JUDGEFITZWATER:

Goodmorning,everyone.OnbehalfofJudgeJeffreyS.Sutton,andthemembersoftheCommitteeonRulesofPracticeandProcedureoftheJudicialConferenceoftheUnitedStates,mycolleaguesontheAdvisoryCommitteeonEvidenceRules,andourCommitteeReporter,ProfessorDanCapra,welcometotheSymposiumontheChallengesofElectronicEvidence.

WeareindebtedtotheUniversityofMaineSchoolofLawforitswillingnesstohostthissymposium,notonce,buttwice,becausewewerescheduledtoholdthesymposiumlastOctoberbeforethegovernmentshutdowncausedittobecancelled.IwanttoparticularlythankDeanPeterPitegoffandProfessorDeirdreM.Smithformakingthesymposiumpossibleandforthewarmwelcomeourcommitteehasreceived.IalsowanttothankourcolleagueontheEvidenceCommittee,ChiefJudgeJohnA.WoodcockoftheDistrictofMaineforhisgracioushandinensuringasuccessfulsymposiumandmeetingoftheEvidenceRulesCommittee.

ThisisthethirdinaseriesofsymposiathattheEvidenceRulesCommitteehasconvened.In2011,weheldasymposiumattheWilliam&

MaryMarshall-WytheCollegeofLawonthethen-newly-adoptedRestyledRulesofEvidence.

Theunderlyingpurposesofthatsymposiumincludedenhancingunderstandingoftherestyledrulesbyexploringthepainstakingprocessbywhichtheywereformulatedandidentifyingevidencerulesissuesthatremaintoberesolvedevenafterrestyling.

In2012,weconvenedasymposiumattheCharlestonSchoolofLaw,devotedtoasingleruleofevidence--Rule502,aRuleofEvidenceadoptedbyActofCongressattherequestoftheJudicialConferenceoftheUnitedStates--todiscusswaysinwhichthatrulecouldbebetterknownandunderstoodsothatitcouldfulfillitsoriginal,salutarypurposes.

Attoday'

ssymposium,weareproceedingfromthatmorenarrowexaminationofoneRuleofEvidencetoaconsiderablybroaderconversationaboutasubjectthatisaswide-rangingandseeminglylimitlessasthedigitalworldoftoday.WeareconsideringthechallengesthatelectronicevidenceposestotheRulesofEvidence.

Inarealsense,weareaskingourselveswhetherrulesthathavebeenthoughtfullydevelopedovertime--someoveraverylongperiodoftime--toensurethateveryproceedingisadministeredfairly,withoutunjustifiableexpenseanddelay,toascertainthetruthandsecureajustdetermination,havecontinuingvitalitywhenmeasuredagainsthowpeoplespeak,act,andthinkinanelectronicworld.

Wearefortunateindeedtohavedrawnagainfromthebestandthebrightesttoparticipateaspanelistsinthissymposium.Theyrepresentatrulydistinguishedgroupofjudges,lawyers,andscholars.

AsIhavesaidofourpriorpanelists,theyaredistinguished,notmerelybecausetheyareaccomplishedindividuals,butbecausetheyhaveexpertiseandextensiveexperienceaddressingtheissuesthatappeartobemost*1165pertinenttothebench,tothebar,andtheacademy--indeed,tothepurposesforconveningthissymposium.

Byconveningthissymposium--andbyarrangingfortheseproceedingstobeaddedtothelegalliteraturethroughpublicationintheFordhamLawReview--theAdvisoryCommitteeonEvidenceRulesisattemptingtoanticipateandaddressproactivelytechnologicalchangesthatseemalmostcertaintoincreaseinspeedandcomplexity.

ToparaphraseWinstonChurchill,thisisnottheendofthisprocess.Itisnoteventhebeginningoftheend.Butitis,perhaps,theendofthebeginning.

Wearefortunatetohaveassembledagroupofnotedjudges,practitioners,andacademicianstoassistinthisworthygoal.IwelcomeyoualltothisSymposiumontheChallengesofElectronicEvidence.

Andwearefortunatetohavewithustodayoneofourhosts,DeanPeterPitegoff.Dean.

JohnHariedistheCriminalDiscoveryCoordinatorfortheExecutiveOfficeofUnitedStatesAttorneysintheDepartmentofJustice,wherehecoordinatesdiscoverypolicyandtrainingfortheDepartment'

GregwascochairoftheThirdCircuitTaskForceonSelectionofClassCounsel.He'

sthepresidentoftheU.S.SupremeCourtHistoricalSociety,andafounderofJosephHageAaronson,alawfirmwithofficesinNewYorkandLondon.Andhe'

stheauthorofModernVisualEvidence.[FN2]
