Article1ThisLawisformulatedinaccordancewiththeConstitutionforthepurposesofregulatingsocialinsurancerelationship,protectingthelegalrightandinterestofcitizensinparticipatinginsocialinsuranceandenjoyingsocialinsurancebenefits,enablingcitizenstosharethedevelopmentachievementsandpromotingsocialharmonyandstability.

Article2TheStateestablishessocialinsurancesystemssuchasbasicpensioninsurance,basicmedicalinsurance,work-relatedinjuryinsurance,unemploymentinsuranceandmaternityinsurancesoastoprotecttherightofcitizensinreceivingmaterialassistancefromtheStateandthesocietyinaccordancewiththelawwhengettingold,sick,injuredatwork,unemployedandgivingbirth.

Article3Thesocialinsurancesystemadherestotheprinciplesofwidecoverage,basicprotection,multi-levelandsustainabilityandthelevelofsocialinsuranceshallcorrespondtothelevelofeconomicandsocialdevelopment.

Article4EmployingentitiesandindividualswithintheterritoryofthePeople’sRepublicofChinashallpaysocialinsurancepremiumsinaccordancewiththelawandshallbeentitledtoenquiryaboutpaymentrecordsandpersonalinterestrecordsandrequestsocialinsuranceagenciestoproviderelevantservicessuchassocialinsuranceconsultation.

Individualsmayenjoysocialinsurancebenefitsandareentitledtosupervisethestatusofpremiumpaymentbytheirownentitiesfortheminaccordancewiththelaw.

Article5People’sgovernmentsabovethecountylevelshallincludesocialinsuranceundertakinginthenationaleconomicandsocialdevelopmentplans.

TheStateraisessocialinsurancefundsthroughmultiplechannels.People’sgovernmentsabovethecountylevelshallprovidenecessaryoutlaysupportforsocialinsuranceundertaking.

TheStatesupportssocialinsuranceundertakingthroughtaxincentivepolicies.

Article6TheStatestrictlyregulatesthesocialinsurancefunds.

TheStateCouncilandthepeople’sgovernmentsoftheprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentestablishandimprovethesupervisionandadministrationsystemofthesocialinsurancefunds,protectthesecurityofthesocialinsurancefundsandensuretheireffectiveoperation.

People’sgovernmentsabovethecountyleveladoptmeasurestoencourageandsupportallsectorsofthesocietytoparticipateinthesupervisionofthesocialinsurancefunds.

Article7ThesocialinsuranceadministrationdepartmentsoftheStateCouncilareresponsiblefortheworkwithrespecttotheadministrationofsocialinsurancethroughoutthecountry.OtherrelevantdepartmentsoftheStateCouncilareresponsiblefortherelevantsocialinsuranceworkwithintheirrespectivescopeofduties.

Socialinsuranceadministrationdepartmentsofthelocalpeople’sgovernmentsabovethecountylevelareresponsiblefortheworkwithrespecttotheadministrationofsocialinsurancewithintheirownadministrationregions.Otherrelevantdepartmentsofthelocalpeople’sgovernmentabovethecountylevelareresponsiblefortherelevantsocialinsuranceworkwithintheirrespectivescopeofduties.

Article8Socialinsuranceagenciesprovidesocialinsuranceservicesandareresponsibleforworksuchassocialinsuranceregistration,personalinterestrecordsandpaymentofsocialinsurancebenefits.

Article9Thetradeunionsprotectthelegalinterestoftheworkersinaccordancewiththelawandareentitledtoparticipateinthestudyofmajorsocialinsuranceissues,jointhesocialinsurancesupervisioncommissionsandsuperviseissuesrelatingtothesocialinsuranceinterestoftheworkers.

Article10Workersshallparticipateinbasicpensioninsuranceandthebasicpensioninsurancepremiumsshallbepaidjointlybytheemployingentitiesandtheworkers.

Soleproprietorswhoarenotemployed,non-fulltimepractitionersandotherworkersinflexibleemploymentwhohavenotparticipatedinthebasicpensioninsuranceintheemployingentitiesmayparticipateinbasicpensioninsuranceandpaythebasicpensioninsurancepremiumsontheirown.

MeasuresforthepensioninsuranceofcivilservantsandstaffgovernedbythecivilservantlawsshallbeprescribedbytheStateCouncil.

Article11Basicpensioninsuranceinvolvesbothsocialcoordinationandpersonalaccounts.

Thebasicpensioninsurancefundismadeupofpaymentfromtheemployingentitiesandindividualsandgovernmentsubsidies.

Article12Anemployingentityshallpaythebasicpensioninsurancepremium,whichshallbeincludedandrecordedinthebasicpensioninsurancecoordinationfund,accordingtoaratioofthetotalwageoftheworkeroftheentitythatisstipulatedbytheState.

Aworkershallpaythebasicpensioninsurancepremium,whichshallbeincludedandrecordedinthepersonalaccount,accordingtoaratioofthewageoftheworkerthatisstipulatedbytheState.

Soleproprietorswhoarenotemployedornon-fulltimepractitionersandotherworkersinflexibleemploymentwhohavenotparticipatedinthebasicpensioninsuranceintheemployingentitiesbuthaveparticipatedinbasicpensioninsuranceshallpaythebasicpensioninsurancepremiumsinaccordancewiththeprovisionsoftheStateandsuchpremiumsshallbeincludedandrecordedinthebasicpensioninsurancecoordinationfundandthepersonalaccountsrespectively.

Article13ThebasicpensioninsurancepremiumsthatshallbedeemedtohavebeenpaidduringthepaymentperiodbeforetheworkersoftheState-ownedenterprisesandinstitutionsparticipateinthebasicpensioninsuranceshallbebornebythegovernment.

Incasetheamountinthebasicpensioninsurancefundisinsufficienttomakepayment,thegovernmentshallprovidethesubsidy.

Article14Theamountinthepersonalaccountshallnotbewithdrawninadvance.Theinterestratefortheamountintheaccountshallnotbelowerthanthebank’sinterestratefortimedeposits.Interestratetaxisexempted.Thebalanceinthepersonalaccountmaybeinheritedafterthedeathoftheindividual.

Article15Thebasicpensionismadeupofthecoordinatedpensionandthepensioninthepersonalaccount.

Thebasicpensionisdeterminedbasedonfactorssuchastheindividual’scumulativepremiumpaymentperiod,thewagefromwhichpremiumpaymentismade,theaveragewageofthelocalworkers,theamountinthepersonalaccountandtheaveragelifeexpectancyoftheurbanpopulation.

Article16Anindividualparticipatinginbasicpensioninsurancemaycollectbasicpensiononamonthlybasisifthecumulativepremiumpaymentperiodreaches15yearsatthetimetheindividualreachesthestatutoryretirementage.

Ifthecumulativepremiumpaymentperiodislessthan15yearsatthetimetheindividualparticipatinginbasicpensioninsurancereachesthestatutoryretirementage,he/shemaycontinuetopaythepremiumuntilthecumulativepremiumpaymentperiodreaches15yearsandthencollectthebasicpensiononamonthlybasis,orhe/shemaytransfertothenewruralsocialpensioninsuranceorthesocialpensioninsuranceforurbanresidentsandenjoythecorrespondingpensioninsurancebenefitsinaccordancewiththeprovisionsoftheStateCouncil.

Article17Ifanindividualwhoparticipatesinbasicpensioninsurancepassesawayduetosicknessorreasonsotherthanwork,thefamilymembersofthedeceasedmaycollectfuneralallowanceandbereavementpayment.Theindividuallosingthecapacityforworkcompletelyduetosicknessordisabilitynotcausedbyworkbeforereachingthestatutoryretirementagemaycollectsicknessanddisabilitysubsidy.Theamountrequiredshallbepaidfromthebasicpensioninsurancefund.

Article18TheStateestablishesanormaladjustmentmechanismforbasicpensions,whichincreasesthebasicpensioninsurancebenefitsinatimelymannerbasedonthegrowthoftheaveragewageoftheworkersandtheriseofprices.

Article19Thebasicpensioninsurancerelationshipofanindividualshallbetransferredalongwiththeshiftofhis/heremploymentawayfromthecoordinatedregionbutthepremiumpaymentperiodshallbeaccumulated.Whenanindividualreachesthestatutoryretirementage,thebasicpensionwillbecalculatedbyphasesbutwillbepaidtogether.ThespecificmeasuresshallbeprescribedbytheStateCouncil.

Article20TheStateestablishesandimprovesthenewruralsocialpensioninsurancesystem.

Thenewruralsocialpensioninsuranceinvolvesacombinationofpersonalpayment,collectivesubsidyandgovernmentsubsidy.

Article21Thenewruralsocialpensioninsurancebenefitsaremadeupofbasicpensionsandpensionsfromthepersonalaccounts.

RuralresidentswhoparticipateinnewruralsocialpensioninsuranceandmeettheconditionsstipulatedbytheStatewillcollectnewruralsocialpensioninsurancebenefitsonamonthlybasis.

Article22TheStateestablishesandimprovesthesocialpensioninsurancesystemforurbanresidents.

People’sgovernmentsoftheprovinces,autonomousregionsandmunic
