Article1 

ThisLawisenactedforthepurposesofpreventingandcontrollingwaterpollution,protectingandimprovingtheenvironment,safeguardinghumanhealth,ensuringeffectiveutilizationofwaterresourcesandpromotingprogressofthesocialistmodernizationdrive.

Article2 

ThisLawappliestopreventionandcontrolofpollutionofrivers,lakes,canals,irrigationchannels,reservoirsandothersurfacewaterbodiesandofgroundwaterbodieswithintheterritoryofthePeople'

sRepublicofChina.

ThisLawisnotapplicabletopreventionandcontrolofmarinepollution,whichisprovidedforbyaseparatelaw.

Article3 

RelevantdepartmentsundertheStateCouncilandlocalpeople'

sgovernmentsatvariouslevelsmustincorporateprotectionofthewaterenvironmentintotheirplansandadoptwaysandmeasurestopreventandcontrolwaterpollution.

Article4 

Theenvironmentalprotectiondepartmentsofthepeople'

sgovernmentsatvariouslevelsshallbetheorgansexercisingunifiedsupervisionandmanagementofpreventionandcontrolofwaterpollution.

Navigationadministrationofficesofthecommunicationsdepartmentsatvariouslevelsshallbetheorgansexercisingsupervisionandmanagementofpollutioncausedbyships.

Waterconservancyadministrationdepartments,publichealthadministrationdepartments,geologicalandminingdepartments,municipaladministrationdepartments,andwatersourcesprotectionagenciesformajorriversofthepeople'

sgovernmentsatvariouslevelsshall,throughperformingtheirrespectivefunctionsandinconjunctionwithenvironmentalprotectiondepartments,exercisesupervisionoverandmanagementofpreventionandcontrolofwaterpollution.

Article5 

Allunitsandindividualsshallhavethedutytoprotectthewaterenvironmentandtherighttosuperviseandinformagainstanypollutionordamagetothewaterenvironment.

Anyunitorindividualthathassuffereddamagedirectlyfromawaterpollutionhazardshallhavetherighttodemandeliminationofthehazardandcompensationforthedamagebythepolluter.

CHAPTERIIESTABLISHMENTOFSTANDARDSFORWATERENVIRONMENTQUALITYANDFORDISCHARGEOFWATERPOLLUTANTS

Article6 

TheenvironmentalprotectiondepartmentundertheStateCouncilshallestablishthenationalstandardsforwaterenvironmentquality.

Thepeople'

sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentmayestablishtheirownlocalstandardsfortheitemsthatarenotspecifiedinthenationalstandardsforwaterenvironmentqualityandreportthesametotheenvironmentalprotectiondepartmentundertheStateCouncilfortherecord.

Article7 

TheenvironmentalprotectiondepartmentundertheStateCouncilshall,inlinewiththenationalstandardsforwaterenvironmentqualityandthecountry'

seconomicandtechnologicalconditions,establishthenationalstandardsfordischargeofwaterpollutants.

sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentmayestablishtheirownlocalstandardsfortheitemsthatarenotspecifiedinthenationalstandardsfordischargeofwaterpollutants.Withregardtotheitemsthatarealreadyspecifiedinthenationalstandardsfordischargeofwaterpollutants,theymayestablishmorestringentlocalstandardsthanthenationalstandards.AlllocalstandardsmustbereportedtotheenvironmentalprotectiondepartmentundertheStateCouncilfortherecord.

Thosewhodischargepollutantsintoanywaterbodyforwhichlocalstandardshavebeenestablishedshallobservesuchlocalstandards.

Article8 

TheenvironmentalprotectiondepartmentundertheStateCouncilandthepeople'

sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentshall,inlinewiththerequirementsofpreventionandcontrolofwaterpollutionandthecountry'

seconomicandtechnologicalconditions,amendinduetimetheirstandardsforwaterenvironmentqualityandfordischargeofwaterpollutants.

CHAPTERIIISUPERVISIONANDMANAGEMENTOFPREVENTIONANDCONTROLOFWATERPOLLUTION

Article9 

sgovernmentsatvariouslevelsshall,whendeveloping,utilizing,regulatingandallocatingwaterresources,makeintegratedplansformaintainingproperriverflows,properwaterlevelsoflakes,reservoirsandpropergroundwatertables,inordertoretainthenaturalpurificationcapacityofwaterbodies.

Article10 

Topreventandcontrolwaterpollution,itisnecessarytomakeunifiedplansonthebasisofriverbasinsorregions.Plansforpreventingandcontrollingwaterpollutionofbasinsofmajorrivers,designatedassuchbytheState,shallbeformulatedbytheenvironmentalprotectiondepartmentundertheStateCouncil,togetherwiththecompetentdepartmentofplanning,waterconservancyadministrationdepartmentandotherdepartmentsconcernedaswellasthepeople'

sgovernmentsofrelevantprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment,andshallbesubmittedtotheStateCouncilforapproval.

Plansforpreventingandcontrollingwaterpollutionofbasinsofotherriversthatrunacrossprovincesorcountiesshallbeformulated,inlinewiththeplansforpreventingandcontrollingwaterpollutionofbasinsofmajorrivers,designatedassuchbytheState,andinlightofactuallocalconditions,bytheenvironmentalprotectiondepartmentsofthepeople'

sgovernmentsatorabovetheprovinciallevel,togetherwiththewaterconservancyadministrationdepartmentsandotherdepartmentsconcernedaswellastherelevantlocalpeople'

sgovernments,andshallbesubmittedtotheStateCouncilorthepeople'

sgovernmentsattheprovinciallevelforapproval.Plansforpreventingandcontrollingwaterpollutionofbasinsofotherriversthatrunacrosscountiesbutnotprovincesshallbesubmittedbythepeople'

sgovernmentoftheprovinceconcernedtotheStateCouncilfortherecord.

Plansforpreventingandcontrollingwaterpollution,onceapproved,shallserveastheessentialbasisforpreventionandcontrolofwaterpollution,andanymodificationofsuchplansshallbesubjecttoapprovaloftheoriginaldepartmentsthatapprovedtheplans.

Localpeople'

sgovernmentsatorabovethecountylevelshall,inaccordancewiththeapprovedplansforpreventingandcontrollingwaterpollutionofriverbasins,organizepeopletoworkoutplansforpreventingandcontrollingwaterpollutionfortheirownadministrativeregionsandincorporatesuchplansinthelong-term,medium-termandannualplansoftheiradministrativeregionsfornationaleconomicandsocialdevelopment.

Article11 

sgovernmentsatvariouslevelsshallmakerationalplansforthegeographicaldistributionofindustries,subjectthoseenterprisesthatcausewaterpollutiontorectificationandtechnologicalupdating,adoptcomprehensivepreventionandcontrolmeasures,increasetherateofwaterrecycling,utilizeresourcesrationallyandreducedischargeofwastewaterandpollutants.

Article12 

sgovernmentsatorabovethecountylevelmaydelineateprotectionzonesforwaterbodiesinscenicorhistoricsites,majorfisherywaterbodiesandotherwaterbodiesofspecialeconomicorculturalvalue,andtakemeasurestoensurethatthewaterqualityinthoseprotectionzonescomplieswiththestandardsforthedesignateduses.

Article13 

NewconstructionprojectsandexpansionorreconstructionprojectsandotherinstallationsonwaterthatdirectlyorindirectlydischargepollutantstowaterbodiesshallbesubjecttorelevantStateregulationsgoverningenvironmentalprotectionforsuchprojects.

Intheenvironmentalimpactstatementofaconstructionprojectanassessmentshallbemaderegardingthewaterpollutionhazardstheprojectislikelytoproduceanditsimpactontheecosystem,andmeasuresfortheirpreventionandcontrolshallbeprescribed.Thestatementshallbesubmitted,accordingtothespecifiedprocedure,totherelevantenvironmentalprotectiondepartmentforexaminationandapproval.Thebuildingofsewageoutletswithinanywaterconservancyprojectssuchascanals,irrigationchannelsandreservoirsshallbesubjecttoconsentoftherelevantdepartmentinchargeofwaterconservancyprojects.

Thefacilitiesforpreventionandcontrolofwaterpollutionmustbedesigned,constructedandputtouseorintooperationsimultaneouslywiththemainpartofaconstructionproject.Suchfacilitiesmustbeinspectedbytheenvironmentalprotectiondepartment.Iftheydonotconformtothespecifiedrequirements,thesaidprojectshallnotbepermittedtobeputintooperationortouse.

Anenvironmentalimpactstatementshallcontaincommentsandsuggestionsoftheunitsandresidentsintheplacewheretheconstructionprojectislocated.

Article14 

Enterprisesandinstitutionsthatdischargepollutantsdirectlyorindirectlyintoawaterbodyshall,pursuanttotheregulationsoftheenvironmentalprotectiondepartmentundertheStateCouncil,reporttoandregisterwiththelocalenvironmentalprotectiondepartmenttheirexistingfacilitiesfordischargingandtreatingpollutants,andthecategories,quantitiesandconcentrationsofpollutantsdischargedundertheirnormaloperatingconditions,andalsoprovidetothesamedepartmenttechnicalinformationconcerningpreventionandcontrolofwaterpollution.
