ChapterIGeneralPrinciples

Article1Inordertostrengthenthecontroloversafetyofdangerouschemicals,toguaranteethepeople’slifeandpropertysafety,andtoprotecttheenvironment,theseRegulationsareherebyenacted.

Article2Production,operation,storage,transportation,anduseofdangerouschemicalsanddisposalofthewasteddangerouschemicalswithintheterritoryofthePeople’sRepublicofChinashallbegovernedbytheseRegulations,lawsandotheradministrativeregulationsoftheStateonproductionsafety.

Article3“Dangerouschemicals”asreferredtohereinincludeexplosives,pressuregas,liquefiedgas,inflammableliquid,inflammablesolid,spontaneouscombustiblearticles,combustiblematerialsincaseofmoisture,oxidants,organicperoxide,toxicarticles,corrosives,etc.

DangerouschemicalslistedontotheListofDangerousArticles（GB12268）promulgatedasthenationalstandard,thecatalogueofhyper-toxicchemicals,andotherdangerouschemicalsnotlistedontotheListofDangerousArticlesshallbedeterminedandannouncedbytheadministrativedepartmentinchargeofcomprehensivemanagementofeconomyandtradejointlywiththeadministrativedepartmentsinchargeofpublicsecurity,environmentalprotection,health,qualitycontrol,trafficcontrol,etcoftheStateCouncil.

Article4Thepersonnelchieflyinchargeofunitsthatmanufacture,dealin,store,transport,andusethedangerouschemicalsanddisposeofthewasteddangerouschemicals（hereinafterreferredtoasthe“unitsofdangerouschemicals”）mustguaranteethesafetycontrolfortheirowndangerouschemicalssatisfyprovisionsoftherelevantlaws,regulations,andrules,aswellasrequirementsofthenationalstandards,andberesponsibleforthesafetyoftheirowndangerouschemicals.

Thepersonnelengaginginthemanufacture,operation,storage,transportation,useofdangerouschemicalsordisposalofwasteddangerouschemicalsoftheunitsofdangerouschemicalsmusttakepartinthetrainingfortherelevantlaws,regulations,rules,safetyknowledge,professionalskills,vocationalsafetyprotection,andemergencyknowledge.Onlythosepassingtheexaminationmayholdtheirposts.

Article5Therelevantdepartmentsinchargeofsupervisionandadministrationofthemanufacture,operation,storage,transportation,useofdangerouschemicals,andthedisposalofthewasteddangerouschemicalsshallfulfilltheirresponsibilitiesaccordingtothefollowingprovisions:

（1）TheadministrativedepartmentinchargeofoverallmanagementofeconomyandtradeoftheStateCouncilandtheadministrativedepartmentsofeconomyandtradeofthepeople’sgovernmentsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralPeople’sGovernmentshall,inaccordancewiththeseRegulations,beresponsiblefortheoverallworkforthesupervisionandadministrationofsafetyofdangerouschemicals,beresponsibleforexaminationandapprovaloftheestablishment,reconstruction,andexpansionofenterprisesthatmanufactureorstoredangerouschemicals,beresponsiblefortheexaminationandappointmentoftheprofessionalmanufacturingenterprisesofpackingmaterialsorcontainers（includingtroughcontainersusedfortransportation,hereinafterinclusive）,beresponsibleforissuanceofthelicensesforoperationofdangerouschemicals,beresponsibleforregistrationofdomesticdangerouschemicals,beresponsiblefororganizingandcoordinatingtheemergencyrescueforthedangerouschemicalaccidents,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.Theadministrativedepartmentinchargeoftheoverallworkforsupervisionandadministrationofsafetyofdangerouschemicalsofthepeople’sgovernmentsofmunicipalities（withdistricts）andthepeople’sgovernmentsatthecountylevelshallbedeterminedbythepeople’sgovernmentsatalllevels,andfulfilltheirresponsibilitiesinaccordancewiththeseRegulations.

（2）Thepublicsecurityorgansshallberesponsibleforthepublicsecuritycontroloverdangerouschemicals,beresponsiblefortheissuanceofhyper-toxicchemicalpurchasecredenceandpurchaselicenses,beresponsibleforexamining,approving,andissuingroadtransportationpassesforhyper-toxicchemicals,beresponsibleforsupervisionoverthesafetyoftheroadtransportationofdangerouschemicals,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.

（3）Theadministrativedepartmentsinchargeofqualitycontrolshallberesponsiblefortheissuanceofthemanufacturelicensesfordangerouschemicalsandtheirpackingmaterialsaswellascontainers,beresponsibleforthesupervisionoverthequalityofpackingmaterialsandcontainersofdangerouschemicals,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.

（4）Theadministrativedepartmentsinchargeofenvironmentalprotectionshallberesponsibleforthesupervisionandadministrationofthedisposalofwasteddangerouschemicals,beresponsiblefortheinvestigationofseriousdangerouschemicalpollutionaccidentsandtheecologicaldamageincidents,beresponsiblefortheemergencymonitoringofthesitesoftoxicchemicalaccidentsandregistrationoftheimporteddangerouschemicals,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.

（5）Theadministrativedepartmentsinchargeofrailwaysandcivilaviationshallberesponsiblefortherailwayandairtransportationofdangerouschemicals,andthesafetycontrol,supervision,andexaminationofrailwayandairtransportationunitsfordangerouschemicalsandtheirmeansoftransport.Theadministrativedepartmentsinchargeofcommunicationsshallberesponsibleforthesafetycontrolofthehighwayandwaterwaytransportationunitsfordangerouschemicalsandtheirmeansoftransport,andthesupervisionoversafetyinthewaterwaytransportationofdangerouschemicals,beresponsiblefordeterminingtheprofessionallevelsofhighwayandwaterwaytransportationunitsfordangerouschemicals,drivers,shipmen,loadingandunloadingpersonnel,andtransportescorts,andberesponsibleforthesupervisionandexaminationoftheaforesaidmatters.

（6）Theadministrativedepartmentsinchargeofhealthshallberesponsiblefortheauthenticationoftoxicityofdangerouschemicals,andthemedicalrescueofthepersonnelwhodieorareinjuredduetoaccidentsofdangerouschemicals.

（7）Theadministrationsforindustryandcommerceshall,inaccordancewiththeapprovalorlicensesoftherelevantdepartments,issuethebusinesslicensesforunitsthatmanufacture,dealin,store,ortransportdangerouschemicals,andsuperviseandadministerthebusinessoperationsinthedangerouschemicalmarket.

（8）Theadministrativedepartmentsinchargeofpostshallberesponsibleforthesupervisionandexaminationofdangerouschemicalssentbypost.

Article6TherelevantdepartmentsinchargeofsupervisionandadministrationofunitsofdangerouschemicalsinaccordancewiththeseRegulationsmayexercisethefollowingpowersinthecourseofsupervisionandexaminationaccordingtolaw:

（1）Toenterintotheoperatingsitesofdangerouschemicalstomakethespotexamination,totransfertherelevantmaterials,andlearntherelevantinformationformthepersonnelconcerned,andtotabletheproposalsforunitsofdangerouschemicalstomakerectificationandimprovement;

（2）Toorderthepartiesconcernedtoeliminatethehiddenrisksofaccidentsofdangerouschemicalsforthwithorwithinaspecifiedtimelimitwhensuchrisksarediscovered;

（3）Toorderthepartiesconcernedtoceaseforthwiththeuseoffacilities,equipment,apparatus,andmeansoftransportthatfailstomeettherelevantlaws,regulations,rules,andnationalstandardsbasedonevidence;

and

（4）Tomakecorrectionsonthespot,ortoorderthepartiesconcernedtomakecorrectionswhenfindingtheillegalacts.

Unitsofdangerouschemicalsshallbesubjecttothesupervisionandexaminationconductedbytherelevantdepartmentsaccordingtolawwithoutrefusalorhindrance.

Whenperformingtheirdutiesofsupervisionandexamination,thepersonnelassignedbytherelevantdepartmentsshallproducetheircertificates.

ChapterIIManufacture,Storage,andUseofDangerousChemicals

Article7TheStatecarriesouttheunifiedplanning,rationalarrangement,andstrictcontroloverthemanufactureandstorageofdangerouschemicals,andimplementsthesystemtoexamineandapprovethemanufactureandstorageofdangerouschemicals.WithoutexaminationandapprovaloftheState,anyunitsandindividualsshallnotmanufactureorstoragedangerouschemicals.

Thepeople’sgovernmentsatthemunicipalitylevel（withdistrictsestablishedwithinthemunicipality）shall,accordingtothelocalactualdemandfortheeconomicdevelopment,allocatetheappropriateareastobespecializedforthemanufactureandstorageofdangerouschemicalsinaccordancewiththeprincipleofensuringsafetywhenmakingtheoverallplanning.

Article8Anenterpriseformanufactureorstorageofdangerouschemicalsmustfulfillthefollowingqualifications:

（1）Itshallhavethemanufacturetechniques,equipment,orwarehousingmeansandfacilitiesmeetingthenationalstandards;

（2）ThedistanceofprotectionaroundfactoriesandwarehousesshallmeetthenationalstandardsortherelevantprovisionsoftheState;

（3）Itshall
