoundedindomesticengineeringtenderingandbiddingtheoryformorethantwentyyearsexperiencesummary,isbiddingthetenderwiththetenderandbiddingactivities,thepartiesmonitoringadministrativedepartmentinaccordancewiththelawenforcementofadministrativemonitoring,accordingtothefundamentallaw.Thetendererrequestaccordingtothepracticeofengineeringbuildingprojectstatusanditself,selectreviewthelowestbiddingpricemethodisused,isthelawgivesafundamentalrightsandinterestsofthetenderer.Accordingtothecriterionofadministrationaccordingtolaw,administrativedepartmentistherighttostopexercisetherightsandinterestsofthetenderer.
经评审的最低招标价法并不是近几年才开端在工程建立项目中采用的，在《招标招标法》公布之前的若干年，在世界银行等国际金融机构出资的项目和外商等非国有资金投资的项目中，普遍采用的都是经评审的最低招标价法，在少数国有资金项目中也采用了这种办法。
当然，这些项目在详细的评审准绳和办法上不尽相同。
