“Yourcurrentrequirementthatallarchaeologicallyunearthedhumanremainsshouldbereburied,whetherafterastandardperiodoftwoyearsorafurtherspecialextension,iscontrarytobasic
principlesofarchaeologicalandscientificresearchandofmuseumpractice,”theywrite.
Thelawappliestoanypiecesofboneuncoveredataround400digsites,includingtheremainsofbodiesfoundatStonehengein2008thatdatebackto3,000BC.Archaeologistshavebeengrantedatemporaryextensiontogivethemmoretime,buteventuallytheboneswillhavetobereturnedtotheground.
ThearrangementsmayresultinthewasteoffuturediscoveriesatsitessuchasHappisburghinNorfolk,wherediggingiscontinuingafterthediscoveryofstonetoolsmadebyearlyhumans950,000yearsago.IfhumanremainswerefoundatHappisburgh,theywouldbetheoldestinnorthernEuropeandthefirstindicationofwhatthisspecieswas.Underthecurrentpracticeofthelaw,thoseremainswouldhavetobereburiedandeffectivelydestroyed.
Before2008,guidelinesallowedfortheproperpreservationandstudyofbonesofsufficientageandhistoricalinterest,whiletheBurialAct1857appliedtomorerecentremains.TheMinistryofJusticeassuredarchaeologiststwoyearsagothatthelawwastemporary,buthassofarfailedtoreviseit.
