CHAPTERI

PRELIMINARY

1.Shorttitle,extentandcommencement--

（1）ThisActmaybecalledtheIndustries（DevelopmentandRegulation）Act,1951.

（2）ItextendstothewholeofIndia

（3）ItshallcomeintoforceonsuchdateastheCentralGovernmentmay,bynotificationintheOfficialGazette,appoint.

2.DeclarationastoexpediencyofcontrolbytheUnionCItisherebydeclaredthatitisexpedientinthepublicinterestthattheUnionshouldtakeunderitscontroltheindustriesspecifiedintheFirstSchedule.

3.DefinitionsInthisAct,unlessthecontextotherwiserequires.--

（a）AAdvisoryCouncil@meanstheCentralAdvisoryCouncilestablishedundersection5;

（aa）Aancillaryindustrialundertaking@meansanindustrialundertakingwhich,inaccordancewiththeprovisotosub-section

（1）ofsection11Bandtherequirementsspecifiedunderthatsub-section,isentitledtoberegardedasanancillaryindustrialundertakingforthepurposesofthisAct;

（ab）Acurrentassets@meansbankbalancesandcashandincludessuchotherassetsorreservesasareexpectedtoberealisedincashorsoldorconsumedwithinaperiodofnotmorethantwelvemonthsintheordinarycourseofbusiness,suchas,stock-in-trade,amountsduefromsundrydebtorsforsaleofgoodsandforservicesrendered,advancetaxpaymentsandbillsreceivable,butdoesnotincludesumscreditedtoaprovidentfund,apensionfund,agratuityfundoranyotherfundforthewelfareoftheemployees,maintainedbyacompanyowninganindustrialundertaking;

（ac）Acurrentliabilities@meansliabilitieswhichmustbemetondemandorwithinaperiodoftwelvemonthsfromthedatetheyareincurred;

andincludesanycurrentliabilitywhichissuspendedundersection18FB;

（b）ADevelopmentCouncil@meansaDevelopmentCouncilestablishedundersection6;

（bb）Aexistingindustrialundertaking@means--

（a）inthecaseofanindustrialundertakingpertainingtoanyoftheindustriesspecifiedintheFirstScheduleasoriginallyenacted,anindustrialundertakingwhichwasinexistenceonthecommencementofthisActorfortheestablishmentofwhicheffectivestepshadbeentakenbeforesuchcommencement,and

（b）inthecaseofanindustrialundertakingpertainingtoanyoftheindustriesaddedtotheFirstSchedulebyanamendmentthereof,anindustrialundertakingwhichisinexistenceonthecomingintoforceofsuchamendmentorfortheestablishmentofwhicheffectivestepshadbeentakenbeforethecomingintoforceofsuchamendment;

（c）Afactory@meansanypremises,includingtheprecinctsthereof,inanypartofwhichamanufacturingprocessisbeingcarriedonorisordinarilysocarriedon--

（i）withtheaidofpower,providedthatfiftyormoreworkersareworkingorwereworkingthereononanydayoftheprecedingtwelvemonths;

or

（ii）withouttheaidofpower,providedthatonhundredormoreworkersareworkingorwereworkingthereononanydayoftheprecedingtwelvemonthsandprovidedfurtherthatinnopartofsuchpremisesanymanufacturingprocessisbeingcarriedonwiththeaidofpower;

（cc）AHighCourt@meanstheHighCourthavingjurisdictioninrelationtheplaceatwhichtheregisteredofficeofacompanyissituate;

（d）Aindustrialundertaking@meansanyundertakingpertainingtoascheduledindustrycarriedoninoneormorefactoriesbyanypersonorauthorityincludingGovernment;

（ad）Anewarticle@,inrelationtoanindustrialundertakingwhichisregisteredorinrespectofwhichalicenceorpermissionhasbeenissuedunderthisAct,means--

（a）anyarticlewhichfallsunderanitemintheFirstScheduleotherthantheitemunderwhicharticlesordinarilymanufacturedorproducedintheindustrialundertakingatthedateofregistrationorissueofthelicenceorpermission,asthecasemaybe,fall;

（b）anyarticlewhichbearsamarkasdefinedintheTradeMarksAct,1940（5of1940）,orwhichisthesubjectofapatent,ifatthedateofregistrationorissueofthelicenceorpermission,asthecasemaybe,theindustrialundertakingwasnotmanufacturingorproducingsucharticlebearingthatmarkorwhichisthesubjectofthatpatent;

（e）Anotifiedorder@meansanordernotifiedintheOfficialGazette;

（f）Aowner@,inrelationtoanindustrialundertaking,meansthepersonwho,ortheauthoritywhich,hastheultimatecontrolovertheaffairsoftheundertaking,and,wherethesaidaffairsareentrustedtoamanager,managingdirectorormanagingagent,suchmanager,managingdirectorormanagingagentshallbedeemedtobetheowneroftheundertaking;

（g）Aprescribed@meansprescribedbyrulesmadeunderthisAct;

（h）Aschedule@meansaScheduletothisAct;

（i）Ascheduledindustry@meansanyoftheindustriesspecifiedintheFirstSchedule;

（j）Asmallscaleindustrialundertaking@meansanindustrialundertakingwhich,inaccordancewiththerequirementsspecifiedundersub-section

（1）ofsection11B,isentitledtoberegardedasasmallscaleindustrialundertakingforthepurposesofthisAct;

（k）wordsandexpressionsusedhereinbutnotdefinedinthisActanddefinedintheCompaniesAct,1956（1of1956）,havethemeaningsrespectivelyassignedtotheminthatAct.

4.[Saving.]Rep.,bytheIndustries（DevelopmentandRegulation）AmendmentAct,1953（26of1953）,s.3（w.e.f.1.10.1953）.

THECENTRALADVISORYCOUNCILANDDEVELOPMENTCOUNCILS

5.EstablishmentandconstitutionofCentralAdvisoryCouncilanditsfunctions.-

（1）Forthepurposeofadvisingitonmattersconcerningthedevelopmentandregulationofscheduledindustries,theCentralGovernmentmay,bynotifiedorder,establishaCounciltobecalledtheCentralAdvisoryCouncil.

（2）TheAdvisoryCouncilshallconsistofaChairmanandsuchothermembers,notexceedingthirtyinnumber,allofwhomshallbeappointedbytheCentralGovernmentfromamongpersonswhoareinitsopinioncapableofrepresentingtheinterestsof-

（a）ownersofindustrialundertakingsinscheduledindustries;

（b）personsemployedinindustrialundertakingsinscheduledindustries;

（c）consumersofgoodsmanufacturedorproducedbyscheduledindustries;

（d）suchotherclassofpersonsincludingprimaryproducers,asintheopinionoftheCentralGovernment,oughttoberepresentedontheAdvisoryCouncil.

（3）Thetermofofficeof,theproceduretobefollowedinthedischargeoftheirfunctionsby,andthemanneroffillingcasualvacanciesamong,membersoftheAdvisoryCouncil,shallbesuchasmaybeprescribed.

（4）TheCentralGovernmentshallconsulttheAdvisoryCouncilinregardto-

（a）themakingofanyrules,otherthanthefirstrulestobemadeundersub-section（3）;

andmayconsulttheAdvisoryCouncilinregardtoanyothermatterconnectedwiththeadministrationofthisActinrespectofwhichtheCentralGovernmentmayconsideritnecessarytoobtaintheadviceoftheAdvisoryCouncil.

6.EstablishmentandconstitutionofDevelopmentCouncilsandtheirfunctions-

（1）TheCentralGovernmentmay,bynotifiedorder,establishforanyscheduledindustryorgroupofscheduledindustries,abodyofpersonstobecalledaDevelopmentCouncilwhichshallconsistofmemberswhointheopinionoftheCentralGovernmentare-

（a）personscapableofrepresentingtheinterestsofownersofindustrialundertakingsinthescheduledindustryorgroupofscheduledindustries;

（b）personshavingspecialknowledgeofmattersrelatingtothetechnicalorotheraspectsofthescheduledindustryorgroupofscheduledindustries;

（c）personscapableofrepresentingtheinterestsofpersonsemployedinindustrialundertakingsinthescheduledindustryorgroupofscheduledindustries;

（d）personsnotbelongingtoanyoftheaforesaidcategories,whoarecapableofrepresentingtheinterestsofconsumersofgoodsmanufacturedorproducedbythescheduledindustryorgroupofscheduledindustries.

（2）Thenumberandthetermofofficeof,andtheproceduretobefollowedinthedischargeoftheirfunctionsby,andthemanneroffillingcasualvacanciesamongmembersofaDevelopmentCouncilshallbesuchasmaybeprescribed.

（3）EveryDevelopmentCouncilshallbe,byvirtueofthisAct,abodycorporatebysuchnameasmaybespecifiedinthenotifiedorderestablishingit,andmayholdandtransferpropertyandshallbythesaidnamesueandbesued.

（4）ADevelopmentCouncilshallperformsuchfunctionsofakindspecifiedintheSecondScheduleasmaybeassignedtoitbytheCentralGovernmentandforwhoseexercisebytheDevelopmentCouncilitappearstotheCentralGovernmentexpedienttoprovideinordertoincreasetheefficiencyorproductivityinthescheduledindustryorgroupofscheduledindustriesforwhichtheDevelopmentCouncilisestablished,toimproveordeveloptheservicethatsuchindustryorgroupofindustriesrendersorcouldrendertothecommunity,ortoenablesuchindustryorgroupofindustriestorendersuchservicemoreeconomically.

（5）ADevelopmentCouncilshallalsoperformsuchotherfunctionsasitmayberequiredtoperformbyorunderanyotherprovisionofthisAct.

7.ReportsandAccountsofDevelopmentCouncils.-

（1）ADevelopmentCouncilshallprepareandtransmittotheCentralGovernmentandtheAdvisoryCouncil,annually,areportsettingoutwhathasbeendoneinthedischargeofitsfunctionsduringthefinancialyearlastcompleted.

（2）TheReportshallincludeastatementoftheaccountoftheDevelopmentCouncilforthatyear,andshallbetransmittedassoonas
