INDIVIDUALEMPLOYMENTAGREEMENT

INDIVIDUALEMPLOYMENTAGREEMENT

Parties

Thepartiesare:

(1)________________________________locatedatAuckland(theEmployer)

(2)____________________(theEmployee)

 

1.TheDocument

Theagreementconsistsofthedocumentsandschedulesattachedheretoandreferredtowithinthedocumentandmustbereadinconjunctionwiththedocument.Theagreementconsistsof:

(a)TheIndividualEmploymentAgreement;

(b)TheIndividualSchedule;and

(c)TheJobSpecification.

2.ScopeofEmployee’sDuties

2.1TheEmployeeisemployedinthepositionofChef.Thedutiesaresetoutintheattachedjobdescription.

2.2TheEmployeemayalsoberequiredtoperformotherfunctionsfromtimetotime,andmakeeveryefforttoadjusttoanyreasonablere-definitionofduties.itisexpectedthattheEmployeewillundertakethedutiesasrequested,obeyinglawfulandreasonableinstructions.ItisalsoexpectedthattheEmployeewilldevotealloftheirnormalworkinghoursandbestendeavorstopromotingtheinterestsoftheEmployer.

3.Remuneration

TheEmployee’stotalremunerationissetoutintheattachedIndividualSchedule.

4.PersonalConduct

4.1ProperstandardsofconductareexpectedfromallEmployeesandthesewillbecommunicatedtotheEmployeeorpostedgenerallyinwritingfromtimetotime.

4.2Inbrief,theseincludethehonestyanduniformofdressandappearance,andactinginamannertomaintainboththegoodnameandthepropertyoftheEmployer.

5.Employer’sObligations

IncludedintheEmployer’sobligationsaretherequirementsthatallEmployeesaretreatedfairlyandreasonably,thattheyhaveasafeworkingenvironmentandareprotectedfromharassmentorduress.TheEmployeraimstoprovidearewardingworkingenvironment.

6.ConfidentialityandNon-disclosure

AspartofnormaldutiestheEmployeewillobtain,orhaveaccessto,confidentialinformationconcerningtheEmployer.UndernocircumstancesisanyusetobemadeofthisinformationexceptforthepurposesdirectlyrelateddothebusinessobjectivesoftheEmployer.

7.GeneralConditionsofEmployment

ItisagreedthatshouldtheEmployeehaveandlicensesorcertificatesrevokedorwithdrawn,whereitisarequirementoftheindividual’sjobfunctiontohavesuchlicensesorcertificates,thentheemploymentoftheindividualmaybeterminated

8.HoursofWork

8.1ThehoursofworkwillbeasspecifiedwithintheIndividualSchedule.

 

9.OvernightTrips

TheEmployeemayberequiredtobeabsentfromtheirhometownovernight;inthissituationtheEmployeewillbeprovidedwithaccommodationandmealsatlocationsapprovedbytheEmployerorwillbepaidafixedamount,sonegotiated,toactasreimbursementforaccommodationandmeals.

 

10.PaymentofRemuneration

10.1PaymentofremunerationwillbeaspertheIndividualEmploymentSchedule.

10.2TheEmployershallbeentitledtomakearatabledeductionfromtheEmployee’swages/salaryfortimelostthroughsickness(exceptasprovidedinclause16),accidentortheEmployee’sowndefault.

11.AnnualHolidays

11.1HolidaysshallbeallowedinaccordancewiththeprovisionsoftheHolidaysAct2003,i.e.fourweeks’holidayattheendofeachyearofemployment.

11.2Annualleaveistobetakenintheyearinwhichitfallsdueandshallbetakenatatimearrangedbymutualconsentnotlessthanonemonthpriortothetakingoftheleave.

11.3ForthepurposesoftheHolidaysAct2003theEmployerisdeemedtohaveallowedtheholidaysduringtheyearinwhichtheyaredue.ShouldanEmployeefailtotakeleaveitshallbeforfeitedunlesstheEmployeragreesinwritingthatitmaybeaccumulated.

12.StatutoryHolidays

12.1UnlessotherwiseagreedbetweentheEmployerandtheEmployerandtheEmployee,theEmployershallallowtheEmployeethefollowingeleven(11)dayspaidstatutoryholiday:

ChristmasDay

BoxingDay

NewYear’sDay

TheseconddayofJanuary(orsomeotherdayinitsplace)

WaitangiDay

GoodFriday

EasterMonday

AnzacDay

ThebirthdayofthereigningSovereign

LabourDay

AnniversaryDay(orsomeotherdayinitsplace)

 

12.2Whereanyoftheaboveholidays(exceptWaitangiDayandAnzacDay)fallsonaSaturdayofSunday,theholidaysshallbeobservedonthefollowingMondayorTuesdayasrequiredbytheHolidaysAct2003.

12.3WhenNewYear’sDayfallsonaTuesday,theEmployermaydecidethat31Decemberand1JanuarybeobservedasholidaysinsteadofNewYear’sDayandtheseconddayofJanuary.

12.4WhenAnzacDayfallsontheWednesdayfollowingEaster,theEmployermaydecidethattheTuesdayfollowingEastershallbeobservedasaholidayinlieuofAnzacDaytherebycreatinganextendedlongweekendfortheEmployee.

12.5WhereanEmployeeisnormallyemployedonthedayoftheweekonwhichstatutoryholidaysareobserved,theEmployeeshallbepaidforthenumberofhoursnormallyworkedbytheEmployeeonthatdaytoamaximumofeighthoursattheordinaryrateofpay.

Anemploymentagreementcannotinfuturespecifythattherateofpayalreadyincludesacomponentfortime-and-a-half(exceptinthetransitionalprovisionmentionedbelow).

Time-and-a-halfisappliedtotheportionoftheemployee’srelevantdailypayforthetimethattheemployeeactuallyworks–seethefactsheettitled“Calculatingpaymentforpublicholidays“relevantdailypay”.

13.DressTheme

Uniformofdressisrequired.

14.ParentalLeave

ParentalleaveshallbegrantedinaccordancewiththeprovisionsoftheParentalLeaveandEmploymentProtectionAct1987.

15.SickPay,DomesticLeaveandBereavementLeave

15.1Aftersixmonths’continuousservice,theEmployeeisentitledineachensuingperiodof12monthstoatotaloffivedays’sickleaveonpayatordinarytimerateofpayforthenormalnumberofhoursthattheEmployeenormallyworksonthatdaytoamaximumofeighthours.

15.2whereanEmployeehasunusedsickleaveentitlement,leaveofuptofivedaysperyearshallbegrantedshouldtheEmployeefinditessentialtostayhomeduetothefactthatthe:

(a)spouseoftheEmployeeissick;

(b)dependentchildordependentparentoftheEmployeeorthespouseoftheEmployeeissick.

SickleaveshallbetreatedasthoughitwasduetotheEmployee’ssickleaveentitlement.

15.3TheEmployeeshallensurethatnoticeisgiventotheEmployerassoonasispracticablebeforeoronthefirstdayofabsence.

15.4Forclaimsunder15.1or15.2ofthisclausetheEmployermayrequireasupportingmedicalcertificatesignedbyaregisteredmedicalpractitioner.

15.5Sickleavemayaccumulatetoamaximumof35daysbycarryingforwardfromoneyeartothenextanyunusedleaveofupto30days.

15.6BereavementLeave:

uptothreedays’leaveonordinarypaytomaximumofeighthoursshallbeallowedanEmployeeonproductionofsatisfactoryevidenceofthedeathoftheEmployee’sspouse,parent,child,brother,sister,grandparent,father-in-law,mother-in-law,grandchildoronanyotheroccasionwhichtheEmployeracceptsthatbyreasonofthedeathofanypersontheEmployeehassufferedabereavement.

NOTE:

theleaveprovidedforinthisclauseisnotinadditiontobutisinclusiveofSpecialLeaveprovidedforinSection30AoftheHolidaysAct2004.

16.JuryService

16.1WheretheEmployeeisobligedtoundertakejuryservice,thedifferencebetweentheremunerationpaidbytheCourtandhis/herdailywagetoamaximumofeighthoursperdayatordinaryratesofpayshallbemadeupbytheEmployer.Thedifferenceshallbemadeupforamaximumoffivedaysinrespectofeachseparateperiodofjuryservice.

16.2TheEmployeemustreturntoworkimmediatelytheyarenolongerrequiredattheCourt.

 

17.MedicalExaminations

TheEmployermayatanytimerequiretheEmployeetosubmithimself/herselftomedicalexaminationsbyaregisteredmedicalpractitionernominatedbytheEmployer.SuchmedicalexaminationsshouldbeattheexpenseoftheEmployer.

18.DisciplinaryProcedures

18.1Warnings

WheretheEmployerconsidersthattheconductofanEmployeeisnotintheinterestoftheEmployer,hisclientsorotherEmployees,thefollowingprocedureswillbefollowed:

(i)TheEmployershallinvestigatethefactsofthecomplaintanddiscussthecomplaintwiththeEmployeeconcerned.

(ii)IftheEmployerissatisfiedthatthecomplaintisjustified,theEmployermayissueaverbalwarningtotheEmployee.TheverbalwarningshallbenotedontheEmployee’sfileandacopyofthenoteshallbeshowntotheEmployee.

(iii)Shouldtheconductcomplainedofintheverbalwarningnotberectified,theEmployermayissueafinalwrittenwarning.Thewrittenwarningshallstateitisafinalwarning.

(iv)Iftheconductcomplainedofinthewrittenwarningisnotcorrected,theEmployeeshallbedismissed.

(v)AnEmployeewhoissodismissedshallbegivenoneweek’snoticeofdismissaloroneweek’spayinlieu.Thisclausewillnotapplyintheeventofsummarydismissal(clause(b)).

18.2SummaryDismissal

IntheeventofseriousmisconductanEmployeemaybedismissedwithoutthewarningprocedurehavingbeencompliedwith,orhavingbeencompliedwithinfull.

AnemployeewhoissodismissedshallbeentitledtosuchnoticeastheEmployershalldecide.

 

19.AbandonmentofEmployment

IftheEmployeeisabsentfromworkformorethantwoconsecutiveworkingdayswithoutnotificationtotheEmployer,theEmployeeshallbedeemedtohaveabandonedhis/heremployment,theEmployershallmakeallreasonableeffortstocontacttheEmployeeduringtheperiodoftheunnotifiedabsence.

20.TerminationofEmployment

20.1TheEmploymentAgreementmaybeterminatedbyamonth’snoticebyeitherparty.TheEmployermayelecttopayonemonth’ssa
